Return Requirement

The Adopter agrees that if, at any time, they are unable or unwilling to continue caring for the Dog, the Dog must be returned to Pipers Paw’s Rescue Inc.  The Adopter may not rehome, give away, sell, or otherwise relinquish the Dog to any person or organization without the Rescue’s express written consent. Acknowledgement of Obligation

By signing this Adoption Agreement, the Adopter acknowledges and agrees that this obligation is binding. 

No “ifs, ands, or buts” — the Dog must be returned to the Rescue if needed. 

Enforcement and Remedies
If the Adopter fails to comply with this provision, the Rescue may, at its option, use any legal remedy available, including but not limited to seeking a court order for the return of the Dog. The Adopter agrees to reimburse the Rescue for reasonable costs incurred in the recovery of the Dog, including, but not limited to, transportation costs, legal fees, and boarding costs, should legal steps become necessary. 

Delaware State Law Compliance
This clause is consistent with Title 16, Delaware Code, § 3003F – Animal Adoption, Recovery, and Rehabilitation, which imposes certain duties on animal shelters and rescues regarding adoption, reclamation, and animal recovery.   Under § 3003F, shelters must provide a minimum holding period of three (3) business days for animals in their care to allow reclamation by previous owners before adoption.   

The Rescue’s requirement for return does not conflict with Delaware law regarding owner-initiated return or surrender of animals. It provides a “right of first refusal” rather than conflicting with statutory standards for holding periods, owner reclamation, or shelter operations.

Severability
If any portion of this clause is found to be invalid or unenforceable under applicable law, the remainder of this clause will remain in full force and effect. 

Acknowledgement
Adopter confirms that they have read, understand, and agree to all the provisions of this clause, including the binding return requirement.
