I do hereby consent to participate in a wellness coaching program directed by Embody Sage, LLC that includes online group coaching and wellness classes (the “Program”).  I do so entirely at my own risk. I understand that all activities have some inherent risk.  In this case, I state that I am healthy enough to participate in the Program.  If necessary, I have been cleared by my doctor to participate in the Program. I will be responsible for dressing appropriately for the Program and providing my own equipment and water.  

I acknowledge and agree that no warranties, claims, representations, or guarantees have been made to me regarding the efficacy or results I will achieve from this Program. I understand that results are individual and may vary.

I assume all risks and hazards associated with the Program.  By signing below, I hereby release, absolve and indemnity Embody Sage, LLC, its owners, employees and contractors from all risks and hazards associated with the Program. To the extent permitted by law, I hereby waive any claims against Embody Sage, LLC, its owners, employees and contractors.  
I further agree to indemnify and hold harmless Embody Sage, LLC, its members, officers, agents, employees and independent contractors, to the fullest extent permitted under law, from any and all liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in the Program.
This agreement is governed by the law of North Carolina.  Any dispute related to the Program or this agreement must be brought in the state or federal courts located in Mecklenburg County, NC.  I agree to the jurisdiction and venue of these courts for such dispute.  In any litigation related to the Program or this agreement, I agree that the non-prevailing party will bear all costs, including court costs and reasonable attorneys’ fees.  

I acknowledge that I have carefully read this “consent and waiver” and fully understand that it is a release of liability. By submitting this Embody Sage Consent and Waiver Form, I hereby agree to be bound to the terms and conditions of the Form.
