反對浸大處分學生會成員之聯署聲明 Joint statement against HKBU’s punishment towards SU members

聯署背景:4月17日,香港浸會大學傳訊公關處向傳媒發表一篇「浸大對有關學生會投訴的聲明」,表示收到就學生會第五十六屆幹事會「滄溟」競選政綱內容的投訴。校方指「幹事會在網上平台發布的資料,部份對過去事件的描述,出現誇大、缺乏事實根據及偏頗的情況,並不符合社會的標準和價值觀。」學生事務處認為幹事會成員違反《Standards of Conduct》的第4條「學生應尊重基本的文明觀念,並確保他們的行為不會傷害任何人或團體。」例子16「誹謗個人或團體、仇恨言論、辱罵、冒犯、淫穢或威脅性語言或表達。」因此認定投訴成立,對幹事會全體成員作出紀律處分,更禁止幹事長、內務副幹事長、外務副幹事長及外務秘書參與校政及學生組織為期16個月。

浸大學生會正處於危急存亡之秋,極需學生以及社會各界人士支持及關注。故此聯署為反對校方懲處發起,希望藉此促請校方撤回處分,同時向被處分的學生會成員表達支持

聯署內容:
譴責校方
1)以違反社會標準為由懲罰學生會成員的做法不恰當
2)在整個紀律程序當中,被處分學生沒有就指控作出辯護的機會,有違程序公義
3)學生事務處在公布紀律處分後,沒有公布相關調查報告,有礙上訴的公平性和上訴人的勝數
4)校方一方面以「違反社會標準」的指控來懲處學生,另一方面則沒有跟從社會標準進行紀律聆訊,做法雙重標準,有「輸打贏要」之嫌

要求校方
1)立即公布相關調查報告
2)撤回校方對學生會成員之處分

同意
1)被處分成員沒有違反社會標準
2)被處分成員上訴到底

Background information: According to the statement released by the Hong Kong Baptist University Communication and Public Relations Office on April 17 regarding the complaint against the "Aqua" campaign platform of the 56th Student Union Executive Committee, the university has received a complaint about the content of the election platform. The university claimed that "some of the information posted by the Executive Committee on the online platform contains exaggerated, unfounded, and biased descriptions of past events, which do not conform to social standards and values." The Office of Student Affairs has ‘found’ that the Executive Committee members have violated the Standards of Conduct No.4: students are expected to respect basic notions of civility and to ensure their conduct does not harm any person or group, and example of misbehavior No. 16: defamation of a person or group, hate speech, abusive, offensive, obscene, or threatening language or expressions. Therefore, the complaint is upheld, and disciplinary action has been taken against all members of the Executive Committee, even suspending the President, Internal Vice-President, External Vice-President, and External Secretary from holding positions or participating in the governance of the University's student bodies and committees with immediate effect until 31 August 2024. 

HKBUSU is currently in a critical situation and urgently needs support and attention from students and society. As such, this petition has been launched to oppose the disciplinary actions taken by the university, in the hope that the university will withdraw the punishments, and support can be shown to the affected SU Exco members. 

Joint statement Content
We condemn the actions of the university administration:
1) The punishment of student union members on the grounds of violating social norms is inappropriate.
2) Throughout the entire disciplinary process, the students who were punished did not have the opportunity to defend themselves against the charges, which violates procedural justice.
3) After announcing the disciplinary actions, the Office of Student Affairs did not release the relevant investigation report, which undermines the fairness of appeals and the chances of success for appellants.
4) On the one hand, the university administration punished students on the grounds of violating social norms, but on the other hand, did not follow social norms during the disciplinary hearing. This double standard approach is unfair and biased.

We demand that the university administration:
1) Immediately release the relevant investigation report.
2) Withdraw the punishment of HKBUSU Exco members.

We agree that:
1) The punished members did not violate social norms.
2) The punished members have the right to appeal.
