Everyone who books an experience with Sparkling Diva Mini Spa and participates in the event activities must sign a valid Sparkling Diva Mini Spa waiver. Every child must have the waiver signed and completed by a parent, legal guardian, or someone with power of attorney.

COMPLETING THE WAIVER IS REQUIRED TO PARTICIPATE IN SPARKLING DIVA MINI SPA ACTIVITIES; NO EXCEPTIONS.

Sparkling Diva Mini Spa is NOT RESPONSIBLE for injuries, accidents, slips and falls, choking, or allergies during the event activities.

SPARKLING DIVA MINI SPA SERVICES ARE NOT PERFORMED BY A LICENSED COSMETOLOGIST AND ARE FOR ENTERTAINMENT PURPOSES ONLY. We do not use cuticle tools or harsh chemicals during our mini manicure and mini pedicure services. We will attempt to use products that are considered safe for children; however, we cannot guarantee that there will not be an allergic reaction to products used for the skin, hair, and nails. Unfortunately, skin damage or minor allergic reactions can result from these kinds of activities. SPARKLING DIVA MINI SPA is not responsible for any allergic reactions due to any services, costumes, or the consumption of our signature beverages before, during, or after the event.

SPARKLING DIVA MINI SPA is not responsible for any allergic reactions caused by our party favor cosmetics, which include nail polish, lip gloss, lipstick, eyeshadow, and nail stickers, or by any party favors or anything else given by Sparkling Diva Mini Spa to any child. It is the responsibility of the guest’s parent or guardian to inform Sparkling Diva Mini Spa staff of any allergies or dietary restrictions. Sparkling Diva Mini Spa is not responsible for any slip and fall accidents or any accidents in general. Sparkling Diva Mini Spa is not responsible for any transmitted diseases, viruses, head lice, and/or bacteria. The Sparkling Diva Mini Spa staff are trained professionals and will work to ensure that you and your guests are treated in the most respectful manner and in a safe environment.

In consideration of being allowed to participate in the Sparkling Diva Mini Spa activities event, the undersigned, on behalf of the identified minor, acknowledges, appreciates, and agrees that:

1. Services can be hazardous and dangerous. I understand that these activities can result in serious injury to the child. I assume any and all risks, damages, or injuries that may occur during the Sparkling Diva Mini Spa activities and events.

2. I am aware of the risks, hazards, and dangers of personal injury, allergic reactions, choking, disability, and/or death as a result of participation in Sparkling Diva Mini Spa activities.

3. I have read a copy of the rules for the Sparkling Diva Mini Spa events and understand that it is my responsibility to ask questions about them if necessary. I also understand that it is my responsibility to monitor my child(ren) and my own actions.

4. In consideration for the participation of my child, I hereby release, waive, and forever discharge and covenant not to sue Sparkling Diva Mini Spa LLC and its owners, employees, officers, directors, trustees, binding heirs, executors, administrators, assigns, and all other persons or entities acting on its behalf, from any and all claims, actions, damages, liabilities, costs, or expenses—including attorney fees—that are related to, arise out of, or are in any way connected to my child(ren)'s participation in the event activities, including those that may arise out of the negligence of other participants.

5. I acknowledge that my child(ren)’s participation in the Sparkling Diva Mini Spa event activities is strictly voluntary.

I hereby certify I am over 18 years of age; I have carefully read the foregoing covenants not to sue and acknowledge that I understand and agree to all of the above terms and conditions. Prior to signing this agreement, I have had an opportunity to ask any questions, and I am aware that by signing this waiver and agreement, I am assuming all risks and potential injuries while on the premises.

Lastly, I expressly represent that I have the authority, express or implied, to permit my child(ren)'s participation in the Sparkling Diva Mini Spa events prior to signing this agreement, and I am assuming all risks and potential injuries.

I, the undersigned parent or guardian, assume all risks and hazards incidental to participating in the activities and hereby waive, release, absolve, and hold harmless Sparkling Diva Mini Spa, its owners, staff, and participants for any claim arising out of any injury to my child to the fullest extent allowed by law. I, the undersigned parent or guardian of the participant, am fully aware of the potential dangers and risks inherent in this activity, including physical injury, death, or other consequences that may arise or result directly or indirectly from participation in the event activities. "If any provision of this clause is held unlawful, void, or for any reason unenforceable by a court of competent jurisdiction, then any such provision shall be deemed severable from this clause and shall not affect the validity and enforceability of the remaining provisions."

I, the parent or legal guardian of the child/children mentioned above, grant Sparkling Diva Mini Spa my permission to use photographs taken during this event for any legal use, including but not limited to: publicity, copyright purposes, illustrations, advertising, and web content. Furthermore, I understand that no royalty, fee, or other compensation shall become payable to me by reason of such use.

Due to the outbreak of the novel COVID-19 (Coronavirus), Sparkling Diva Mini Spa is taking precautions with the intake of each client, health history reviews, as well as sanitation and disinfecting practices.

Symptoms of COVID-19 (Coronavirus) include:

Common symptoms:

• Fever

• Tiredness

• Dry cough

Some people may experience:

• Aches and pains

• Nasal congestion

• Runny nose

• Sore throat

• Diarrhea

I understand the above symptoms and I affirm that my child does not currently have, nor has experienced, the symptoms listed above within the last 60 days. I affirm that my child, as well as all household members, have not been diagnosed with COVID-19 (Coronavirus) within the last 60 days. I affirm that my child has not knowingly been exposed to anyone diagnosed with COVID-19 (Coronavirus) within the last 60 days. I affirm that my child has not traveled outside of the country, or to any other city outside of our own that is or has been considered a “hot spot” for COVID-19 (Coronavirus) infections, within the last 60 days.

I understand that Sparkling Diva Mini Spa and its owners, agents, employees, officers, directors, trustees, binding heirs, executors, administrators, assigns, and all other persons or entities acting on its behalf cannot be held liable for any exposure to COVID-19 (Coronavirus) or any other contagion caused by misinformation on this form or the health history provided by each client. I understand that Sparkling Diva Mini Spa will NOT be liable if my child falls ill with COVID-19 (Coronavirus) either before, during, or after participating in the Sparkling Diva Mini Spa event activities.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
