Everyone that books an experience with Sparkling Diva Mini Spa participating in the activities event, must sign a valid Sparkling Diva Mini Spa waiver. Every children must have the waiver signed and completed by the parent, legal guardian or someone with power of attorney.
COMPLETING THE WAIVER IS REQUIRED TO PARTICIPATE AT THE SPARKLING DIVA MINI SPA ACTIVITIES, NO EXCEPTIONS.

Sparkling Diva Mini Spa is NOT RESPONSIBLE for injuries, accidents, slip & falls, choking, and allergies during the event activities.
SPARKLING DIVA MINI SPA SERVICES ARE NOT PERFORMED BY A LICENSED COSMETOLOGIST AND IS FOR ENTERTAINMENT PURPOSES ONLY. We do not used cuticles tools or harsh chemical during our mini manicure and mini pedicure services. We will attempt to use products that are considered safe for children however, we cannot guarantee that there will not be an allergic reaction to products being used for skin, hair, and nails. Unfortunately, skin damage or minor allergic reactions can result from these kinds of activities. SPARKLING DIVA MINI SPA is not responsible for any allergic reaction due to any services, costumes or consuming our signature beverage before, during or after the event.
SPARKLING DIVA MINI SPA is not responsible to any allergic reaction caused by our party favors cosmetics which includes nail polish, lip gloss, lip stick, eye shadow and nail sticker or to any party favors or anything given from Sparkling Diva Mini Spa to any child. It is the responsibility of the guest’s parent guardian to inform Sparkling Diva Mini Spa staff of allergies or any dietary restrictions. Sparkling Mini Diva Spa is not responsible to any slip or fall accidents or any accidents in general. Sparkling Diva Mini Spa is not responsible to any transmitted diseases, viruses, head lice and or bacteria’s. The Sparkling Mini Diva Spa staff are trained professionals and will work to ensure that you and the guests are treated in the most respectable manner and in a safe environment.
In consideration of being allowed to participate in the Sparkling Diva Mini Spa activities event
the undersigned on behalf of the minor identified acknowledges, appreciates and agrees that:
1. Services can be hazardous and dangerous. I understand that these activities can result in serious injury to the child. I assume any and all risk and damage or injury during the Sparkling Diva Mini Spa activities events.
2. I am aware of the risk, hazards and danger of personal injury, allergic reactions, choking, disability and/or death as a result of participation at the Sparkling Diva Mini Spa activities.
3. I have read a copy of the rules of the Sparkling Diva Mini Spa events and understand that it is my responsibility to ask questions about them if necessary. I also understand, it is my responsibility to monitor my child(ren) and my own activities.
4. In consideration for the participation of my child, I hereby release, waive and forever discharge and covenant not to sue Sparkling Diva Mini Spa LLC and its owners, employees, officers, directors, trustees, binding heirs, executors, administrators, assignees, and all other persons or entities acting on its behalf, from any and all claims, actions, damages, liability, cost or expense including attorney fees which are related to or arise out of or in any way connected to my child(ren) participation in the activities events including those that may arise out of the negligence of other participants.
5. I acknowledge that my child(ren)’s participation at the Sparkling Diva Mini Spa activities events is strictly voluntary.
I hereby certify I am over 18 years of age; I have carefully read the foregoing covenants not to sue and acknowledge that I understand and agree to all of the above terms and conditions. Prior to signing this agreement, I have had an opportunity to ask any questions and I am aware that by signing this waiver and agreement, I am assuming all risks and potential injury while on the premises.
Lastly, I expressly represent that I have the authority, expressed or implied, to permit my child(ren) participation at the Sparkling Diva Mini Spa events prior to signing this agreement and I am assuming all risks and potential injury.
I, the undersigned, parent guardian assume all risk and hazards incidental to participating in the activities and hereby waive, release, absolve, and hold harmless Sparkling Diva Mini Spa, owners, staff and participants for any claim arising out of any injury to my child to the fullest extent allowed by law. I, the undersigned, parent guardian of the participant, am fully aware of the potential dangers and risk inherent in this activity, including physical injury, death or other consequences that may arise or result directly or indirectly from participation in the activities events. “If any provision of this clause is held unlawful, void, or for any reason unenforceable by a court of competent jurisdiction, then any such provision shall be deemed sever able from this clause and shall not after the validity and enforceability of the remaining provisions.”
Minor (Child) Photo Release Form:
I, the parent or legal guardian of the child/ children mentioned above grant Sparkling Diva Mini Spa my permission to use photographs taken during this event for any legal use, including but not limited to: publicity, copyright purposes, illustrations, advertising and web content. Furthermore, I understand that no royalty, fee or other compensation shall become payable to me by reason of such use.
Precautionary COVID-19, Coronavirus Liability Release Form
Due to the 2019-2020 outbreak of the novel COVID-19 (Coronavirus), Sparkling Diva Mini Spa is taking precautious with the intake of each client, health history review, as well as sanitations and disinfecting practices.
Symptoms of COVID-19 (Coronavirus) include:
Common symptoms:
· fever.
· tiredness.
· dry cough.
Some people may experience:
· aches and pains.
· nasal congestion.
· runny nose.
· sore throat.
· diarrhea.
I understand the above symptoms and I affirm that my child does not currently have, nor have experienced the symptoms listed above within the last 60 days. I affirm that my child, as well as all households’ members, have not been diagnosed with COVID-19 (Coronavirus) within the last 60 days. I affirm that my child has not knowingly been exposed to anyone diagnosed with COVID-19 (Coronavirus) within the last 60 days. I affirm that my child has not traveled outside of the country, or to any other city outside of our own that is or has been considered a “hot spot” for COVID-19 (Coronavirus) infections within the last 60 days.
I understand that Sparkling Diva Mini Spa and its owners, agents, employees, officers, directors, trustees, binding heirs, executors, administrators, assignees, and all other persons or entities acting on its behalf cannot be held liable for any exposure to the COVID-19 (Coronavirus) or any other contagion caused by misinformation on this form or the health history provided by each client. I understand that Sparkling Diva Mini Spa will NOT be liable if my child, fall ill with the COVID-19 (Coronavirus); either before, during or after coming to participating to the Sparkling Diva Mini Spa activities events.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
