I, as a parent or legal guardian of the child named above, have the authority to sign this liability waiver and release agreement on behalf of my child, myself, and all family members.
I acknowledge and understand that my child's participation in SummerGATE may involve risks of "Loss," defined to include (without limitation) injury, disability, disfigurement, illness, death, property damage, economic loss, and other losses, present and future. Such Loss might result wholly or partly, or directly or indirectly, from my child’s actions, inactions, negligence, or intentional acts, or from the actions, inactions, negligence, or intentional acts of others, including but not limited to other children, adults, people, animals, objects, food, liquids, gases, natural forces, events, sounds, tools, equipment, and conditions of the premises, or indeed through no fault of anyone or anything. I further acknowledge and understand that there may be risks of Loss not mentioned here, as well as risks of Loss that may be known or unknown, foreseeable or unforeseeable, expected or unexpected, imagined or unimagined, and predictable or unpredictable. ALL risks of Loss and all types of Loss are encompassed herein.
The "Released Parties" are defined to include (without limitation) SummerGATE, Gifted and Talented Education, their affiliated organizations, and all of their employees, teachers, assistants, volunteers, agents, administrators, staff members, independent contractors, board members, officers, affiliates, and other associated people and entities, including without limitation the owners and personnel of the facilities and venues used by SummerGATE.
I hereby assume ALL risks of Loss for which I, my child, or any family member might make a claim against any of the Released Parties. I hereby accept personal responsibility, vis-à-vis the Released Parties, for ALL damages that result or might result from such Loss.
On behalf of myself, my child, and all family members, I hereby release, discharge ALL claims against, waive ALL rights against, and agree not to sue, make any claims against, or seek any compensation or damages from the Released Parties for any Loss or liability that arises from or is connected with, in any way whatsoever, my child’s presence at or participation in SummerGATE or presence at any of the facilities or venues used by SummerGATE during the SummerGATE program.
I hereby agree to defend, indemnify, and hold harmless the Released Parties with respect to any claims or suits that might be asserted by anyone (including without limitation by myself, my child, family members, or any others, including other SummerGATE participants or their families) against any of the Released Parties, where the theory of the Released Parties' liability, whether vicarious or direct or other, is based wholly or partly on the acts or omissions of my child or on the acts or omissions of any of the Released Parties in connection with my child.
Signing this liability waiver and release agreement is a condition of my child's participation in SummerGATE.
