UMass Lowell Kayak Center & Boathouse Release of Liability

Important: Read this entire document before signing. Do not sign until you understand all of the information contained in this document and the risks involved in this experience.
Participation: I understand that UMass Lowell is making available to me the opportunity to participate in a boathouse program and that participation in these activities is not mandatory. I also understand that I am free to choose not to participate in any aspect of the event or experience if it is beyond my ability or if it entails risks that I do not wish to accept.

Risks: Although safety is the overriding concern on all boathouse activities, I understand that there is risk of bodily injury or death due to conditions such as cold water, current, steep terrain, slippery rocks, insects and animals, extreme or inclement weather. Most activities require physical exertion; they include, but are not limited to kayaking, canoeing, and rowing. By choosing to be a participant in these activities, I acknowledge that although the boathouse staff is trained and will take all reasonable precautions to ensure my safety, they cannot guarantee my absolute safety, as there are inherent risks involved in adventure programming. By signing this agreement I also understand that UMass Lowell does not directly insure me against accidents or injuries which occur while I am participating in these activities. Insurance that may provide coverage for these kinds of injuries is available for purchase by my family or me.

Motor
Vehicle: UMass Lowell (the “University”) does not provide for insurance of the use of personal vehicles even if it is used in conjunction with a University activity. In that case, I understand that liability for accidents and/or injuries is responsibility of the owner/driver of that vehicle.

I hereby assume any and all risk connected with my participation, and based on this knowledge, I agree to indemnify and hold harmless the Commonwealth, the University, its Trustees, officers, employees, students or agents from and against any and all claims, liability, losses, third party claims, damages, costs, or expenses (including attorneys’ fees) arising out of or resulting from my participation in this program. I understand that this release covers liability, claims and actions caused entirely or in part by any acts or failure to act of negligence, mistake, or failure to supervise or train, or any other conduct by the University. I recognize that this release means I am giving up, among other things, rights to sue the University, its Trustees, employees and agents for injuries, damages or losses I may incur. I also understand that this release binds my heirs, executors, administrators and assigns, as well as myself.
