Risks: Although safety is the overriding concern on all boathouse activities, I understand that there is risk of bodily injury or death due to conditions such as cold water, steep terrain, slippery rocks, insects, and animals, extreme or inclement weather. Most activities require physical exertion; they include, but are not limited to kayaking, canoeing, and rowing. By choosing to be a participant in these activities, I acknowledge that although the boathouse staff is trained and will take all reasonable precautions to ensure my safety, they can not guarantee my absolute safety, as there are inherent risks involved in adventure programming. By signing this agreement I also understand that UMass Lowell does not directly insure me against accidents or injuries which occur while I am participating in these activities. Insurance that may provide coverage for these kinds of injuries is available for purchase by my family or me.
Motor Vehicle The University of Massachusetts (the “University”) does not provide for insurance of the use of personal vehicles even if it is used in conjunction with a University activity. In that case, I understand that liability for accidents and/or injuries is responsibility of the owner/driver of that vehicle.
Based on this knowledge, I agree to indemnify and hold harmless the Commonwealth, the University, its Trustees, officers, agents and employees from and against any and all claims, liability, losses, third party claims, damages, costs, or expenses (including attorneys’ fees) arising out of or resulting from my participation in this program.
