I agree to the following Waiver Agreement and Liability Release (“Agreement”) with Take the Lead Horsemanship, LLC and its Owner, employees, agents and representatives (collectively “Owner”) as a condition and in consideration for them allowing myself, and the other persons identified below, to enter the Owner’s premises, land, leased premises, structure or facilities located at 6800 Scioto Darby Road, Hilliard, OH 43026 (“Premises”) and engage or participate in equine activities including, but not limited to, those as set forth in Ohio Revised Code Section 2305.321(A)(2) or otherwise be near or in the presence of equines, regardless of Ownership of said equines, on the Premises. I am making this Agreement regardless of whether these equine activities take place under the supervision of Owner. This Agreement will be binding at all times, now and in the future, even after my relationship with Owner should end.1. EQUINE ACTIVITIES ON PREMISES: I have requested to enter the Premises where Owner conducts and/or allows equine activities. I expressly acknowledge that I am doing so to engage in equine activities, whether or not under Owner’s supervision. I further expressly acknowledge that while on Premises that I will be near or in direct proximity of equines and equine activities.2. EQUINE-RELATED RISKS: I understand that anyone riding, handling, or even near an equine can suffer bodily and other injuries. Among other things, equines are unpredictable by nature. For example, when frightened, angry, or under stress, the natural instincts of an equine are to jump forward or sideways or run away from danger by trotting or galloping. Equines are also known to kick, buck, rear up, back up quickly, spin around, strike, or bite. I expressly acknowledge and understand that equines can do any of these things without warning. I also acknowledge and understand that all equines, even if they have no known history of hurting people or animals, are unpredictable. Equines are powerful and can be dangerous to people and other animals.Further, I understand there are inherent risks of being involved in equine activities. These include but are not limited to: the propensity of an equine to behave in ways that may result in injury, harm, or death to persons around the equine; the unpredictability of an equine’s reaction to sounds, sudden movements, and unfamiliar objects, persons or other animals; hazards such as surface or subsurface conditions on, near, or off of the Premises; and/or collisions with other equines, animals, persons or objects; and the potential of an equine activity participant to act in a negligent manner that may contribute to injury, death, or loss to the person of the participant or to other persons, including, but not limited to, failing to maintain control over an equine or failing to act within the ability of the participant. I understand these risks and dangers inherent in equine activities, and I agree to assume them. I also understand that these are just some of the risks, and I agree to assume all other equine related risks. I am not relying on Owner to list all possible equine related risks for me. 3. LIABILITY RELEASE: As consideration for being permitted to enter the Premises, be near equines, engage in equine activities and/or to engage in any other activity involving equines, whether or not under Owners supervision, I agree to assume full responsibility for any and all bodily injuries or other damages which I may sustain while engaging in these and other activities. The term "damages" includes, but is not limited to, any and all medical expenses, economic loss, compensatory damages, property damages, damages for pain and suffering, personal property damages and/or punitive damages. Further, I, for my heirs, administrators, personal representatives or assigns, release and discharge Owner and its heirs, assigns, administrators, officers, directors, employees, agents, representatives, affiliated persons, and others acting on their behalf of and from any and all claims, demands, damages, omissions, suits, and present and future causes of action, whether known or unknown, anticipated or unanticipated, resulting from or arising out of any and all of my activities which may occur as a result from being on Premises, handling equines, the inherent risks of equine activities, being near or in close proximity of an equine, and engaging in equine activities, and/or engaging in any other activity involving equines, whether or not under Owner’s supervision (except if such injury or damage is caused by Owner’s gross negligence or wanton or willful misconduct). I expressly acknowledge and agree that under the Ohio Equine Activity Liability Act (ORC Section 2305.321 et. seq.) Owner is an equine activity sponsor and/or equine professionals and they are not liable for an injury to or the death of a participant in an equine activity resulting from an inherent risk of equine activity.
