Liability Waiver: By checking the “I agree” checkbox, I understand that I will be volunteering for the Toronto Cares community initiative. IN CONSIDERATION OF being permitted to participate as a Volunteer in Toronto Cares, I hereby acknowledge and agree that:• I am participating in Toronto Cares as a volunteer and not as an employee of or providing employment services to Toronto Cares. I understand and agree that I am participating in Toronto Cares freely as a volunteer, on my personal time, and not as a condition or extension of my employment;• As a volunteer, I will not, either now or in the future, receive any financial remuneration, salary, wage, payment or any employee benefit whatsoever, or be covered by Workplace Safety and Insurance benefits through Toronto Cares;• I will not be accorded any employment rights by Toronto Cares and nothing in this Agreement or Toronto Cares volunteer initiative shall be construed as creating a partnership, employment, internship or agency relationship between me and Toronto Cares;• Except as authorized, I will not be provided with or use the Toronto Cares’ facilities and equipment;• I accept and fully assume all risks, loss, injury or damage, without qualification, that may arise out of or result from my participation in this, including economic loss, death to myself or damage to my property wherever sustained including on public streets or elsewhere;• I release Toronto Cares and its volunteers, employees, agents and assigns for any and all claims for personal injury and/or property damage that may arise from or be in any way connected to my participation as a volunteer for Toronto Cares. I understand that this release applies to both present and future injuries and that it binds my heirs, executors and administrators;• In the course of or incidental to my participating as a volunteer in Toronto Cares, I may be in receipt of confidential information including, but not limited to, information about individuals experiencing homelessness, including specific individual identities, materials, records, memoranda, data and results pertaining to, arising from or containing particulars of confidential information. I agree to keep all completed paper surveys secure while they are in my possession and to return all materials pertaining to the survey to Toronto Cares upon completion of the tasks I am asked to complete. I agree that I shall not at any time while I am a volunteer for Toronto Cares or at any time thereafter, disclose to anyone such confidential information, except as may be required or permitted by law or at the request of Toronto Cares.• All material prepared by me while volunteering at Toronto Cares, including copyright therein, shall become the sole property of Toronto Cares and be returned to Toronto Cares. I waive any moral rights I may have with respect to all material prepared pursuant to this Agreement in favour of Toronto Cares and any of its assignees and licensees;• There may be media and photographers present during my volunteering time and that if I do not wish to be photographed, it is my responsibility to make this known at the time;• I have read this release and understand its terms. I sign voluntarily and have full knowledge of its significance;• I am at least eighteen (18) years of age and fully competent to sign this Agreement; BY SIGNING THIS FORM, I ACKNOWLEDGE THAT I HAVE READ, UNDERSTOOD AND AGREED TO THE ABOVE CONDITIONS, RELEASE AND WAIVER.
