Warning of Risk
Basketball is a physical, fast-paced
sport involving running, jumping, sudden movements, and potential contact with
other players and equipment. Participants in basketball activities, including
but not limited to games, skill training, and physical conditioning, face a
variety of risks. These risks include, but are not limited to, collisions with
players or stationary objects, slips and falls, physical contact such as
elbowing, hip checks, undercutting, and shoving, as well as hazards from
improperly maintained or defective equipment and surfaces. Participants may
also face risks from attempting maneuvers beyond their current skill level,
poor officiating, failure in supervision, unsportsmanlike conduct by spectators
and players, and other unpredictable circumstances inherent in the sport of
basketball.
By signing this waiver, the
Participant (or their Parent/Guardian) acknowledges these risks and the
potential for injuries, which can range from minor to severe, and includes but
is not limited to sprains, fractures, concussions, or even permanent disability
or death.
2.
Waiver and Release of All Claims
In consideration of being allowed to
participate in basketball activities organized by 4thquartergrind, LLC at any
location, the Participant (or their Parent/Guardian) hereby voluntarily waives,
releases, and forever discharges 4thquartergrind, LLC its employees, agents,
coaches, volunteers, officials, and any affiliated organizations from any and
all claims, actions, or causes of action arising out of injury, illness,
damage, or loss sustained by the Participant as a result of participating in these
activities, whether caused by negligence, wrongful act, or any other cause.
This release includes any claims for
injury, loss, or damages that may arise due to the dangerous conditions of a
basketball court or equipment, failure to provide proper supervision or medical
treatment, or any other factor arising from the nature of the sport and the
inherent risks involved.
3.
Assumption of Risk
By signing below, the Participant (or
their Parent/Guardian) acknowledges that participation in basketball involves
certain inherent risks that cannot be eliminated regardless of the care taken.
These risks include, but are not limited to, those listed in the "Warning
of Risk" section. The Participant assumes all risks associated with
participation, including the risk of contracting communicable diseases such as
COVID-19.
5.
Medical Release
In the event of an emergency, the
Participant (or their Parent/Guardian) grants permission for 4thquartergrind,
LLC staff or authorized representatives to seek necessary medical treatment for
the Participant, including but not limited to first aid, emergency medical
care, and transportation to a medical facility. The Participant (or their
Parent/Guardian) agrees to bear the financial responsibility for any medical
expenses incurred as a result of injury or illness during participation.
