SBA PPP Advocacy Letter
Dear House and Senate Leaders,

We, the undersigned associations, businesses, and nonprofits represent millions of Americans whose incomes are supported by—or endeavor to be supported by—the Small Business Administration’s (SBA) Paycheck Protection Program (PPP).  

As leaders in the hospitality, tourism, entertainment, music and culture industries, we applaud passage for the Flexibility Act (H.R. 7010) as a much-needed technical fix to the Paycheck Protection Program. There remains urgent need beyond the Flexibility Act to address the ongoing economic crisis for the hardest-hit sectors of the American economy. Our industries—both for-profit and nonprofit—will be among the last to fully reopen. We urge Congress to bridge the significant gap between the start of this crisis and a meaningful return of stable revenue.

The last tranche of PPP loans will soon expire. Without an infusion of new money for PPP borrowers, our country will face yet another wave of unemployment claims as millions of workers whose jobs were preserved through PPP will be laid off or furloughed. To preserve jobs and ready the nation’s economy for a robust recovery, we urge Congress to adopt the following modifications to PPP as soon as possible:

Increase the maximum allowable loan amount to reflect 24-weeks of payroll, benefits, fixed operating costs, and PPE expenses. We recommend existing PPP borrowers be permitted to apply for additional loans, up to the new maximum loan amount and not to exceed December 31, 2020.
Expand the eligible borrowers to include all not-for-profit entities, including nonprofits larger than 500 employees.
Expand the non-payroll fixed costs that are eligible for forgiveness.
Specify the interaction between the Employee Retention Tax Credit and the PPP loans to ensure borrowers can make use of both types of assistance.
Ensure that borrowers whose loan proceeds are fully used prior to the end of the covered period are only responsible for maintaining FTE staffing levels and wages through the duration of their loan, not the full 24-week period.

The above provisions will be necessary to protect American workers and ensure the viability of our country’s most-impacted private and nonprofit employers.
