In consideration of being permitted by Rivercrest Bible Camp, Inc. d/b/a Camp Rivercrest (“Camp Rivercrest” or the “Camp”) to be present on or use the property, facilities, and premises of the Campy (collectively, the “Premises”) and/or to engage in the Activities (as defined below) and in recognition of the Camp’s reliance hereon, I, on behalf of myself and each of the minor children listed below (if any), agree to all the terms and conditions set forth in this instrument (this “Release”).
1. Activities. The activities covered by this Release include any activities or conduct on which you (or others) engage while on the Premises, whether as a volunteer, camp participant, spectator, or otherwise, including, but not limited to, using or engaging in the paintball course and equipment, the black banana slip-n-slide, high ropes/challenge course, climbing wall and tower, giant swing, initiatives course, basketball, baseball, soccer, and volleyball courts or fields, hiking trails, swimming pool, field games, and/or archery (collectively, the “Activities”).
2. Acknowledgement and Assumption of Risk. I fully understand that my presence on and use of the Premises, and/or my participation in the Activities, entails known and unanticipated risks that could result in physical injury, emotional injury, and property loss, including, but not limited to, concussions, broken bones, sprained or torn ligaments, permanent disability, dehydration, paralysis, death, contracting COVID-19 or other illness, and other bodily injury or property damage, which may be caused by the actions, or inactions, of myself or others, the temperature, weather, condition of the Premises, the negligence or carelessness of the Released Parties (as defined below), dangerous or defective equipment, or property owned, maintained, or controlled by Released Parties. I also fully understand that there may be other risks either not known at this time, or not readily foreseeable at this time. Nevertheless, I voluntarily elect to use the Premises and/or participate in the Activities with full knowledge, understanding, and appreciation of the risks and danger involved, and I hereby assume full responsibility for any risks, loss, property damage or bodily injury (as described above) that may arise out of or result from the use of the Premises and/or participation in the Activities. I hereby represent and warrant that, to the best of my actual or constructive knowledge, there is no reason, medical or otherwise, that would make my participation in the Activities unusually hazardous. I hereby acknowledge and agree that I will act responsibly at all times with respect to the use of the Premises and/or participation in the Activities. I further acknowledge and agree that I am responsible for the security and safety of any property and personal effects that I may bring to the Premises, and that the Released Parties (as defined below) do not and cannot guaranty the security or safety of any such property.
3. Release from Liability. I hereby expressly waive and release any and all claims, now known or hereafter known, against Camp Rivercrest, and its officers, directors, employees, agents, affiliates, successors, and assigns (collectively, the “Released Parties”), arising out of or attributable to the use of the Premises or participation in the Activities, including, but not limited to any claims arising out of or related to any injury, disability, death, or property damage, regardless of whether any such claim involves the negligence of Camp Rivercrest or any Released Parties or otherwise. I covenant not to make or bring any such claim against Camp Rivercrest or any other Released Parties, and forever release and discharge Camp Rivercrest and all other Released Parties from liability under such claims.
4. Indemnification. I shall defend, indemnify, and hold harmless Camp Rivercrest and all other Released Parties against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including attorney fees, the costs of enforcing any right to indemnification under this Release, and the cost of pursuing any insurance providers, incurred by/awarded against Camp Rivercrest or any other Released Parties arising out of or resulting from any claim by or on behalf of myself or any third party related to being on or using the Premises or participating in the Activities.
5. Medical Treatment. In the event of an emergency, I authorize Camp Rivercrest to secure from any licensed hospital, physician, or medical personnel any treatment deemed necessary for my immediate care; provided, however, that I acknowledge and agree that Camp Rivercrest shall have no obligation or duty to provide, secure, or otherwise obtain any such medical treatment or services. I agree that I will be responsible for payment of any and all medical services rendered.
6. Photographic Release. I understand and agree that while I am on or using the Premises and/or during the Activities, I may be photographed and/or videotaped by Camp Rivercrest for internal and/or promotional use. I hereby grant and convey to Camp Rivercrest all right, title, and interest, including but not limited to, any royalties, proceeds, or other benefits, in any and all such photographs or recordings, and consent to Camp Rivercrest’s use of my name, image, likeness, and voice in perpetuity, in any medium or format, for any publicity without further compensation or permission.
I, on behalf of myself and each of the minor children (if any) listed below, have read and fully understand this Assumption of Risk, Waiver, Release from Liability, and Hold Harmless and have executed it freely and voluntarily. I also fully understand that this Release contains a liability waiver and that by signing this Release I am giving up legal rights which may otherwise be available.
