For and in consideration of Susan Dawn Wagner permitting the participant to participate in the Zumba® class, Participant, by registering for class, herby voluntarily indemnifies, releases from liability and holds harmless Susan Dawn Wagner for any accident, injury, illness, death, loss, damage to person or property, or other consequences suffered by Participant or any other person arising or resulting directly or indirectly from Participant's participation in the activity. In the event that Participant is injured, Participant agrees to assume any financial obligation, either through Participant's personal health insurance, or through some other means, for any medical costs which Participant incurs. Susan Dawn Wagner, however, assumes no responsibility for any medical expenses, injury, or damage suffered by Participant in connection with the use of any facilities or services in connection with the activity.

IT IS THE INTENTION OF PARTICIPANT BY REGISTERING FOR CLASS TO EXPRESSLY ASSUME ALL RISK OF PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE UPON HIM/HERSELF, TO THE EXCLUSION OF SUSAN DAWN WAGNER AND TO EXEMPT AND RELIEVE SUSAN DAWN WAGNER FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE, OR WRONGFUL DEATH.

Participant further agrees that Participant, his/her spouse, assignees, heirs, guardians, and legal representatives will not make a claim against, sue or attach Susan Dawn Wagner for any loss or damage resulting from Participant's participation in the activity.

PARTICIPANT IS AWARE OF THE POTENTIAL DANGERS INCIDENTAL TO ENGAGING IN THE ACTIVITY, THAT THIS IS A RELEASE OF LIABILITY, A WAIVER OF THE PARTICIPANT'S LEGAL RIGHT TO COLLECT DAMAGES IN THE EVENT OF INJURY, DEATH, OR PROPERTY DAMAGE AND A CONTRACT BETWEEN PARTICIPANT AND SUSAN DAWN WAGNER, AND PARTICIPANT SIGNS IT (BY REGISTERING FOR CLASS) OF HIS/HER OWN WILL.

Furthermore, you acknowledge and agree that by clicking on a “Sign-Up” button and signing up for an account on the Zumba website, you are submitting a legally binding electronic signature and are entering into a legally binding contract. You acknowledge that your electronic submission constitutes your agreement and intent to be bound by these terms. Pursuant to any applicable statutes, regulations, rules, ordinances or other laws, including without limitation the United States Electronic Signatures in Global and National Commerce Act, P.L. 106-229 (the "E-Sign Act") or other similar statutes, YOU HEREBY AGREE TO THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, ORDERS AND OTHER RECORDS AND TO ELECTRONIC DELIVERY OF NOTICES, POLICIES AND RECORDS OF TRANSACTIONS INITIATED OR COMPLETED THROUGH THE ZUMBA WEBSITE OR SERVICES OFFERED BY ZUMBA. Further, you hereby waive any rights or requirements under any statutes, regulations, rules, ordinances or other laws in any jurisdiction which require an original signature or delivery or retention of non-electronic records, or to payments or the granting of credits by other than electronic means.
