During a fact-finding mission in the Occupied West Bank undertaken by the Arab Group for the Protection of Nature (APN) and the Pesticide Action Network Asia and the Pacific (PANAP), numerous accounts of illegal and inhumane activity committed by Israeli settlements were witnessed. The two reports ‘Pesticides and Agroecology in the Occupied West Bank’ and ‘Human Rights and Toxic Chemicals in the Occupied West Bank (Palestine)’ document some of these acts, which include the illegal trade and manufacture of toxic pesticides in Israeli settlements, the discharge of raw industrial and domestic sewerage from the settlements directly onto Palestinian grazing lands and olive groves, as well as the leaching of chemicals from Israeli industrial and agricultural operations into water resources, including in areas with high concentration of schools. Communities near these settlements have reported the proliferation of disease-carrying mosquitoes, and increased incidence of respiratory and eye diseases, including among children.Additionally, there were several reports of not only the expropriation of farmland by the Israeli military, but also the deliberate poisoning and shooting of Palestinian livestock by Israeli settlers and army personnel.  

These acts result in serious human rights violations of Palestinian residents, farmers, and pastoralists in the surrounding communities, including:
i. the rights to life, livelihood, physical and mental integrity, liberty and security of person;
ii. the right to the highest attainable standard of health;
iii. the right to adequate food;
iv. the right to be secure in the employment of their own means of subsistence and development;
v. the rights to ancestral land and resources traditionally relied upon for subsistence, and to protect the environment and the productive capacity of their lands and resources;
vi. the rights of children to survival and development; and
vii. the right to access just and fair redress and effective remedy.

Accordingly, we the undersigned organizations and individuals urge intergovernmental organizations, state parties, corporations, and civil society organizations to put the following recommendations in to immediate action :
UN and International Organizations
In line with the provisions of the United Nations General Assembly Resolution A-HRC-31-L.39 on the “Human Rights Situation in Palestine and other Occupied Arab Territories”, all relevant United Nations Treaty Bodies, Special Mechanisms and Human Rights Council and Affiliated Technical Organizations are urged to call on Israel to immediately:

1. Allow the Palestinian Authority to exercise its own laws on pesticides in border areas and in Area C, including the disposal of confiscated pesticides appropriately.
2. Publicly disclose (i) the number of illegal industrial settlements and agrochemical factories within the Occupied West Bank, (iii) the type and concentration of chemical contaminants released and present in the surrounding air, water and soil.
3. Dismantle all industrial settlements, including Geshuri and Barkan, under the guidance of a team of international and Palestinian experts, in order to prevent further damage to peoples’ health and the environment.
4. Stop the human rights violations committed against Palestinian farmers by (i) remediating contaminated soil and water, (ii) halting intentional maiming, shooting and poisoning of livestock, and (iii) returning confiscated land unconditionally to the rightful Palestinian owners.

In addition, international organizations, including UN agencies, are called upon to:

5. Facilitate the formation of a joint international and Palestinian team of health professionals to carry out extensive epidemiological studies for disease analysis, as well as the immediate analysis of toxic chemicals inside the West Bank .

State Parties to the United Nations
In order to avoid complicity with violations of internationally recognized human rights standards and international humanitarian law, in line with provisions 12, 13 and 14 of the UN General Assembly Resolution A-HRC-31-L.39,

1. All states with companies headquartered within their respective jurisdictions that are involved in the production, sale and promotion of pesticides with Israeli state-based or corporate actors (including Switzerland, Germany, UK and USA ) should immediately require them to halt activities.

Corporations and their Subsidiaries
In order to avoid complicity with violations of internationally recognized human rights standards and international humanitarian law, in line with provisions 8, 13 and 17 of the UN General Assembly Resolution A-HRC-31-L.39, all companies and their subsidiaries:

1. Complicit in the manufacturing of pesticides in the Israeli settlements in the West Bank or in supplying the settlements with such products (including via initial export to Israel) should immediately halt their activities, cease implicated trade relations, and withdraw from all interactions with Israeli settlements.
2. Complicit in the collection, transport or sales of waste from the illegal settlements should immediately cease and desist from such activities.


Civil Society Groups
Civil society groups are called upon to:

1. Work in collaboration with Palestinian counterparts to monitor (i) waste discharges and industrial emissions from the illegal settlements and their impacts on human health; and (ii) human rights violations perpetrated by the Israeli Civil Administration, military and illegal settlers on the Palestinian people through the manufacture, use and discharge of toxic chemicals.
2.  Work with Palestinian lawyers, as needed, on tort or other collective cases to hold pesticide companies legally accountable for the poisoning and illnesses experienced by communities exposed to these chemicals.

مناشدة دولية: إيقاف تسميم فلسطين

خلال بعثة لتقصي الحقائق في الضفة الغربية المحتلة قامت بها الجمعية العربية لحماية الطبيعة (APN) وشبكة العمل على المبيدات في آسيا والمحيط الهادئ (PANAP)، تم الاستماع إلى العديد من الشهادات حول الأنشطة غير القانونية واللاإنسانية التي ترتكبها المستوطنات الإسرائيلية. و أصدرت تقريرين و هما "المبيدات وإيكولوجيا الزراعة في الضفة الغربية المحتلة" و"حقوق الإنسان والمواد الكيماوية السامة في الضفة الغربية المحتلة (فلسطين)" يوثقان بعض هذه الأعمال، التي تشمل التجارة غير المشروعة وتصنيع المبيدات السامة في المستوطنات الإسرائيلية، وتصريف مياه الصرف الصحي الصناعي والمنزلي الخام من المستوطنات مباشرة إلى أراضي الرعي وبساتين الزيتون الفلسطينية، فضلا عن تسرب المواد الكيمياوية من العمليات الصناعية والزراعية الإسرائيلية إلى موارد المياه. وبالإضافة إلى ذلك، كانت هناك عدة مشاهدات ليس فقط حول مصادرة الجيش الإسرائيلي للأراضي الزراعية، بل كذلك حول قيام المستوطنين وأفراد الجيش الإسرائيلي بالتسميم المتعمد وإطلاق النار على مواشي الفلسطينيين.

ii. الحق في التمتع بأعلى مستوى من الصحة يمكن بلوغه؛
iii. الحق في الغذاء الكافي؛
iv. الحق في أن يكونوا آمنين في توظيف الوسائل الخاصة بهم للعيش والتنمية؛
v. الحق في الأرض والموارد الموروثة والتي يعتمدون عليها تقليديا من أجل البقاء، وحماية البيئة والقدرة الإنتاجية لأراضيهم ومواردهم؛
vi. حقوق الطفل في البقاء والنماء؛  
vii. الحق في الوصول إلى تعويض عادل ومنصف ووسيلة انصاف فعالة.


وفقا لذلك، فإننا نحن المنظمات والأفراد الموقعين أدناه نحث المنظمات الحكومية الدولية، والدول الأعضاء، والشركات، ومنظمات المجتمع المدني على وضع التوصيات التالية حيز التنفيذ الفوري(1) :

الأمم المتحدة والمنظمات الدولية

1. السماح للسلطة الفلسطينية بممارسة قوانينها الخاصة على المبيدات في المناطق الحدودية وفي المنطقة (ج)، بما في ذلك التخلص بشكل ملائم من المبيدات المصادرة.
2. الإفصاح علنا عن (i) عدد المستوطنات الصناعية غير المشروعة ومصانع الكيماويات الزراعية في الضفة الغربية المحتلة، (ii) نوع وتركيز الملوثات الكيمياوية التي تم اطلاقها والموجودة في الهواء والمياه والتربة المحيطة.
3. تفكيك جميع المستوطنات الصناعية، بما في ذلك مستوطنات جيشوري وباركان، تحت إشراف فريق من الخبراء الدوليين والفلسطينيين، من أجل منع وقوع المزيد من الضرر على صحة الناس والبيئة.
4. وقف انتهاكات حقوق الإنسان التي ارتكبت ضد المزارعين الفلسطينيين من خلال (i) إعادة تأهيل التربة والمياه الملوثة، (ii) وقف التشويه المتعمد، وإطلاق النار وتسميم الماشية، و (iii) إعادة الأراضي المصادرة دون قيد أو شرط إلى أصحابها الفلسطينيين الشرعيين.


وبالإضافة إلى ذلك، دعوة المنظمات الدولية، بما في ذلك وكالات الأمم المتحدة، للقيام بما يلي:

5. تسهيل تشكيل فريق دولي وفلسطيني مشترك من المختصين في مجال الصحة للقيام بدراسات وبائية واسعة لتحليل المرض، فضلا عن التحليل الفوري للمواد الكيمياوية السامة داخل الضفة الغربية (2).


الدول الأعضاء في الأمم المتحدة

لتجنب التورط بالمشاركة في الانتهاكات لمعايير حقوق الإنسان المعترف بها دوليا والقانون الإنساني الدولي، وذلك تمشيا مع الأحكام 12 و 13 و 14 من قرار الجمعية العامة للأمم المتحدة رقم A-HRC-31-L.39،

1. على جميع الدول التي تقع فيها مقرات الشركات التي تشارك في إنتاج وبيع وترويج المبيدات مع الجهات التي مقرها إسرائيل أو الشركات الإسرائيلية (بما في ذلك سويسرا وألمانيا والمملكة المتحدة والولايات المتحدة الأمريكية (3)) أن تطلب منها وقف أنشطتها على الفور.


الشركات والشركات التابعة لها

لتجنب التورط بالمشاركة في الانتهاكات لمعايير حقوق الإنسان المعترف بها دوليا والقانون الإنساني الدولي، وذلك تمشيا مع الأحكام 8 و 13 و 17 من قرار الجمعية العامة للأمم المتحدة رقم A-HRC-31-L.39، فإن جميع الشركات وفروعها:

1. المتواطئة في تصنيع المبيدات في المستوطنات الإسرائيلية في الضفة الغربية أو في تزويد المستوطنات بهذه المنتجات (بما في ذلك عن طريق التصدير الأولي لإسرائيل) يجب أن توقف أنشطتها فورا، وأن توقف العلاقات التجارية التي تشير إلى تورطها، والانسحاب من جميع التعاملات مع المستوطنات الإسرائيلية.
2. المتواطئة في جمع ونقل وبيع النفايات من المستوطنات غير الشرعية يجب أن تتوقف فورا وأن تكف عن مثل هذه الأنشطة.

منظمات المجتمع المدني

دعوة مجموعات المجتمع المدني إلى ما يلي:

1. العمل بالتعاون مع نظرائهم الفلسطينيين لمراقبة (i) تصريف النفايات والانبعاثات الصناعية من المستوطنات غير الشرعية وآثارها على صحة الإنسان؛  و (ii) انتهاكات حقوق الإنسان التي ترتكبها الإدارة المدنية الإسرائيلية، الجيش والمستوطنين غير الشرعيين على الشعب الفلسطيني من خلال تصنيع واستخدام والتخلص من المواد الكيمياوية السامة.
2. العمل مع المحامين الفلسطينيين، حسب الحاجة، على المسؤولية التقصيرية أو الحالات الجماعية الأخرى لتحميل شركات المبيدات المسؤولية القانونية عن التسمم والأمراض التي تعاني منها المجتمعات المعرضة لهذه المواد الكيمياوية.
