WAIVER AND SIGN-IN FORM PARTICIPATION: I understand Yamhill Carlton Together Cares (“YCTC”) and the Yamhill Carlton Soccer Club ("YCSC") is making a facility and/or program available for myself and/or my child during specified times. It is my primary responsibility to follow the rules of the facility and club, act in a safe and responsible manner, accompany all children in my care (further know as "my child") and make sure my child is safe and is acting in a way to keep other children, parents, guardians and others safe. I am/my child is in good health and able to participate safely. If YCTC or YCSC deems myself or my child unable and/or unwilling to participate safely, I / my child may be asked to refrain from activities. WAIVER AND RELEASE. I hereby voluntarily, fully and forever waive, release and discharge YCTC, YCSC, its officers, directors, agents, employees, volunteers, and all other persons or entities acting in any capacity on its behalf YCTC, YCSC and the owner(s) of the facility, its officers, directors, agents, employees, business(es) operating on property (the “Property Owner”) from any and all losses, liabilities, claims, expenses, demands, actions, damages, injuries, causes of action, and rights of action which are related to, arise out of, or are in any way connected with my child’s participation in activities at, with, or sponsored or administered by YCTC and/or YCSC. The foregoing waiver of liability includes, without limitation, damages or injury resulting from the negligence of YCTC, YCSC and the Property Owner (whether such claims are based upon breach of contract, breach of warranty, or any other legal theory) loss of personal property or from any other cause or causes. ASSUMPTION OF RISK. I understand that my child, myself and anyone I bring to YCTC and/or YCSC events or programs may suffer physical harm as a result of the acts or omissions of me, my child, YCTC, YCSC and/or the Property Owner, or others (including participants) due to his or her participation in activities at, with, or sponsored or administered by YCTC or YCSC. I elect to have my child participate in spite of the risks. If I elect to be be on the site, I am responsible for myself and all those I bring with me in spite of the risks. I will not bring or send anyone I am not legally responsible for to the property, nor will bring members of my family or any other person(s) I am legally responsible for, including myself, my spouse, or any other relations to the YCSC Arena property, including but not limited to all fields and parking areas, unless I agree they are included in this waiver. COVENANT NOT TO SUE. I agree not to institute any suit or action at law or otherwise against YCTC and/or the Property Owner, or to initiate or assist in the prosecution of any claim for damages or cause of action which my child or I may have by reason of injury to my child, myself, or property related to, arising out of, or in any way connected with my child’s participation in activities at, with, or sponsored or administered by YCTC and/or YCSC. INDEMNITY. On behalf of myself and any minor children entrusted to my care, I hereby agree to release and indemnify YC Together Cares and YCSC, the property owners, their respective parent corporations, subsidiaries and affiliate corporations, and all of their respective shareholders, members, officers, directors, employees, agents, successors and assigns (collectively the “Released Parties”) from all liability for injury, death, property loss and damage arising out of or in connection with (i) my or my child’s participation in any activity at the Arena property and the use of any facility, equipment, programs and services at the property, including, but not limited to, covered arena, soccer pitch, picnic area, surrounding field, parking area, including all equipment, (ii) my breach of this Agreement, (iii) my violation of the policies of the Arena or (iv) my negligent or intentional tortious acts or omissions. This release and indemnity agreement includes claims based upon negligence by the Released Parties and any other person or cause. I further agree to pay the Released Parties all costs and legal fees expended defending against such claims or lawsuits as well as any sum paid as a result of any judgment or settlement. MEDICAL AUTHORITY, CARE AND EXPENSES. I authorize YCTC, YCSC employees and volunteers to seek and obtain qualified emergency medical treatment and/or transportation to receive such treatment for the participant if thought necessary. I understand I will be financially responsible for changes resulting from such medical treatment and/or transportation to receive such treatment. I will pay for my child’s and my own emergency medical expenses and all subsequent medical expenses in the event of any incident, accident, illness or incapacity, regardless of whether I have otherwise authorized such expenses. I understand YCTC and YCSC employees and volunteers are not trained to address specific behavioral and/or medical conditions. By accepting this Waiver, I make all of the preceding statements and agreements for and on behalf of myself, my spouse, my children, my parents, and any of our or their heirs, assigns, personal representatives, and estates. I am authorized to execute this Waiver on behalf of my child. If any provision of this agreement is determined to be unenforceable, all other provisions shall be given full force and effect.I/We have read, understand and agree to comply with the Waiver as outlined above. *
