Save the Kitties Foster Agreement

Save the Kitties Foster Agreement

1. Purpose of Agreement

You will be referred to as the “Foster,” with the understanding that the Foster will provide temporary shelter and care for Cat who currently has nowhere else to live. Save the Kitties (hereinafter referred to as “Rescue”) will continue to look for a permanent home for Cat, but fostering keeps Cat safe and provides comfort and security until they can be adopted. Foster understands they will not be compensated for this service, other than being provided with essential items and veterinary care needed while Cat is in Foster’s care.

2. Home Inspection

Each prospective foster home may be visited virtually or in person by an agent of Rescue or another approved individual to evaluate its qualifications as a foster home.

3. Ownership and Custody

Foster understands and agrees that Cat is the property of Rescue. Foster does not have any ownership of Cat; all such rights remain fully and forever with Rescue. Cat shall not be sold, given to, placed in the care of, offered, or delivered for adoption to another person, organization, or any other entity, including but not limited to a family member, friend, rescue facility, or shelter. The Cat must be returned to Rescue if, for any reason, Foster can no longer care for Cat.

Foster agrees not to transfer custody of Cat to anyone other than a representative of Rescue and agrees to return Cat to Rescue upon request. Foster agrees to notify Rescue, without delay, if Foster can no longer care for or keep Cat. Foster agrees to give Rescue reasonable time to re-home Cat or place Cat in an approved foster home, if available. Foster must notify Rescue of any behavioral problems that have occurred at any time before returning Cat.

Foster and Rescue understand that either party may end the foster relationship at any time for any reason.

4. Veterinary Care

Foster understands and agrees that any non-emergency and emergency veterinary care must be approved by Rescue prior to any charges being incurred.

Foster agrees to give Cat all required medications or treatments as needed and prescribed by the veterinarian. When it is time for Cat to be spayed or neutered, the Foster agrees to coordinate the surgery with Rescue.

If it is determined that Cat has become ill or injured as a result of Foster’s unreasonable conduct, Rescue will be entitled to any and all expenses incurred to return Cat to health.

Foster agrees to take Cat to veterinary appointments and meet-and-greet appointments at Rescue’s primary location. Rescue will coordinate with Foster to make sure said appointments are convenient.

KDA Regulatory Additions:

  • Each pet animal foster home agreement shall contain the name of the licensed veterinarian whom the pet animal foster home shall contact in case of injury or illness and the name of the party responsible for the payment of treatment and office call charges.
  • The animal shelter licensee or rescue network manager shall require each pet animal foster home to notify the sponsoring animal shelter or rescue network manager of any dog or cat receiving veterinary care within 24 hours of treatment.
  • A copy of the plan of veterinary care shall be filed annually with the commissioner.

5. Daily Care Responsibilities

Foster will feed Cat at least twice a day and provide a fresh supply of water at all times. Cat will be treated as a family member with loving care and affection. Foster will do their best to ensure Cat’s safety and well-being. Cat will live inside the home and will not be isolated from the family.

However, if separation is needed for safety or health (e.g. slow intros to other cats), Cat may be kept in a secure and designated foster room.

6. Lost Cat or Contact Info

In the event Cat becomes lost, Foster will immediately notify Rescue. Foster will also immediately notify Rescue of any change of contact information (address, phone number, or email address).

7. Microchip Policy

Cat’s microchip will have Rescue’s contact information. Foster agrees not to remove or alter Rescue’s contact information from the microchip. If the microchip stops working or cannot be located, Foster agrees to notify Rescue immediately so a new one can be implanted.

8. Transport Guidelines

Foster agrees that Cat will only be transported in a secure carrier.

9. Animal Welfare and Safety

Foster agrees not to abuse or neglect the Cat or allow others to do so. Rescue has sole discretion to determine whether abuse or neglect has occurred.

Foster affirms that no member of their household has been convicted or charged with any animal welfare law violation, including neglect, cruelty, or abandonment, nor with any domestic battery or sex crime.

10. Liability and Assumption of Risk

Foster is taking possession of Cat at their own risk and releases Rescue, its volunteers, board members, and assigns from any and all liability arising out of possession of Cat.

Foster accepts full liability for the Cat while in their care, including any bites, scratches, or injury to people or other animals.

Rescue will not be held liable for any damage or loss resulting from counseling advice, nor does Rescue guarantee the behavior, temperament, or medical condition of any Cat.

Foster agrees to exercise caution when introducing Cat to new environments, animals, or people.

Animal Interaction & Liability Acknowledgment

The Foster understands that introducing a foster animal into a home with other pets carries inherent risks. Save the Kitties is not responsible for any illness, injury, damage, or loss resulting from interactions between the foster animal and any animals owned or cared for by the Foster, including but not limited to cats, dogs, ferrets, rabbits, birds, reptiles, or other pets. This includes situations where a foster animal injures the Foster’s animals or where the Foster’s animals injure the foster animal. The Foster agrees to take all reasonable steps to properly separate, supervise, and introduce animals as needed to ensure safety, and assumes full responsibility for all risks associated with housing the foster animal in a home with other animals.

11. Behavioral Issues and Damages

Foster will immediately notify Rescue of any behavioral concerns. Foster assumes full responsibility for any damages caused by Cat while in their care.

12. Indemnification

Foster agrees to indemnify and hold Rescue harmless from any and all loss and expenses (including legal fees) related to injury, damage, or death to any person, animal, or property caused by the Cat or while the Cat is in their care.

13. Foster Capacity Limits

KDA Regulatory Additions:

  • A pet animal foster home shall not foster more than 10 adult cats or dogs at the same time.
  • A pet animal foster home shall not at any time maintain or house on the premises more than 19 adult dogs or cats.
  • The limit of 19 dogs or cats includes:
    (A) Any adult dog or cat that is a personal pet of the pet animal foster home caretaker; and
    (B) Any adult dog or cat owned by any other individual or entity and maintained, housed, or harbored on the premises.
  • If more than 19 adult dogs or cats will be housed on the premises for any reason, the pet animal foster home shall apply for an animal shelter license and shall not accept any adult dogs or cats in excess of that limit before receiving the animal shelter license.

14. Foster Intake Restrictions

KDA Regulatory Additions:

  • The animal shelter licensee or rescue network manager shall require that a pet animal foster home not directly accept stray dogs or cats, or any animal relinquished by its owner.
  • Each pet animal foster home wanting to accept stray dogs or cats or animals that are relinquished by their owners shall apply for and receive an animal shelter license before accepting these animals.
  • Each rescue network manager shall be responsible for the intake of all animals in the care of the rescue network.
  • No stray dog or cat may be placed with a pet animal foster home until the applicable requirements of K.S.A. 47-1710, and amendments thereto, have been met.

15. Entire Agreement

This document reflects the entire agreement between Foster and Rescue.

Rescue reserves the right to modify or update this Foster Agreement at any time as necessary. Foster will be notified of any significant changes and may be required to acknowledge and agree to updated terms.

16. State Oversight

Kansas Department of Agriculture has the right to inspect foster homes, if necessary.

Next Steps:
Upon submission of your application, it will be automatically emailed to our Foster Coordinators. They will review your application and reach out to schedule an in-person home inspection.
