Please read the following thoroughly and completely.
I desire to use the physical fitness facilities, equipment and services offered at the white rock boathouse (“the boathouse”) to engage in physical fitness programs, classes and/or activities, including but not limited to swimming, boating, rowing, paddling, erging and weight lifting (collectively the “activities”). The risk of injury from the activities is significant, including the potential for serious bodily injury, death, and property damage and i assume all risk in connection with the use of the boathouse and of engagement in any of the activities. I, hereby, for myself, and on behalf of my heirs, assigns, personal representatives, and next of kin, covenant not to sue and release, hold harmless, and forever discharge, White Rock Boathouse, Inc., all of its officers, directors, participants, coaches, agents, and/or employees, and any and all sponsors, officials, volunteers, and other participants (collectively the “indemnitees”) from any and all liability of any kind to me for personal injury or death, or property damage (including theft) that results or arises from my use of the boathouse or from my engagement in the activities, whether under the supervision of any of the indemnitees or by my own direction, even if such personal injury or death, or property damage is caused in whole or in part by the negligence of any of the indemnitees. In addition, the undersigned hereby agrees to indemnify and hold harmless the indemnitees from all liability, loss, damage or expense of any kind (including but not limited to court costs and attorneys’ fees) for injury to or death of any person, or for damage to any property arising out of or in connection with the use of the boathouse or engagement on any of the activities by me or any of my guests/invitees, even where such injuries, death or damages are caused in whole or in part by the negligence of any of the indemnitees. I understand the provisions in this paragraph calls for me to indemnify the indemnitee regardless of whether any liability is the result of such indemnitee’s sole, concurrent, contributory or comparative negligence.
In the case of an injury or illness, I hereby consent to the administration of first aid or other medical treatment. I agree to assume full responsibility for payment of any and all fees incurred as a result of such medical treatment. I understand that all participants in the activities are required to have their own medical insurance coverage, and that neither any indemnitee nor any sponsoring entity provides such coverage.
ADDITIONAL – VISUAL/AUDIOVISUAL
I hereby voluntarily and without compensation authorize visual images and/or voice recordings to be made of me by, or on behalf of, white rock boathouse, inc. I also authorize White Rock Boathouse, inc., its assigns and its officers, directors, participants, coaches, agents, and/or employees, and any and all sponsors, officials, volunteers, and other participants (“releasees”) to reproduce, modify, publicize, broadcast and display any such visual images or voice recordings, with or without my name, without notice or payment of any royalty, fee, or other compensation of any character to me for the use of my image, name or voice. I hereby covenant not to sue and release the releasees from and against any and all claims that I may have for invasion of privacy, right of publicity, defamation, copyright infringement, or any other cause of action arising out of the use, adaptation, reproduction, distribution, broadcast, or exhibition of my likeness, name or voice. This covenant not to sue, release and hold harmless agreement is binding on me, my heirs, assigns, personal representatives, and next of kin. By becoming a participant at the boathouse, I represent that I have read this agreement, fully understand its terms, understand that I have given up substantial rights by agreeing to the terms of participation, and that i have done so freely and voluntarily without inducement.
