Participation Waivers and Release of Liability and Indemnity Agreements

Please read the entire document before clicking on "I agree"

I permit my above-named child to participate in T&C Sports program. I recognize that some risk of bodily injury is involved in the normal participation in this sport. I agree to obey all rules and follow all safety procedures involved with this program established by the T&C Sports Club, the T&C Sports Association, RRISD, LISD, NFL, WDDOA, CAYSA, STYSA, USSF, CAPLAX, CenTex, PONY, Spurs Sports & Entertainment, or any other governing bodies associated with the sports associations at T&C Sports. T&C Sports is not liable for any injury.

I certify to the best of my knowledge that my child's current physical condition is satisfactory for participation in the T&C Sports program and that my child is free of any health problems that would endanger his/her participation. I will inform the coach should his/her condition change at any time during his/her participation in this program. T&C Sports is not liable for any injury.

Code of Conduct Agreement:

I hereby pledge to provide positive care and encouragement for my child and all children playing. I will encourage good sportsmanship by demonstrating positive support for all players, coaches, officials, and parents at every game, practice, or other T&C events. I will place the emotional and physical wellbeing of the players ahead of a personal desire to win. I will refrain from the use of drugs, tobacco, alcohol, and profanity at all T&C events. I will remember that the game is for our youth - not the adults.  T&C Sports takes a zero-tolerance approach to the above. I understand that as a spectator I must make sure that I am three feet behind the field lines to assist the field commissioners in maintaining a safe playing environment for the children. If an official or any league representative ejects player or spectators from a game or spectator area, then you must leave the T&C property boundaries immediately and may be subject to further sanctions as outlined in the bylaws.

Zero Tolerance Policy:

Please remember that T&C Sports Complex is not a public park. Please make sure that your out of town guests are aware of this policy! At the T&C Sports Complex, visitors are expected to observe the Zero Tolerance Policy, which prohibits: Violence-Physical or Verbal, Alcohol, Weapons, Noise Makers, Tobacco Products-ALL Types including E-Cigarettes/Vaping, Littering, Pets-Leashed and Unleashed, tailgating, no onsite cooking, this includes all T&C parking lots (T&C's permit does not allow public cooking or preparation of foods outside of our concessions). No oversized vehicles including campers. This Zero Tolerance Policy applies to all visitors for every event attended at the complex. Any patron violating these policies will result in a warning to correct and/or being asked to leave the T&C property immediately. Any patron violating these policies will result in a warning to correct and/or asked to leave the T&C property.

Lightning Policy:

The Town & Country Sports Complex is now monitored by a Thor Guard lightning prediction and warning system.  The Thor Guard system measures atmospheric conditions at the T&C campus and surrounding area.  When the conditions reach the threshold for potential lightning, an alarm will sound (one long blast of the sirens) and the strobe lights will begin to flash.

Steps to take when the Thor Guard sirens and lights are activated:

  1. EVERYONE on the T&C campus must take immediate shelter, either in cars or in the T&C restrooms (these are the safest structures).
  2. Only when the Thor Guard system gives the 'all clear'(3 short siren blasts and the lights go off), may activities resume.

It is the responsibility of every adult on campus to comply with these steps, and to ensure that every child also complies.  This is a Zero Tolerance safety condition for participating at T&C.  Failure to comply is to do so at your own safety risk, and with possible expulsion from the T&C campus and future activities. You may view the status of the T&C Thor Guard system from your smart phone or PC at this link:  tandcsports.thormobile7.net

Photograph/Video Permission:

I agree that T&C may photograph or videotape me or my child while participating in the Town & Country Optimist sponsored events and activities. Further, T&C retain those rights to use these visual images without compensation to my child or me. User consents to management’s use of your image or likeness incidental to any video display, transmission, or recording of the event.

Volunteer Duty:

I understand that T&C Sports is a volunteer operated organization and that there will be times I will be called to support the commissioner and board members of the T&C Sports Association by performing field duties or assisting with other sports or facility functions.  Families or individuals receiving partial or full scholarships are required to volunteer in a capacity suited to their abilities, schedule, or skill set.

Upon signing this Agreement and forever thereafter, you agree that if you participate in or attend any T&C Sports League or League (“League”) related event, or that of any League Team ("Team"), or are present on League or Team premises or use any League or Team facility, you do so at your own risk and assume the risk of all injury and/or damage you might sustain, regardless of whether you are a participant, a spectator, or otherwise. Your assumption of risk includes but is not limited to the use of any sports or other equipment (mechanical or otherwise) and accessing League or Team premises. The participant assumes all risks of injury associated with or in any manner related to his or her use of or presence at any premises, use of any equipment, or participation in any sport, function or activity in any way related to membership, including injury resulting from the negligence of any party. This waiver applies regardless of whether you are participating in any league practice, scrimmage, game or function at the time of the injury, or whether your injury occurs because of your presence upon the premises regardless of purpose or activity at the time of the injury-causing incident. This waiver and release agreement is intended to be as broad as is allowed under applicable law and applies to all claims for damages, regardless of whether they are allegedly caused by the negligence of the league, a team, or their officers, directors, administrators, employees and agents.

You agree that you are voluntarily participating in the activities and assume all risk, known and unknown, associated with same. You further expressly agree that the foregoing release, waiver, and indemnity agreement is intended to be as broad and inclusive as permitted by the law of the state in which this agreement is entered into, and that if any portion of this agreement is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. This release is not intended as an attempted release of claims of gross negligence or intentional acts. You acknowledge that League and Team provide a service to their members and is not in the business of selling, leasing, or otherwise placing into the stream of commerce exercise or sports equipment, or other such products, and the use of any such items is incidental to the service provided by League and Team.

YOU ACKNOWLEDGE THAT YOU HAVE CAREFULLY READ THIS WAIVER AND RELEASE AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY, AND EXPRESS ASSUMPTION OF RISK AND INDEMNITY AGREEMENT.
