The 2022 NY Harvest Festival & Freedom Fair General Vendor Terms and Conditions:

To be considered for acceptance to participate as a vendor in the 2022 NY Harvest Festival & Freedom Fair, hereinafter referred to as “festival”, the undersigned must agree with the following terms.

Damage or Injury:

The undersigned and its representatives assume all responsibility and liability for any and all risk of damage/injury/illness/death that may occur to the undersigned, its employees, volunteers, customers, and agents during participation in the festival. By signing these terms and conditions, the applicant hereby releases and holds harmless Damn Sam Productions, NY Harvest Festival & Freedom Fair, its Board of Directors, employees, volunteers, and agents from all responsibility and liability of damage, injury, illness or death whether known, anticipated, or unanticipated as a result of participating in the festival. This includes personal injury, property damage, and defense costs. The undersigned acknowledges that they are independent contractors - not employed by or under the direction of the festival – except for compliance with these Terms and Conditions.

Damn Sam Productions, NY Harvest Festival & Freedom Fair, its Board of Directors, employees, volunteers, and agents will not be responsible for any losses of any kind, whether by fire, theft, physical violence, nature, accident or any other cause. NY Harvest Festival will provide safety personnel for the festival; however, vendors are responsible for the protection and insurance of their own merchandise.

Hours of Operation:

Vendors should remain open from the time the music begins until the time the music ends each day.

All vendors must sell only the approved items that are listed on their vendor applications, No Exceptions!

There is a $50.00 refundable cleaning security fee, which will be collected by NY Harvest Festival & Freedom Fair upon your arrival on site. The undersigned insures that at the conclusion of the festival their area will be left clean, and that there will be no evidence of property damage. The $50.00 refundable cleaning security fee can be collected upon inspection of the vendor’s area at the conclusion of the festival. This inspection will be completed by NY Harvest Festival & Freedom Fair staff. We want to leave this land better than we found it.

All vendors must have a certified fire extinguisher in their booth for the duration of the festival.

Vendors are responsible for paying all appropriate sales tax with respect to the sale of goods and for procuring all permits and documentation as may be required by local and state government to operate within the state of New York. Advance rentals of tables, chairs etc. maybe provided for an additional fee.

All vendor booth fees include total of two vendors. Any more than two vendors must purchase a ticket. We offer discounted $90 tickets IN ADVANCE TO VENDORS ONLY!

Please insure all employees wear the appropriate passes/wristbands at all times during the festival.

NO PRODUCTS WILL BE SOLD THAT COMMEMORATE SAID EVENT OR DAMN SAM PRODUCTIONS, ALL EVENT IMAGES AND LOGOS ARE THE SOLE PROPERTY OF FESTIVAL- NO EVENT MERCHANDISE CAN BE MADE, SOLD, GIVEN AWAY ETC. EXCEPT BY FESTIVAL, OR BY WRITTEN CONSENT OF FESTIVAL

NO ILLEGAL DRUGS, FIREWORKS, NITROUS OXIDE, WEAPONS OF ANY KIND, OR ANY OTHER ITEM WHICH ARE ILLEGAL IN THE STATE OF NEW YORK MAY BE SOLD AT ANY VENDOR’S BOOTH. NO EXCEPTIONS!

Vendors must provide their own electricity, tables, chairs, tents, trash bags, electrical cords, lighting, equipment, displays, and signage. The use of frayed or unsafe extension cords is prohibited. All signage and equipment MUST fit within the vendor’s designated space. Vendor space must be kept clean and free of debris throughout the duration of the festival. Advance rentals of tables, chairs etc. may be provided for an additional fee.

All vendor fees are non-refundable, rain or shine, and must be submitted with these forms. If cannot attend, all payments will be considered a donation.

Vendors must check in at the front gate to receive their credentials before beginning set up. Vendors and their vehicles will be searched by security for illegal substances and weapons before set up. Vendors must set up booths on Thursday, October 06, 2022, between the hours of 10:00am and 8:00pm. All vehicles must be moved to the vendor parking area by 8:00pm on Thursday. NO VENDORS WILL BE ALLOWED TO BRING VEHICLES INTO THE VENDOR AREA AFTER THE VENDOR SET UP TIMES HAVE ENDED, NO EXCEPTIONS!
