WAIVER, RELEASE, AND PHOTOGRAPH/VIDEO RELEASE
I HEREBY WAIVE AND RELEASE Home For A Home, Inc. ("Released Party") from liability pertaining to the matters set forth below, and grant Released Party the rights described in the Photograph/Video Release section below. I understand that by signing this Waiver and Release, I expressly and willingly agree to assume complete responsibility for any risk of injury that may arise from the below related activity. On behalf of myself, my heirs, assigns and next of kin, I waive all claims for damages, injuries and death sustained to me or my property that I may have against the above-named Released Party relating to such activity. I understand that the activities that I will participate in are inherently dangerous and may cause serious injuries, including bodily injury, damage to personal property and/or death. By this waiver, I assume any risk, and take full responsibility and waive any and all claims of personal injury, including severe bodily injury, damage to personal property and death relating to all activities associated with H4H Guatemala Build in Antigua, Guatemala sponsored by Home For A Home, Inc., including but not limited to car rides, van rides, truck rides, taxi rides, eating local cuisine, construction activities and related activities in and in transit to and from the H4H Guatemala Build in Antigua, Guatemala. If I am injured from said activities, I will not hold Released Party responsible even if the injuries were caused by negligence on my part or the Released Party, or any other party under or affiliated with the above-named Released Party. I do not have any physical limitations, medical ailments, physical or mental disabilities that would limit or prevent me from participating in the above-mentioned activity, and, if required, will obtain a medical examination and clearance.
PHOTOGRAPH/VIDEO RELEASE
I further grant to Released Party and its designees the irrevocable right and permission to photograph and/or video or audio record me during the above-referenced activity, and to use, reproduce, publish, distribute, exhibit, broadcast, and edit such photographs, video, and audio recordings, together with my name, likeness, and voice, in any and all media now known or hereafter developed — including but not limited to print, digital, social media, websites, and promotional or fundraising materials — for any lawful purpose related to Home For A Home, Inc., including advertising, promotion, fundraising, and education, without further notice to me and without compensation. I waive any right to inspect or approve the finished product(s) in which my image, likeness, voice, or name may appear. I release Released Party from any and all claims arising from such use, including but not limited to claims for invasion of privacy, defamation, or infringement of the right of publicity.
I HAVE READ AND FULLY AGREE TO THE TERMS OF THIS WAIVER AND RELEASE. I UNDERSTAND AND CONFIRM THAT BY SIGNING THIS WAIVER AND RELEASE I HAVE GIVEN UP CONSIDERABLE FUTURE LEGAL RIGHTS. I HAVE SIGNED THIS WAIVER FREELY, VOLUNTARILY, UNDER NO DURESS OR THREAT OF DURESS, WITHOUT INDUCEMENT, PROMISE OR GUARANTEE BEING COMMUNICATED TO ME. MY SIGNATURE IS PROOF OF MY INTENTION TO EXECUTE A COMPLETE AND UNCONDITIONAL WAIVER AND RELEASE OF ALL LIABILITY TO THE FULL EXTENT OF THE LAW. I AM 18 YEARS OF AGE OR OLDER AND MENTALLY COMPETENT TO ENTER INTO THIS AGREEMENT AND GRANT THIS WAIVER.
