1. Introduction
These Terms and Conditions ("Terms") govern the use of services, classes, training sessions, and other activities ("Services") provided by Surbiton BoxFit ("Surbiton BoxFit", "we", "our", or "us"). By participating in any Surbiton BoxFit activities, you ("participant", "client", "you") agree to these Terms.
2. Assumption of Risk
By signing up for or participating in any Surbiton BoxFit activities, you acknowledge and understand that physical exercise, especially kickboxing, boxing, and fitness-related activities, involves inherent risks, including but not limited to injury, illness, or even accidental death. You voluntarily accept and assume all risks associated with your participation in Surbiton BoxFit Services.
3. Health and Fitness Requirements
You represent and warrant that you are in good physical health and capable of engaging in physical exercise. If you have any pre-existing medical conditions, injuries, or concerns, you agree to consult with a healthcare professional before participating in Surbiton BoxFit activities.
4. Waiver and Release of Liability
You agree to release, waive, and discharge Surbiton BoxFit, its owner, agents, contractors, and affiliates from any and all claims, demands, damages, actions, or causes of action arising from personal injury, property damage, or accidental death, whether caused by negligence or otherwise, related to your participation in Surbiton BoxFit activities.
5. Indemnity
You agree to indemnify, defend, and hold harmless Surbiton BoxFit, its owner, agents, contractors, and affiliates from any and all claims, damages, costs, expenses, and liabilities (including legal fees) arising from your actions or conduct during your participation in Surbiton BoxFit Services.
6. Accidental Injury or Death
Surbiton BoxFit is not responsible for any injury, illness, or death occurring as a result of your participation in kickboxing, fitness classes, or any other related activities, whether caused by your own actions or the negligence of Surbiton BoxFit or its owner. You acknowledge that accidents can happen despite safety precautions, and agree to participate at your own risk.
7. Medical Emergency
In the event of a medical emergency during any Surbiton BoxFit activity, you authorize the owner of Surbiton BoxFit to seek medical attention on your behalf if necessary. You agree to assume responsibility for any medical costs or expenses incurred as a result of any injury or medical emergency that may arise during or after your participation.
8. Age Restrictions
Participants must be at least 18 years old to participate in Surbiton BoxFit classes or any related activities. No individuals under the age of 18 are permitted to participate in Surbiton BoxFit Services.
9. Insurance
Surbiton BoxFit strongly recommends that all participants maintain personal health insurance to cover any medical expenses in case of injury. Surbiton BoxFit is not responsible for any medical bills or expenses resulting from participation in its Services.
10. Code of Conduct
Participants must act respectfully toward the owner of Surbiton BoxFit and fellow participants. Surbiton BoxFit reserves the right to refuse service, suspend, or terminate access to its Services for any participant who engages in disruptive, unsafe, or inappropriate behavior.
11. Termination of Agreement
Surbiton BoxFit reserves the right to terminate your participation in its Services at any time and for any reason, including non-compliance with these Terms, failure to make payment, or unsafe conduct.
12. Modification of Terms
Surbiton BoxFit reserves the right to update or modify these Terms at any time. Participants will be notified of any material changes. Continued participation in Surbiton BoxFit Services constitutes acceptance of any changes to these Terms.
13. Social Media
Surbiton BoxFit reserves the right to take photos of any participant taking part in the class. Any photos of participants will only be posted to social media if the participant has given verbal or written permission.
