Teton County School District No. 1 (“TCSD#1) offers a broad range of extracurricular activities to students enrolled in middle school and high school.  This broad range of activities places constraints on the ability of TCSD#1 to provide transportation for all of these activities at all times, and some activities and practices occur off-campus and require unsupervised travel to and from the activity or practice.  As a result, there are certain sports, contests, events, practices and extra-curricular activities that may require the student’s parents/legal guardians to arrange private transportation to and/or from an activity.  There also may be circumstances where a student opts out of traveling on the activity bus and requests to travel to and/or from the activity in a private vehicle with his or her parents/legal guardians or other approved adult. The Student has my permission to travel to and from practices or special events for the Activity, which may occur off-campus from TCSD#1 premises or properties, in a private vehicle, either driving himself/herself or with another student or approved adult.  [This provision applies to activities such as Nordic skiing, alpine skiing, golf, swimming, cross-country, yearbook or other sports or activities which may practice off-campus elsewhere in Teton County, Wyoming or may require unsupervised travel in a private vehicle]. NOTICE OF RISKS AND ACKNOWLEDGEMENT AND ASSUMPTION OF RISKS We (which collectively shall be defined as the Student and his/her Parents/Legal Guardians), for themselves and for and on behalf of their participating minor child, understand and agree there is an inherent risk of injury or death to the Student associated with participating in the Activity, which may include supervised or unsupervised travel in a private vehicle.  We acknowledge that participation in the Activity, and in all activities, including travel in a private vehicle, involves inherent risks unique to the Activity that may not be listed here and which may be known or unknown.  We acknowledge that the inherent and other risks, hazards and dangers (collectively referred to as “Risks”) of the Activity can cause injury, damage, death, personal property damage or other loss to the Student or others. The information provided about such Risks is not exhaustive; other unknown or unanticipated activities, risks, and outcomes may exist, and TCSD#1 cannot assure the Student’s safety or eliminate any of these Risks.  We acknowledge that the Student is voluntarily choosing to travel in a private vehicle with knowledge of the Risks. Therefore, we assume and accept full responsibility for the Student, for the inherent and other Risks (both known and unknown) of participating in the Activity, including supervised or unsupervised travel in a private vehicle, and for any personal injury, death, personal property damage or other loss to, or suffered by, the Student or others (including his/her Parents/Legal Guardians), resulting from those Risks, including the risk of the Student’s own negligence or other misconduct.  I/we give permission for the Student to participate in the above-referenced Activity, or other activities sponsored by TCSD#1, agree to discuss the nature of the Activity and Risks with the Student, and further knowingly and willingly agree to assume all such Risks resulting from the Student’s voluntary participation in the Activity. RELEASE AND INDEMNITY AGREEMENT: Please read carefully.  This Release and Indemnity Agreement (this “Agreement”) contains a surrender of certain legal rights.  We (the Student and the Parent(s)/Legal Guardian(s)), for themselves and for and on behalf of their participating minor child, hereby agree as follows: to release, hold harmless, and agree not to sue Teton County School District No. 1 (TCSD#1), together with  its trustees, officers, administrators, employees, volunteers, agents, affiliates, representatives, successors and assigns (collectively the “Releasees”), with respect to any and all claims, liabilities, losses, demands, damages, causes of action, suits, or expenses (including attorneys’ fees and costs) (hereafter collectively “Claims”) for any injury, damage, death or other loss in any way related to, or arising from, the Student’s enrollment or participation in the Activity, or any TCSD#1 activities, which includes travel and the use of any equipment, facilities or premises.  I hereby understand, consent and agree to waive any and all Claims that I or the minor Student has, or may have, against the Releasees and to bind the Student’s estate and any family member, heir, or other party bringing Claims, including any Claims which may be brought after the Student has reached the age of majority.  I further agree and warrant that neither I, nor the Student, nor anyone acting behalf on me or the Student, will make a claim against the Releasees as a result of any injury, damage, death or other loss suffered by me or the Student; and to defend, indemnify (“indemnify” meaning protect by reimbursement or payment) and hold TCSD#1, together with its trustees, officers, administrators, employees, volunteers, agents, affiliates, representatives, successors and assigns (collectively the “Releasees”), harmless with respect to any and all Claims brought by, or on behalf of: me, the Student, my spouse or other family member, the Student’s heirs or estate, a co-participant in the Activity, or any other person whatsoever, for any injury, damage, death or other loss to the extent caused by the Student’s conduct in the course of participating in the Activity, or any TCSD #1 activities, which includes travel and the use of any equipment, facilities or premises. This Activities Consent for Travel In a Private Vehicle is effective in regard to the Student’s enrollment or participation in the Activity, and in any and all activities (whether listed above or not), from the date signed until a subsequent consent is signed by the Student and one or both of his/ her parents/legal guardians and shall remain in full force and effect for all TCSD#1 activities in which the Student is enrolled or participates up until execution of such subsequent Form.  Note: For travel to or from a contest or event outside of Teton County, Wyoming, this form must be signed PRIOR to departure (if transportation is to an activity or both directions for an activity) by the Parent(s)/Legal Guardian(s) and school administrator and will serve for only the dates and contests listed.  This form must be signed by the Parent(s)/Legal Guardian(s) and coach/sponsor PRIOR to departure from an activity (if School District transportation was used to arrive at an activity and private transportation has been arranged to leave an activity).
