ACKNOWLEDGMENT OF RISKS, ASSUMPTION OF RISK AND RESPONSIBILITY, AND RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS. PLEASE READ CAREFULLY BEFORE SIGNING.

I have been provided the opportunity to participate in the The Stokeyard Outfitters Sauna experience (the “Sauna”) and hereby voluntarily agree as follows:

ACKNOWLEDGEMENT OF RISKS: My participation in the Sauna involves known and unknown risks, dangers, and hazards that may cause death, personal injury, damage to personal property and loss of personal property. The risks and consequences I am acknowledging include, but are not limited to:

● Slippery surfaces caused by water, ice, snow, or other substances;
● Exposure to cold temperatures;
● Exposure to hot temperatures;
● Exposure to hot equipment;
● Increased internal body temperature;
● Collisions or contact with other persons and objects inside or outside of
the Sauna;
● Exposure to airborne illnesses or transmittable diseases;
● Defects or weaknesses in the design, construction, repair, or modification
of the Sauna;
● Visible and invisible natural or man-made hazards in or around the Sauna;
● Other foreseeable and unforeseeable risks that contribute to the
unpredictability of my participation in the Sauna.
● Other foreseeable and unforeseeable risks that contribute to the
unpredictability of my participation in the Sauna.

REPRESENTATION OF FITNESS: I am physically and mentally fit to participate in the Sauna. I do not have any medical condition, such as anhidrosis, that interferes with my ability to sweat. I am not pregnant and am not subjecting a fetus to excessive body temperatures that may cause fetal damage during pregnancy. I am not taking or under the influence of any drugs, alcohol, medication, or other substance affecting my mental or physical state.

ASSUMPTION OF RESPONSIBILITY: I am responsible for my own safety and personal property. I cannot and will not rely on anyone other than myself to keep me or my personal property safe before, during, or after participating in the Sauna. My participation in the Sauna is voluntary and I can refuse to participate or quit participating in the Sauna at any time for any reason.

ASSUMPTION OF RISK: I assume all risk and responsibility for death, personal injury, damage to personal property and loss of personal property that I sustain in connection with my participation in the Sauna, except to the extent such damages, injuries, or death results from conduct that constitutes greater than ordinary negligence under Minn. Stat. § 604.055.

I understand that some swimwear is not designated to be used in chlorine and the hotel does not assume liability for any swimwear damage when using the spa pool.

MEDIA RELEASE: I hereby consent to the participation in interviews, the use of quotes, and the taking of photographs, movies or video tapes. I also grant to the right to edit, use, and reuse said media for marketing/communications purposes including use
in print, on the internet, and all other forms of distribution. I also hereby release Stokeyard Outfitters and its agents
and employees from all claims, demands, and liabilities whatsoever in connection with the above.
By signing this waiver I acknowledge that I have completely read and fully understand the above release and agree to
be bound thereby. I hereby release any and all claims against any person or organization utilizing this material.

WAIVER AND RELEASE FROM LIABILITY; COVENANT NOT TO SUE: I, for myself and for my personal representatives, executors, administrators, heirs or next of kin, forever waive, release, discharge, agree to hold harmless, and covenant not to sue The Hewing Hotel, Stokeyard Outfitters and their owners, shareholders, members, partners, employees, officers, directors, agents, and other affiliated persons or entities from any and all liability for any death, personal injury, damage to personal property, loss of personal property, costs, expenses, attorney’s fees, actions, causes of action, suits, obligations, judgments and claims of any nature that I sustain in connection with my participation in the Sauna, except to the extent such damages, injuries, or death result from conduct that constitutes greater than ordinary negligence under Minn. Stat. § 604.055.

INDEMNIFICATION: I indemnify and agree to hold harmless the Hewing Hotel and Stokeyard Outfitters, their owners, shareholders, members, partners, employees, officers, directors, agents, and other affiliated persons or entities from any and all liability for any death, personal injury, damage to personal property, loss of personal property, costs, expenses, attorney’s fees, actions, causes of action, suits, obligations, judgments and claims of any nature arising from, or in connection with, my participation in the Sauna.

AUTHORIZATION: Without creating any obligation, I authorize any medical treatment deemed necessary in the event of any injury or illness I sustain while participating in the Sauna. I either have appropriate insurance, or in the absence of insurance coverage, I agree to pay all costs of medical treatment provided to me.

RIGHT OF PUBLICITY: I authorize and consent to the use of my name, image, or likeness for commercial purposes in connection with the promotion and marketing of The Hewing Hotel and Stokeyard Outfitters.

BINDS HEIRS. It is my express intent that this agreement shall bind the members of my family and spouse, if I am alive, and my heirs, assigns and personal representatives, if I am deceased.
CHOICE OF LAW: This agreement is governed by the laws of the State of Minnesota. Any claim arising from this agreement or my participation in the Sauna must be brought in the state courts of Minnesota in Hennepin County.

SEVERABILITY: Pursuant to Minn. Stat. § 604.055, nothing in this agreement purports or intends to waive liability for damage, injuries, or death resulting from conduct that constitutes greater than ordinary negligence. If any provision of this agreement is held
invalid, such provision will be severed from this agreement, but the remaining provisions of this agreement will remain in full force and effect.

ASSUMPTION OF THE RISK AND WAIVER OF LIABILITY RELATING TO THE CORONAVIRUS/COVID-19 AMENDMENT: The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.

Stockyard Outfitters has put in place preventative measures to reduce the spread of COVID-19; however, Stockyard Outfitters cannot guarantee that you will not become infected with COVID-19.

I therefor acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 by using a sauna and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 by using a sauna may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Stockyard Outfitters employees, volunteers, and program participants.

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with my participation in any Stokeyard Outfitters sauna rental or programming (“Claims”).
I hereby release, covenant not to sue, discharge, and hold harmless Stokeyard Outfitters, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto.

I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Stokeyard Outfitters, its employees, agents, and representatives, whether a COVID-19 infection occurs or not.
I am of sound mind and understand that the entirety of the above is considered a legally binding agreement and not simply a recitation. I am fully capable of entering into a legal agreement.

RELEASE TERMS

HOTELS – For purposes of this Release the name ‘Crossroads Hotel MT’, and
related entities and subsidiaries, including, without limitation, Aparium Hotel
Group. This release also extends to any insurance Company providing or
workers compensation coverage to these entities.
NEGLIGENCE – Conduct or a failure to act that would be described as careless.
Failure to use the care that a reasonable person would use in similar
circumstances.
RELEASE – To give up or give away.
LIABILITY – Responsibility or responsible for.
INJURY – Physical or psychological wound, illness, hurt or harm.
DAMAGES – Compensation (money) for past and future medical bills, equipment
and care; pain & suffering; loss of society and companionship; loss of past wages
and future earnings; funeral expenses; caretaking costs; wrongful death and
other expenses or losses stemming from injury or death.
CROSSROADS HOTEL MT OPERATIONS – includes all activities and functions
relating to or arising out of the business of the Crossroads Hotel MT Facilities.
CROSSROADS HOTEL MT FACILITIES – The land, buildings and employees
located at Crossroads Hotel MT Kansas City, Missouri.

ACKNOWLEDGEMENTS
• Crossroads Hotel MT, has provided me with a list of terms used in this Release.
• I have read the list of terms and the definitions provided.
• I acknowledge that I have the right to talk with a representative of Crossroads
Hotel MT to discuss questions about this Release or the terms used in it.
• As an adult I understand that the daily activities of life carry a risk of injury. I
accept the inherent risks associated with providing services in and to an
operating hotel.
• I am aware that providing services in and to an operating hotel could result in
injury or death.

• I understand that injury or death could result from my own Negligence or the
Negligence of Crossroads Hotel MT or its staff in the Crossroads Hotel MT
Operations, Facilities or Crossroads Hotel MT Equipment.
• I understand that if this Release was not as broad as it is I would not have been
able to serve as an entertainer, collaborator, artist or guest at Crossroads Hotel
MT.
• I want to serve as an entertainer, collaborator, artist or guest at Crossroads Hotel
MT.
• Since it is my desire to serve as an entertainer, collaborator, artist or guest at
Crossroads Hotel MT, I am waiving my right to bargain or negotiate for a different
Release of Liability terms.

RELEASE OF LIABILITY
Having reviewed and understood the above acknowledgements, and in
consideration for my being selected as an entertainer, collaborator, artist or guest
at Crossroads Hotel MT, I release Crossroads Hotel MT, Aparium Hotel Group and
its affiliated entities from liability for any and all claim for damages stemming from
or arising out of negligent conduct on the part of Crossroads Hotel MT. I
understand that this release extends to negligent acts or failure to act on the part
of the agents and employees of Crossroads Hotel MT and the negligent or unsafe
condition of Aparium Operations, Aparium Equipment and / or Aparium Facilities
with this release I also release Aparium from legal liability for all claims whether
based on statutory, tort, contract law or other legal theories. In the event of a
conflict between the terms of this release, and any other agreement I may sign with
Crossroads Hotel MT, the terms of this release control.
I also understand that by signing this document my spouse, children, dependents,
guardians, and heirs may not bring a lawsuit seeking damages.
CAUTION THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS. BY SIGNING THIS
DOCUMENT, YOU GIVE UP YOUR RIGHT TO SURE APARIUM FOR DAMAGES
