LEGAL TERMS AND CONDITIONS

DISCLAIMER
A Place For Us and its organizers act on a purely voluntary basis and do not receive any compensation for the services offered or provided herein. We rely on third party volunteers to provide mentoring services. We rely in good faith on the information mentors have provided us about their backgrounds, credentials, qualifications, abilities, and aptitudes, which we have not independently sought to verify. We do not guarantee any medical or educational results. We have instructed our mentors to not seek in-person contact with mentees, and have also advised them to not record sessions with their mentees unless they have the express written permission of those mentees and their legal guardians. However, we do not monitor the interaction between mentors and mentees; this is a private interaction, and we rely upon the mentors to comport themselves appropriately within the bounds of our policies and any applicable law. If at any point, we determine that a mentor has violated our policies, the mentor will be removed from our program. Please let us know if you suspect or know of any such violations immediately.
LIMITATION OF LIABILITY
To the maximum extent permitted by law, A Place For Us and its organizers, representatives, mentors, and agents will not be liable for any direct, incidental, special, consequential, punitive, or multiple damages, or loss of any kind, whether incurred directly or indirectly, resulting from your use of A Place For Us, its services, or those provided mentors affiliated with A Place For Us.
CHOICE OF LAW
Except to the extent they are preempted by U.S. federal law, the laws of Illinois, other than its conflict-of-laws principles, govern these Terms and any claims and disputes (whether contract, tort, or otherwise) arising out of or relating to these Terms or their subject matter.

At A Place For Us (“the Organization”) we need guidance in setting shared standards, developing good business practices, and living up to our organizational core values. Each of us is expected to maintain the highest standard of ethical conduct when acting on behalf of the Organization. We are responsible for knowing the laws and regulations of the localities in which we operate or for which we are responsible, as well as the Organization’s policies that apply to our work and by which we are expected to abide. Leadership has the added responsibility of setting a good example and being accountable for the actions of anyone who reports to them. If you have any questions, talk to your supervisor or any member of the Board of Directors. You are expected to comply with both the letter and spirit of this Code of Conduct. It is your responsibility to seek clarification about the application of this policy to a specific situation. It is your duty to report violations of law and the Code of Conduct. Contact your supervisor or Board President if you believe a violation of law or of this policy has occurred. You will not lose your position or be mistreated for raising questions about A Place For Us’s policies and conduct. You also are required to cooperate fully with any authorized internal or external investigations. Making false statements to or otherwise misleading internal or external auditors, legal counsel, or any person charged with handling the investigation is grounds for your immediate termination. If you violate the law or A Place For Us’s policies, or deliberately withhold information during an ethics investigation, you will be subject to disciplinary action, possibly including termination. If you have any further questions, you should consult the Organization’s Whistleblower policy for further information.
COMPLIANCE WITH LAW
You are responsible for performing your duties in full compliance with all applicable laws and regulations. You may not knowingly participate in any act that violates an applicable law, rule, or regulation of any government, governmental agency, or regulatory body. If you believe that, as a matter of conscience, you cannot do something that you are asked to do, contact your supervisor or the Board President. If you determine that you have unknowingly participated in any act that violates an applicable local, state, or federal law, you must report the violation as soon as possible to your supervisor or the Board President.
DRUG-FREE WORKPLACE
A Place For Us is a drug-free workplace. Drug and alcohol use are highly detrimental to the safety and productivity of everyone in the workplace. The unlawful manufacture, possession, distribution, dispensation, transfer, purchase, sale, or being under the influence of alcoholic beverages or controlled substances while on A Place For Us’s property, attending to business-related activities, on duty, or operating a vehicle or machine leased, rented, or owned by the Organization is strictly prohibited. Drug abuse violations by anyone in the workplace will generally result in immediate termination or suspension. The duration of the suspension, termination, or mandatory participation in a drug abuse assistance or rehabilitation program will be determined upon review by management. When appropriate, the Organization may refer the staff member to approved counseling or rehabilitation programs. You may use physician-prescribed medications, provided that the use of such drugs does not adversely affect your job performance or your safety or the safety of other individuals in the workplace. Providing alcohol to any person under the legal drinking age is prohibited. In keeping with A Place For Us’s intent to provide a safe and healthy work environment, smoking is prohibited throughout the workplace.
DIVERSITY AND EQUAL OPPORTUNITY
A Place For Us’s future depends on its ability to attract and retain the best people at all levels of the organization. Therefore, the Organization is committed to a policy of attracting and retaining a diverse workforce. A Place For Us is also committed to treating each person fairly and equitably. We prohibit sexual or any other kind of discrimination, harassment, or intimidation, whether committed by or against a supervisor, coworker, volunteer, donor, vendor, or visitor. Discrimination and harassment, whether based on a person’s race, gender, color, religion, national origin, age, disability, marital status, personal appearance, sexual orientation, family responsibility, matriculation, veteran status, or political affiliation are inconsistent with our mission.
You must never use A Place For Us’s systems to transmit or receive electronic images or text of a sexual nature or containing ethnic slurs, racial epithets, or any other material of a harassing, offensive, or lewd nature. Receipt of any such electronic image must immediately be reported to your supervisor or the Board President.
If you believe that you are being subjected to discrimination or harassment, or if you observe or receive a complaint regarding such behavior, you should report it to your supervisor, or the Board President. A Place For Us will promptly investigate all allegations of harassment or discrimination and will take appropriate corrective action to the fullest extent permitted by local law.
Retaliation against individuals for raising claims of harassment or discrimination is prohibited. We also will ensure that anyone who assists in the investigation of a complaint is free from retaliation. Retaliation can take many forms, including the release of confidential personal information with respect to an employee who makes a complaint or who assists in an investigation. An individual may not ask for details about any complaint unless the person has a legitimate business need to know the information, and if anyone is asked to supply such information, he or she should immediately report it to his or her supervisor or the Board President.
PROPRIETARY MATERIAL
Confidential information, copyrights, and trademarks are all forms of proprietary material. Whether belonging to A Place For Us or to another organization, all proprietary information is to be treated as a valuable asset of the owner and may not be disclosed or used without permission.
Confidential information is information that is not generally known outside of an organization and is not known by public means. Examples of confidential information include financial reports, board reports, donor information, personnel information about current or former Organization employees or members, and vendor bids. You have a duty to protect this information regardless of how you obtained it.
Unless you receive prior approval, you may not disclose confidential information to anyone outside of A Place For Us who does not have a legitimate work-related reason to know the information. Any such disclosure must be in accordance with privacy laws regarding personal information. Likewise, you must respect the confidentiality of information given to you in confidence by others.
If it is necessary to receive or disclose confidential information in the context of a specific business transaction, first discuss the situation with your supervisor and, as appropriate, with legal counsel.
Apart from legally recognized “fair uses” of proprietary material, you may not use copyrighted material and trademarks without permission of the owner. This includes unauthorized duplication of computer software and making multiple copies of a publication when only a single copy has been purchased.
PUBLIC STATEMENTS
All A Place For Us’s public statements must be truthful, not deceptive, and in compliance with applicable laws, regulations, and Organization policy. Any claims about the work of A Place For Us must be verified before they are made. All solicitations of donors must also comply with this standard.
The following activities are expected from all participants, staff, and board members:
Acknowledge that this is a volunteer-based organization; if you have any concerns or bandwidth issues, please reach out to staff.
Treat others in the organization professionally and respectfully
cooperate with any adult supervisor/leader/mentor.
In general, the use of good judgment based on high ethical principles will guide directors, officers, and volunteers with respect to lines of acceptable conduct. However, if a situation arises where it is difficult to determine the proper course of conduct, or where questions arise concerning the propriety of certain conduct by an individual or others, the matter should be brought to the attention of A Place For Us. Volunteers should contact their immediate supervisor. Board members should raise any such concerns with the chair or the treasurer of Place For Us’s board. In all questions involving ethics and conduct, the board will make relevant determinations, except that any individual whose conduct is at issue will not participate in such decisions.
SUPPORT FOR OUR CODE OF CONDUCT
Consistent with our mission, A Place For Us is committed to supporting its people in meeting these ethical standards of conduct. In similar fashion, all A Place For Us officers, directors, members and volunteers must uphold these standards in their work conduct. If you observe or know of violations of these standards, or a violation of the law, or have questions about their meaning, intent, and/or application, it is your responsibility to report such a situation or pose any question promptly. A Place For Us will not tolerate any reprisal or retaliation or suspected violation of these standards or the law.

A Place For Us (the "Organization") requires its directors, officers, employees and volunteers to observe high standards of business and personal ethics in the conduct of their duties and responsibilities within the Organization. As representatives of A Place For Us, we must practice honesty and integrity in fulfilling our responsibilities and must comply with all applicable laws and regulations.
The purpose of this Whistleblower Policy is to create an ethical and open work environment, to ensure that A Place For Us has a governance and accountability structure that supports its mission, and to encourage and enable directors, officers, employees and volunteers of the Organization to raise serious concerns about the occurrence of illegal or unethical actions within the Organization before turning to outside parties for resolution.
Notwithstanding anything contained in this Whistleblower Policy to the contrary, this Whistleblower Policy is not an employment contract and does not modify the employment relationship between the Organization and any of its directors, officers, employees or volunteers, nor does it change the fact that all employees of the Organization are employees at will. Nothing contained in this Whistleblower Policy provides any director, officers, employee or volunteer of the Organization with any additional rights or causes of action not otherwise available under applicable law.
REPORTING RESPONSIBILITY
All directors, officers, employees and volunteers of A Place For Us have a responsibility to report any action or suspected action taken within the Organization that is illegal, unethical or violates any adopted policy of the Organization ("Violations"). Anyone reporting a Violation must act in good faith, without malice to A Place For Us or any individual in the Organization and have reasonable grounds for believing that the information shared in the report indicates that a Violation has occurred. A person who makes a report does not have to prove that a violation has occurred. However, any report that the reporter has made maliciously or any report which the reporter has good reason to believe is false will be viewed as a serious disciplinary offense.
NO RETALIATION
No one who, in good faith, reports a Violation or cooperates in the investigation of a Violation shall suffer harassment, retaliation or adverse employment consequences. Any individual within A Place For Us who retaliates against another individual who has, in good faith, reported a Violation or cooperated in the investigation of a Violation is subject to discipline, including termination of employment or volunteer status.
If you believe that an individual who has made a good faith report of a Violation or who has, in good faith, cooperated in the investigation of a Violation is suffering harassment, retaliation or adverse employment consequences, please contact the designated board members.
REPORTING PROCESS
All directors, officers, employees, and volunteers should address their concerns relating to a Violation to any person within A Place For Us who can properly address those concerns. In most cases, the direct supervisor of an employee or volunteer is the person best suited to address a concern. However, if you are not comfortable speaking with your supervisor or if you are not satisfied with your supervisor's response, you are encouraged to speak to any board member or to anyone in management you feel comfortable approaching.
An officer who believes that there has been an actual or probable material violation of the law, or any material breach of a duty owed to A Place For Us, must report the violation to a superior officer or designated board members. However, if the person to whom he or she would normally report is implicated in a violation, the officer should report directly to the board of directors.
A Place For Us encourages anyone reporting a Violation to identify themselves when making a report in order to facilitate the investigation of the Violation. However, reports addressed to an individual within A Place For Us may be submitted on a confidential basis and reports may be submitted to the designated board members anonymously. Reports will be kept confidential, to the extent possible, consistent with the need to conduct an adequate investigation.

1. What information do we collect?
We collect certain information from you (our volunteer mentors, our mentees and our mentees’ families) to conduct a variety of activities related to our objective of arranging matches between volunteer mentors and students in need of mentoring. We collect:
Information provided by you during signup. This information includes, but is not limited to: names, email addresses, phone numbers, University, and disability.
Information provided about you by other users. Volunteer mentors may provide us information about changes in mentees’ needs. Likewise, mentees and mentees’ families may provide us information about a volunteer mentor’s fit for them or for their student.
2. How do we use your information?
We use personal information collected from you:
To communicate with you. We and/or the volunteer mentors may use the personal information you send to us for our communication purposes. You can opt-out of our outreach emails at any time.
To respond to your inquiries and to offer support. We and/or the volunteer mentors may use your information to respond to your inquiries and solve any potential issues you might have with the use of our services.
To request feedback. We and/or the volunteer mentors may use your information to request feedback and to contact you about your use of our services.
To improve our matching service. We and/or the volunteer mentors may use your information to identify usage trends, to evaluate and improve our services, and to evaluate and improve the effectiveness of our outreach efforts.
To enforce our terms, conditions and policies.

To report on our service’s performance. In the event that we share general statistics about our service’s performance with third parties or with the public, no identifiable personal information will be included. If you would at any time like to review or change the information we associate with you, please email us at aplaceforusnetwork@gmail.com. If you would like to unsubscribe from emails we send through third party marketing services, you may click the unsubscribe button at the bottom of those emails.
At your request, we can delete your information from our active databases. However, some information may be retained in our files to prevent fraud, troubleshoot problems, enforce our Terms of Service and/or comply with legal requirements.
9. Do we update this policy?
Yes. We may update this privacy policy from time to time to stay compliant with relevant laws, and to reflect any changes to our services. At such a time, we will change the “last updated” text at the bottom of this policy. Significant changes will also be communicated via email to our volunteer mentors, mentees, and mentees’ families.

I agree to abide by all the policies of A Place For Us and assume full responsibility for all of my actions as an unpaid volunteer in this program. I recognize that if at any time I break any policy of A Place For Us, I will be removed from the program and I will assume total liability for any consequences of my action. These policies include but are not limited to the following:
1. Mentors will not meet in-person with their students at any point in the A Place For Us program.
2. Mentors will not record any meeting with their mentees without the express and written permission of those students and their legal guardians in accordance with state law. Any recordings that are made will be made only at mentees’ request (with the permissions above granted and the express written consent of the mentor) and will not be made available to anyone other than the student.
3. Mentors are expected to be fully honest with A Place For Us about their backgrounds, credentials, qualifications, abilities, and aptitudes in the context of their positions as volunteer mentors.
4. Mentors are expected to commit to meeting with their mentee at least twice a month for a year, at which point their mentorship relationship will be reevaluated.
5. Mentors may not share content with mentees that contains sexual images, vulgarity, graphic violence, threats, hate speech, or incitements to violence.
6. Mentors are not, to their knowledge, restricted by judicial decree, court order, or other legal restriction from interacting directly with minors.
7. Mentors may be terminated from the program at any time if they are shown to violate any given policy of A Place For Us.
8. Mentors may be current college students, or those enrolled in degree-granting professional schools, post-graduate programs, or recent graduates (graduated within 5 years). If you do not currently fall into any of these categories, please email us at aplaceforusnetwork@gmail.com to discuss other ways to get involved.
In light of this understanding, I commit to honoring A Place For Us policies and mission as a volunteer.

I agree to abide by all the policies of A Place For Us and assume full responsibility for all of my actions as a participant or as the legal guardian of a participant in this program. I recognize that if at any time I or my child break any policy of A Place For Us, I or my child will be removed from the program and I or my child will assume total liability for any consequences of my or my child’s actions. 1. Mentees under the age of 18 must ask their parents or guardians to review this policy and accept all terms on their behalf. Mentees under the age of 18 can only participate in A Place For Us with the consent of their parents/guardians.
2. Mentees consent to participate in virtual mentoring services conducted over video and/or phone.
3. Mentees will not meet in person with their mentors at any point in the A Place For Us program, and will not record any meeting without the express written permission of their legal guardians and their mentors, in accordance with state law. Any recordings abiding by these standards should not be made available to anyone other than the mentee recording and should be used only for mentees’ educational purposes.
4. Mentees are expected to be fully honest with the A Place For Us program about their experiences with their mentors and should uphold proper standards of conduct in the context of their participation. They will report any concerns that they have about interactions with tutors or potential policy violations by mentors to A Place For Us.
