Information on how to enter and the prize form part of these Terms and Conditions. Participation in the ‘Win the VIP Kaiser Brew Garden Experience’ giveaway (‘The Promotion’) is deemed acceptance of these Terms and Conditions.

 

  1. The Promoter is Giesen Group, 46B Halwyn Drive, Hei Hei, Christchurch, New Zealand.
  2. The promotion is open to attendees of the Great Kiwi Beer Festival 2022 aged 18 years and over.
  3. Employees (and their immediate family and/or those living in the same household) of the Promoter, and its respective affiliates, subsidiaries, agencies and suppliers associated with this promotion are ineligible to enter.

HOW TO ENTER

  1. The promotional period commences 11.00 am NZT on Saturday 29th January 2022 and ends at 11.59 pm NZT on Sunday 30th January 2022 (the ‘Promotional period’).
  2. A valid entry must include:
  1. Buy a Kaiser Bros beer at the Great Kiwi Beer Festival 2022 to get a ‘token’,
  2. Get your photo taken in the photo booth at the Kaiser Bros site (site 39), or take your own photo of you enjoying Kaiser Bros beer at the Great Kiwi Beer Festival 2022 event,
  3. Post your photo/s on Instagram, with the tag @kaiserbrosbeer
  4. Entries must be uploaded before the promotional period ends
  5. Please ensure posts are shared publicly so the Promoter can see them
  1. Entrants can submit multiple entries.
  2. One competition winner will be drawn and announced by Wednesday 2nd February 2022. The Promoter will determine the winner based on random selection.
  3. The winner will be contacted via their social media account that submitted the winning entry by Wednesday 2nd February 2022. This will also be announced on the Promoter’s social media channels.

 

          The Promoter’s decision is final and no correspondence will be entered into.

          The winner must acknowledge acceptance of and claim their Prize by replying to the social media message confirming their win with their name, email address, and phone number. This must be received by the Promoter no later than 4.00pm NZT on Friday 4th February 2022.

          If for any reason a winner does not acknowledge acceptance of and claim their Prize by 4.00pm NZT on Friday 4th February 2022, the Prize will be forfeited, and another winner selected.

          The Promoter will have no liability for a winner's failure to receive notices. Entrants are responsible for checking their social media channels in case they are selected as a winner. The Promoter recommends checking Message Requests, Other Messages, and Filtered Messages regularly through to 4th February 2022.

 

THE PRIZE

The one (1) winner of the Prize, will receive:

          A VIP experience for themselves and three friends at the Kaiser Brew Garden in Riverside Market, Christchurch. This experience includes food and beverages valued at $500. You’re in good hands and will be well looked after by the team.

PRIZE TERMS AND CONDITIONS

1.         The Prize must be used between February 2022 and November 2022.

2.         The Prize may not be redeemed on public holidays or public holiday weekends, and is subject to venue capacity and availability.

3.         The redemption date will be agreed by the winner, Kaiser Bros, and Kaiser Brew Garden. A minimum two-week lead time is required to confirm a redemption date.

4.         All participants in the experience must be aged 18 years or over.

5.         This Prize cannot be exchanged for goods or cash, sold to any other person, and is non-transferrable.

6.         Prizes or any unused portion of a Prize, are not transferable or exchangeable and cannot be taken as cash.

7.         The winner is solely responsible for any and all travel expenses to and from the Prize experience location.

8.         Winners agree to abide by all instructions provided by Kaiser Brew Garden, Kaiser Bros and Giesen Group staff and to follow all Health and Safety requirements as briefed by the team.

PERSONAL INFORMATION AND PRIVACY

 

1.         Information collected pursuant to the Promotion from entrants will be handled in accordance with all applicable laws in New Zealand, including the Privacy Act.

2.         By entering the promotion all entrants consent to all personal information collected, including but not limited to first and last names, phone number, email and city to be entered into Giesen Group database and to accept promotional communications. All communications will include an “opt out” option.

3.         Entrants may access, and request correction of, their personal information held by the Promoter by contacting +64 3 344 6270.

GENERAL

1.         The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence).

2.         The Promoter reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

3.         If a winner of the Prize is under the age of 18 years, the Prize will be forfeited by that entrant, and the next best entry will be awarded.

4.         The Promoter reserves the right to cancel, terminate, modify or suspend the promotion, or suspend or modify a prize under any circumstances.

5.         By attending the Prize event, all winners and their guests give permission to the Promoter to document their image and use that documentation in promotional campaigns including but not limited to social media, email, editorial, advertorial, website content and additional video platforms.

6.         As a condition of entering the Promotion, each entrant licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (which shall include Content) for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability. Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.

7.         As a condition of accepting the Prize, each winner must sign any legal documentation in the form required by the Promoter, and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

8.         Nothing in these Conditions of Entry limits excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Consumer Guarantees Act (Non-Excludable Guarantees).

9.         The Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.

10.  All entries become the property of the Promoter.

11.  These Terms and Conditions of Entry shall be governed by the laws of New Zealand and each entrant agrees to submit to the jurisdiction of the New Zealand court.

12.  The Promoter encourages consumers to enjoy responsibly. In New Zealand legal aged consumers are advised to consider the safe drinking levels recommended in the Health Promotion Agency (HPA).
