Dear Vice‑Chancellor of The Open University,

We, the undersigned, write with profound concern to demand an urgent public retraction of all commitments The Open University in the UK (OU) has made to UK Lawyers for Israel (UKLFI). These include commitments to not use the term “ancient Palestine” in future learning materials and to add caveats to existing content on grounds of the term being newly “problematic.” A Freedom of Information request confirms the OU's commitments as stated on UKLFI’s website.

There is a significant risk that these commitments could be interpreted as inconsistent with the OU’s statutory duties under the Higher Education (Freedom of Speech) Act 2023 (HEFSA). The commitments expose staff to harassment, set harmful precedents for further attacks on academic freedom, and make the OU complicit in the spread of disinformation and a politically motivated attempt to erase Palestine from history. Erasing historical facts can help legitimise Israel’s ongoing and unlawful annexation of Palestinian territories. Moreover, evidence of external interference in academic affairs damages institutional reputation, undermines academic integrity, weakens public trust and discourages open debate, which is central to Universities’ mission. We therefore ask the Vice-Chancellor to urgently and fully retract all commitments the OU has made to UKLFI.

The Higher Education (Freedom of Speech) Act 2023 (HEFSA) exists precisely to protect providers and their constituents (students, staff and visiting speakers) against the ideological influence of external lobby groups. UKLFI is a known lobbying entity under investigation for “strategic lawsuits against public participation (slapps)” [...] intended to limit freedom of expression on matters of public interest”, as reported in The Guardian, with its charitable wing also under investigation. Under the duties imposed by HEFSA, and in accordance with the Regulator’s Framework for Assessment, UKLFI’s request should have been promptly rejected with no concessions made. We remind the Vice-Chancellor of established interpretations of the Equality Act (2010), and that academic content should not be restricted or modified on the basis of offence, and this includes offence purported by an external lobbying entity.  

Requirements to add context notes as a result of external pressure amounts to compelling academics to frame or present their teaching in a way that reflects the ideological preference of an external lobby group, rather than their own professional judgment. The Office for Students’ Regulatory Advice, Section 3, Point 207 makes clear that “[a]cademic staff should not be constrained or pressured in their teaching to endorse or reject particular value judgements.” Proscription of an academically recognised term (“ancient Palestine") as a result of external pressure not only constitutes downright censorship but could have a chilling effect on lawful speech and academic freedom.

Despite repeated appeals from concerned members of staff for a public statement, the OU's continued public silence has allowed its ill-judged commitments and associated disinformation to spread across national and international media, The Telegraph, Israel National News, Talk TV, and others.

Under the Higher Education (Freedom of Speech) Act 2023, Vice-Chancellors have a ”positive duty” to take “reasonably practicable steps” to secure and protect lawful speech and academic freedom from improper external influence, with risk of financial penalties for non‑compliance. We therefore respectfully request you fully, publicly and urgently retract all commitments made to UKLFI, issue a public defence of the historical accuracy and importance of the term "ancient Palestine", and reaffirm the University’s commitment to its statutory duties under the HEFSA. To occasion institutional learning and reduce risk of recurrence, we also demand a thorough, independent inquiry into how this incident occurred.

My research covers India, ancient to modern, where contested territorial terminologies are rampant and discussed openly as such and not simply erased. Palestine was the name of a Roman province and needs to be used as such. The "Ancient" in Ancient Palestine is the problem, and could be equally labelled Ancient Israel+Lebanon+West Bank of Syria (which is not Israel).
