ACCIDENT WAIVER AND RELEASE OF LIABILITY FORM

 

 

I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING IN ANY/ALL ACTIVITIES ASSOCIATED WITH THIS EVENT, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault.

I certify that my child is physically fit and has completed a medical history examination performed by qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in APIAL Athletics.

I acknowledge that this Accident Waiver and Release of Liability Form will be used by the event holders, sponsors, and organizers of the activity in which I may participate, and that it will govern my actions and responsibilities at said activity.

In consideration of my child’s participation in APIAL athletics, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:

(A) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this activity, THE FOLLOWING ENTITIES OR PERSONS: The APIAL league and/or their directors, officers, employees, volunteers, representatives, and agents, and the activity holders, league members, sponsors, and volunteers;

(B) INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in APIAL athletics, whether caused by the negligence of release or otherwise.

I acknowledge that APIAL and their directors, officers, volunteers, representatives, and agents are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific athletic event on their behalf.

I acknowledge that this activity may involve a test of a person's physical and mental limits and carries with it the potential for death, serious injury, and property loss.

I hereby consent to receive medical emergency treatment which may be deemed advisable in the event of injury, accident, and/or illness during this activity.

I understand while participating in this activity, I may be photographed. I agree to allow my photo, video, or film likeness to be used for any legitimate purpose by the activity holders, producers, sponsors, organizers, and assigns.

The Accident Waiver and Release of Liability Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

I CERTIFY THAT I HAVE READ THIS DOCUMENT AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.

APIAL COVID-19 Waiver and Disclaimer

I understand that APIAL (Albuquerque Parochial and Independent Athletic League) has agreed to allow my child participate and myself (parent/spectator) to attend any athletic event sponsored and produced by APIAL and its affiliates. I am aware that the unprecedented pandemic COVID-19 has imposed strict measures to do everything presently known to be possible to prevent any person who might be infected with the virus from being present at an event sponsored and produced by APIAL and its affiliates. I am aware that that APIAL has taken every preventative measure to eliminate potential exposure or spread to any participant, spectator, volunteer or customer. I fully consent to abide by the rules, practices, and procedures imposed by APIAL. In furtherance of this goal, and agree that if I fail to do so, I will be forced to leave the event, premises, or location of the event taking place, with no liability on the part of APIAL. In such an event, and no refund of any fees I have paid. Despite all the practices and protections that APIAL has imposed it is possible an infection could occur without the infected person being aware of it and without it being detected by APIAL regardless of how rigidly followed or enforced. I knowingly and voluntarily waive any claim or demand against APIAL or its affiliates, any of its officers, officials, volunteers, athletic directors, administrators, coaches, or participants for any liability whatsoever for any loss or damages that I or they might suffer in the event that I or any member of my family should become infected by COVID-19. I understand that there is no way to prove that any such infection resulted from my or their presence at the an an APIAL event and I am taking some measure of risk, however small or remote, in deciding to partake in an APIAL event, and agree that I am assuming the risk in its entirety, will not seek to hold APIAL or its affiliates, any of its officers, officials, volunteers, athletic directors, administrators, coaches, or participants, in any way responsible for any harm that may come my way or my childs way or any party associated with myself, child or family in attendance.

Player, Parent & Spectator Code of Conduct

MISSION STATEMENT

To promote the spiritual, academic and physical welfare of its youth and good sportsmanship and fair play through all activities sponsored by APIAL.

APIAL has the following additional guidelines regarding conduct of its members. (as per the APIAL constitution)

a. CONDUCT OF COACHES, ADs and PLAYERS - Coaches, ADs and players must conduct themselves in a Christian manner and must honor all judgment calls of the referees. Coaches and parents will be responsible for the acts of their team’s players.

1. Any act of violence shall mean removal from the contest.

2. Any further act shall constitute removal from the gym/field. This applies to all persons present at the contest.

3. Non-compliance to the above will result in a one-year suspension from APIAL.

4. Any Coach/Athletic Director who does not conduct him/herself in a sportsmanlike manner will be suspended from participating in any contest for one year. Principals (or their representative), after consultation and mutual agreement with all coaches, referees, and other school representatives, have the right to stop any game if they feel it is harmful to the students. In such situations, the decision of the game will be brought to the board for final decision. Such games may end in a forfeit.

b. CONDUCT OF FANS - Fans must conduct themselves in a Christian manner and must honor all judgment calls of the referees.

1. Unsportsmanlike conduct (e.g., excessive noise during basketball free throws or volleyball serves) may result in a warning or removal from the gym/field.

We hold our student-athletes, coaches and parents to high standards of ethics and sportsmanship and we promote the development of good character and other important life skills. Integrity, fairness, and

respect are lifetime values taught through athletics. They are also the principles of good sportsmanship.  With them, the spirit of competition thrives, fueled by honest rivalry, courteous relations, and graceful acceptance of the results.  The following is a guideline for Sportsmanship as outlined by the Albuquerque Parochial and Independent Athletic League (APIAL).

I have read and understand the requirements of this Code of Conduct. I understand that I’m expected to perform according to this code and I understand that there may be sanctions or penalties if I do not.
