Marijuana Policy - In Effect

  1. Medical Marijuana
  1. Per Oklahoma state law, the use and/or possession of medical marijuana is legal with possession of a physician recommendation and State issued license and as such, the Oklahoma Society for Culture Appreciation (henceforth referred to as “the Company”) is prohibited from discriminating against potential or current employees, volunteers, contractors, or board members (henceforth referred to as “the Agent(s)”) on the basis of using and/or possessing medical marijuana while not performing official duties, possessing or having possessed an Oklahoma Medical Marijuana license, or the pursuit of any unless they are applying for or occupy a position classified as a “safety-sensitive”, the guidelines of which were presently set forth in Oklahoma House Resolution 2612, detailed here in Section 1, Subsection B.
  2. The definitions of safety-sensitive roles as set forth presently in Oklahoma H.R 2612 are as follows:
  1. the handling, packaging, processing, storage, disposal or transport of hazardous materials,
  2. operating a motor vehicle, other vehicle, equipment, machinery or power tools,
  3. repairing, maintaining or monitoring the performance/operation of any equipment, machinery or manufacturing process, the malfunction or disruption of which could result in injury or property damage,
  4. performing firefighting duties,
  5. the operation, maintenance or oversight of critical services and infrastructure including, but not limited to, electric, gas, and water utilities, power generation or distribution,
  6. the extraction, compression, processing, manufacturing, handling, packaging, storage, disposal, treatment or transport of potentially volatile, flammable, combustible materials, elements, chemicals or any other highly regulated component,
  7. dispensing pharmaceuticals,
  8. carrying a firearm, ori. direct patient care or direct child care;
  1. Use of Medical Marijuana during performance of official duties is not expressly permitted per Oklahoma law and is therefore prohibited unless a physician or legal exemption is provided in writing to the Company's Human Resources Department.
  1. Violation of these guidelines may result in disciplinary action, including and up to termination from role, and is to be decided by a majority decision of the Company's board upon recommendation of action by the Company’s Director of Staff Coordination or their designated agent following an investigation by the Director or their designated agent. An Agent suspected of violation of these guidelines will be suspended immediately pending investigation and disciplinary vote.
  1. Physical possession of medical marijuana on the Agent’s person while performing official duties is prohibited. Storage of medical marijuana in a bag, briefcase, office, locker, provided accommodations, etc is permissible as long as it is not readily accessible to other Company Agents or the general public.
  1. Violation of these guidelines may result in disciplinary action, including and up to termination from role, and is to be decided by a majority decision of the Company’s board upon recommendation by the Company’s Director of Staff Coordination or their designated agent following an investigation by the Director or their designated agent. An Agent suspected of violation of these guidelines will be suspended immediately pending investigation and disciplinary vote.
  1. Usage of Medical Marijuana in spaces rented by the Company is strictly prohibited.
  1. Spaces rented by the company are defined as spaces, rooms, or storage areas outlined in any valid contract with any venue; as well as hotel rooms rented and provided to agents during any event.
  2. Spaces rented by the company will also be defined by any interior of any office or warehouse spaces rented by the company.

  1. Non-Medical Marijuana
  1. Use and/or possession of marijuana without a state issued license is currently illegal under Oklahoma State Law and is therefore prohibited while performing official duties. Unlicensed use or possession of marijuana during performance of official job duties will result in immediate termination from the role.
  2. Usage of Non-Medical Marijuana in spaces rented by the Company is strictly prohibited.
  1. Spaces rented by the company are defined as spaces, rooms, or storage areas outlined in any valid contract with any venue; as well as hotel rooms rented and provided to agents during the event.
  2. Spaces rented by the company will also be defined by the interior of any office or warehouse spaces rented by the company.
  1. Severability:
  1. The Company and Agents acknowledge that this policy is reasonable, valid, and enforceable. However, if any term, covenant, condition, or provision of this policy is held by a court of contempt jurisdiction to be invalid, void, or unenforceable, it is the parties’ intent that such provision be changed in scope by the court only to the extent deemed necessary by that court to render the provision reasonable and enforceable and the remainder of the provisions in this policy will in no way be affected, impaired, or invalidated as a result.
