This document contains the TERMS and CONDITIONS for all purchases. This document relates to the seller, Lexi Shorey ( LLHollis324@gmail.com ) on PayPal. This seller can also be found at a few different locations. Only the locations specified below can be used as proof of alternate agreements or changes to these terms. If alternate agreements are in place, written proof from these sources must be available or it will not be binding via these terms.

*** Once you have made a purchase from or through me, it will be assumed you have read and agreed to these terms and conditions. Ignorance or failure to read these terms does not negate their binding nature. Negligence or lack of understanding does not negate their binding nature. Questions related to the terms and conditions can also be asked at any of the Official Locations previously stated.
*** It is important to note that these Terms and Conditions may change over time. If you have made any purchase on or after 03/10/2020, you agree to any future changes or amendments to this document. No grandfather clause will be provided. Purchasing from me opts you in to the understanding that this document may be changed or amended at any time, and remain binding.
- Adoptables, Premade Designs, and Customs
- Adoptables, for the purpose of this document, will be defined as pre-existing characters, imagery, text, and/or physical item(s).
- Premade designs, for the purpose of this document, are defined as specific premade creations that may be characters, imagery, text, and/or physical items.
- Customs, for the purpose of this document, will be defined as a character, imagery, text, and/or physical item(s) that is/are made, in whole or in part, to the specifications of the buyer.
- Pricing and Payment
- Pricing that is listed or agreed upon (such as for an auction or offer-to-adopt) is final. No negotiation may take place once this agreement has been made. Any attempt to not pay the full price will result in a cancellation of any agreement made and a blacklist, privately or publicly.
- If a character has been paid for in part but the buyer attempts to under-pay or get out of providing further payment, the transaction will be cancelled and items retained with the seller. No refund of previous payment will be provided.
- Blacklisting may occur on any or all of the official locations notated. This may be kept private, but may be made public if the seller (myself) deems it necessary.
- Payment Plans
- Payment plans may be offered on a case by case basis. This information will be included on the original sales post, or will need to be included via written confirmation at one of the Official Locations noted above.
- Payment plans always come with a non-refundable down payment. This is to ensure that the buyer is serious and intends to continue the payment plan.
- Once additional payments are made, they are always considered non-refundable.
- If the buyer chooses to back out or is unable to complete their payment plan in the agreed-upon time frame, the seller will retain all funds.
- Agreements to extend payment times and amounts may take place at any of the Official Locations noted above.
- Transfer of Ownership
- An official transfer of ownership takes place as soon as payment is made and acknowledged. Once you have paid, please wait for the seller’s confirmation prior to using the character, in order to avoid confusion.
- Files may be provided to the buyer via:
- ToyHouse transfer;
- Sta.sh link;
- Or Email.
- If you need to receive your file in a different manner, please contact the seller via one of the Official Locations stated above.
- Ownership, for the purpose of this document, indicates the rights to the character purchased. Once purchased and the transfer of ownership takes place, the buyer retains the rights to the character they purchased.
- These rights include the ability to use the character in nearly all contexts. This includes “Not Safe For Work” (NSFW), gore, and other mature work.
- Please be aware that there are a few exceptions to these rights. Please see the “revocation” section further down the page. Again, these terms and conditions are binding for all buyers.
- Gifting, Trading, Reselling
- Once ownership has been transferred, the buyer can choose to gift, trade, or resell the character as they see fit.
- The buyer may resell for any value they deem fit. There are no restrictions on resale value or additional art requirements.
- Any buyer who purchases from me for the sole purpose of reselling the character for a higher price will be blacklisted publicly or privately. However, the character will not be revoked.
- Revocation
- Generally speaking, a character cannot be revoked from a buyer unless extenuating circumstances exist. These circumstances are listed below. However, this will still be at the discretion of the seller (myself) even if the circumstance is not listed below. However, a non-personal reason will always be provided.
- Use of character to promote, encourage, insight, or portray severe illegal activity. This is primarily focused on crimes that are hateful or sexual in nature. These include, but are not limited to:
- Pedophilia, where the character is involved, present, or references;
- Beastiality, where the character is involved, present, or referenced;
- Rape or sexual assault, where the character is involved, present, or referenced;
- Necrophilia, where the character is involved, present, or referenced;
- User of the character to promote hate. Hate, for the context of this document, refers to the belief that a group of people is worth less than another based on any trait, belief, principle, or lifestyle. This includes race, sexuality, gender identity, ethnicity, culture, etc.
- Hate propaganda, imagery, or text where the character is involved, present, or referenced;
- Portrayal of commonly-accepted imagery, text, items, or other symbols that are directly or indirectly associated with hate groups or beliefs where the character is involved, present, or referenced.
- I.e. the confederate flag, the swastika
- Failure to pay or complete payment.
- Failure to pay, either by real currency, virtual currency, or an agreed-upon trade, will result in a revocation of the sold character(s).
- Failure to complete payment after a reasonable* timeframe will result in the revocation of the character(s).
- A “reasonable” time will be defined as a period of 3 months or more where at least 2 attempts at contact were made to discuss the payment/lack thereof.
- Refunds and Returns
- Refunds are NOT accepted under any circumstance. They may be issued at the discretion of the seller, but there is no obligation. It is the buyer’s responsibility to ensure that they are content with making their purchase before real currency, virtual currency, or any trade items change hands. The seller will not be held at fault for any ignorance, lack of forethought, or regret on the part of the buyer.
- Returns are always accepted. However, no refund of any kind will be issued. If the buyer prefers not to keep the character or other good they have been provided, the seller will retain the character/good and all associated rights. Once the buyer has chosen to return their purchase, this cannot be undone.
- Commissions, YCHs, and other Artistic Content
- Commissions, for the purpose of this document, will be defined as any artwork -- physical, digital, written, or crafted -- that the buyer has requested the seller to complete.
- YCHs, otherwise known as “Your Character Here” commissions, for the purpose of this document, will be defined as commissions that are completed on a pre-made template, though may involve editing on the part of the seller.
- Artistic content, for the purpose of this document, refers to any artistic creations that is not referenced elsewhere in this document.
- Pricing and Payment
- The buyer is expected to pay the agreed upon price in full once the invoice has been sent. Exceptions to this can be made only if a written agreement has taken place on any of the Official Locations noted above.
- Payment type and amount is not under negotiation unless otherwise stated via written proof from one of the Official Locations noted above.
- Failure to pay the full agreed upon price will result in a cancellation of the order(s) made. Any previous payments made will be retained by the seller and no refund will be provided.
- Turnaround Time
- Turnaround time, for the purpose of this document, will be defined at the time it takes from the confirmation of the order to the delivery of the order.
- A specific completion time is NOT guaranteed. Estimated completion times may be provided, but are not binding. This stands even if an approximate time was given in writing at one of the Official Locations above.
- This means that orders are not guaranteed by a specific date or time under any circumstance.
- An estimated time may be provided upon requests.
- Delays may occur for a variety of reasons. This may be announced or unannounced. Questions regarding order status can be directed to any of the Official Locations above.
- Frequent harassment regarding turnaround time or delays will result in cancellation of the order(s) and retainment of the payment by the seller.
- Frequent harassment, for the purpose of this document, will be defined as continual inquiries into order status. In order to be defined under this term, these inquiries must be at least 3 per week for 2 weeks. These weeks do not have to be consecutive.
- A warning does not have to be issued prior to cancellation.
- Estimated turnaround times for most pieces will be between 4-8 weeks. However, as stated above, estimated turnaround times are NOT binding or guaranteed.
- Updates regarding delays are generally provided via status post on DeviantArt or Story on Instagram.
- Ordering
- Buyers are held responsible for the information that they provide to the seller. Failure to provide all information may result in an error in the completed order. These errors can be fixed, but there will be an additional fee.
- Errors made on the part of the seller will be fixed free of charge. However, it must be evident that the information was provided prior to the order being confirmed.
- Dislike of the final result of an order will not result in any changes. If a request to change something to the piece is made, an additional fee will be charged.
- Buyers are responsible with ensuring that all needed funds (real, virtual, or trade items) are readily available. An order cannot be placed without these funds immediately available for use.
- Payment Plans
- Payment plans may be offered on a case by case basis. This information will be included on the original sales post, or will need to be included via written confirmation at one of the Official Locations noted above.

- Refunds and Returns
- Refunds will not be issued under any circumstance. Please be sure to read and understand these Terms and Conditions prior to placing an order.
- Returns will be accepted, but no refund will be provided. If you no longer want what you had previously ordered, the seller will take it back and retain the rights to the work. This cannot be undone once a return has been made.
- Examples and Seller Usage
- The seller has the right to use all creations and orders as examples of their work in future posts, highlights, and presentations, with or without credit to the commissioner.
- OVERARCHING INFORMATION
- Blacklisting
- Blacklisting, for the purpose of this document, refers to prohibiting the buyer from making any future purchases from the seller.
- Private, or soft, blacklisting refers to the personal notation that a seller makes to no longer allow and buyer to make purchases from them.
- Public, medium, blacklisting refers to a public announcement of the blacklisted user and the reason they have been blacklisted by the seller. This may be a temporary or permanent listing.
- Hard blacklist refers to prohibiting the buyer from making any future purchases from the seller, owning any characters or content made by the seller, or having any seller-made art anywhere in their possession.
- Hard Revocation
- Hard revocation, for the purpose of this document, will be defined as the process where the seller removes all rightful material from the buyer. This includes, but is not limited to, revoking all characters with their gained art (seller made or not), and commissions, YCHs, or products made by the seller, and any content otherwise associated with the seller.
- Hard revocations implies the complete separation of the seller from the buyer, where all work associated with the seller is revoked and returned to the seller’s possession. The buyer loses all rights to this content and will not be provided with a refund for any previous purchases made.
- A hard revocation can only take place in a limited number of circumstances. Extreme examples from the revocation section above are fitting examples. In addition, proven scammers who have, or attempt to, con others are often included here as well.
- While this is fully at the discretion of the seller, a reason will ALWAYS be provided if a hard revocation takes place.
- Refunds
- Refunds are not available under any circumstance.
- If a buyer attempts to issue a chargeback, this document and the buyer’s presumed agreement will be provided.
- Harassment
- Harassment of any kind will not be tolerated. This type of behavior may result in a cancellation of order, blacklist, hard blacklist, revocation, or hard revocation. Extreme cases may be reported to local authorities. Under all circumstances, a refund will not be issued.
- Harassment is defined as either:
- 3 or more inquiries or undesired contacts within 1 weeks time for a period of 2 weeks or more (does not have to be consecutive);
- Unprofessional and/or unwarranted contact of any nature that occurs at least 2 times, without any time frame or limit;
- or unwarranted, gross, illegal, or disturbing contact which causes discomfort, fear, or sense of threat. One occurence of this will meet the definition of harassment.
- Crediting
- All work must be properly credited to the seller at any of the Official Locations noted above.
- Do not claim the work as your own.
- Failure to properly credit may result in anything from a blacklist to a revocation.
- Seller Rights
- The seller reserved the right to:
- Turn down a buyer for any reason
- Cancel an order prior to payment
- Cancel an order with no reason given if refund is given
- Invoke any terms and conditions above at any time
- Change these terms and conditions as they see fit.
