To the Trustees of Columbia University:

 

We, the undersigned, are alumni of Columbia University, many of whom contribute our time and money to the University. We are shocked and grieved at the actions taken by University leadership in recent weeks, including this week’s capitulations to the government.  We are deeply concerned about the University’s seeming unwillingness to condemn actions that have violated students’ and alumni’s due process rights, its acquiescence to policing activity which violates the University’s duty of care towards the student community, and its failures to live up to our shared values, particularly in its recent announcement of disciplinary action.

 

1.    Student protest has a proud tradition at the University. Hamilton Hall was occupied by students for various causes at least five times prior to the 2024 student protest. Last week’s expulsion of students from the University for exercising their First Amendment rights hearkens back to one of the ugliest periods of the University’s history, and contravenes both the university’s own stated commitment to academic freedom and the purpose of the First Amendment, which protect speech, even of the kind that may be deemed to be controversial at the time.

 

We demand greater transparency around the disciplinary process that led to student expulsions and multi-year suspensions, including disclosure of any communications from domestic and international donors or politicians targeting student protestors.  Students should be given the opportunity to appeal these decisions and seek reversal of the expulsions and reinstatement of those degrees temporarily revoked on the basis of First Amendment-protected speech.

 

2.    While we appreciate that the administration’s 7 March letter to University leadership purporting to revoke $400 million in federal grants has introduced a sense of uncertainty, its legal basis must be challenged. As former Columbia Law School professor Michael Dorf wrote, “the claim that Columbia has been ignoring reports of anti-semitism is false.” Even if some feel that the claim had validity, 42 U.S. Code §2000d-1 provides at least five prerequisite conditions for removing federal funds, none of which were fulfilled by the administration prior to the 7 March letter. According to Columbia Law School’s own scholars of constitutional law, the government's subsequent March 13 demand letter violates Title VI. Nevertheless, in public communication, the University has appeared to capitulate entirely, offering “to work with” with the administration on fulfilling its baseless demands, and continuing to allow ICE to make arrests on campus, enter non-public buildings and search student residences. The University’s apparent surrender is inexplicable on legal and ethical grounds, and contrasts sharply with the response of Georgetown University to a similar threat against their students’ First Amendment rights.

 

We demand that Columbia University publicly recognize its primary duty to its student population; disclose all collaborations with agents from the FBI, the Department of Homeland Security, Immigration and Customs Enforcement, and the NYPD; and immediately notify students of any inquiries from those agencies about them. While we are aware of university policy which only admits law enforcement to non-public buildings if they provide a judicial warrant, we further demand that the university bar DHS and ICE agents from public areas of campus without valid warrant. We welcome the guidance issued to University staff directing them to call Public Safety and engage the Office of General Counsel to validate and inspect warrants provided by government agencies, but a policy that requires law enforcement to first contact General Counsel would offer more security to students.

 

3.    The arrest of Mahmoud Khalil by unidentified plainclothes agents, for the exercise of protected speech rights, has shocked the world, led to criticism from human rights organizations, and been disavowed by hundreds of Columbia’s alumni, including many Jewish alumni. After appealing to the University following doxing and threats – and receiving no response - Mr. Khalil was arrested and remains detained without legal basis and in blatant violation of his rights as a lawful permanent resident of the United States. The government is claiming, for the first time in history, the “undefined deportation power” of the Secretary of State that may well be unconstitutional and is currently being challenged. The government’s charging document makes clear that it cannot proceed with Mr. Khalil’s removal without the assistance of the University. The arrest of Mr. Khalil points to a broader climate of heightened policing activity targeting Columbia students, which has in many cases been enabled by the University itself. Indeed, the University’s invitation to the New York Police Department to enter campus in April 2024, and again in 2025 at the Milstein sit in, and arrest its own students may have violated the duty of care. Since then, the university’s quiet acceptance of the federal government’s open admission that it targeted students for “pro-Palestinian” activity, including Ranjani Srinivasan, who lost her student visa over what she describes as social media posts, and Leqaa Kordia, who was detained after being arrested during last spring’s protests, have only heightened student concerns about student safety and academic freedom.

 

We urge the University to make a public statement condemning Mr. Khalil’s unlawful detention. We demand that it cease and desist from sharing Mr. Khalil’s (or any student’s) disciplinary or other academic information with any government agency without consent or proper procedure and expect that the University will marshal all resources to protect all students from targeting by the government on the basis of protected speech.

 

While at Columbia, an institution older than the Constitution, we learned to question unchecked authority, fulfill our civic duties, and uphold the rule of law. The rights violations detailed above transcend any one student or issue, and threaten the University’s founding values as well as its security. At this moment in history, we urge the University to change course and be “the light” that its students deserve.
