STIPULATED FACTUAL PROFFER

The Defendant, his counsel, and the United States agree that, had this matter had

proceeded to trial, the United States would have proven beyond a reasonable doubt the following

facts, which are sufficient to support a guilty plea to the sole count of the Information:

On August 13, 2009, the FBI executed a valid search warrant at the residence the

defendant shared with another individual. Inside one room, agents found approximately thirty

(30) images of child pomography posted on the walls, including images of children plainly under

twelve (12) years of age. None of the images, however, depict conduct that constitutes either

sadism or masochism. Some of these thirty images depict victims who have been previously

identified by law enforcement and which are known to have traveled in interstate commerce.

The defendant admits to possessing these thirty images.
