PREÁMBULO Considerando que ambas instituciones han firmado, en el mismo acto, un Protocolo General/Convenio General/Convenio Marco que contempla el intercambio de estudiantes. Considerando que las partes reconocen la importancia de ofrecer a sus estudiantes la oportunidad de conocer los planes de estudio, la lengua y la cultura de los países participantes, por el presente Convenio Específico acuerdan lo siguiente: | PREAMBLE Whereas both institutions have signed, on the same date, a General Agreement providing for the exchange of students. Whereas the parties recognise the importance of offering their students the opportunity to learn about the curricula, language and culture of the participating countries, they hereby agree as follows: | |
| 1. OBJECTIVE | |
Las partes establecen un Programa de Intercambio de Estudiantes que permita al alumno inscrito en una Universidad (Universidad de Origen) cursar materias en la otra (Universidad Receptora) para que le sean acreditadas como parte de los requisitos necesarios para obtener un grado académico en la Universidad de Origen. Los estudiantes propuestos por cada universidad serán aceptados en la otra a fin de cursar un conjunto de materias pre-acordadas. La aceptación queda sujeta a la valoración académica de la Universidad Receptora. Para ser elegibles en este Programa de Intercambio, los estudiantes deberán cubrir todos los requisitos y la normatividad establecida tanto por la Universidad de Origen como por la Universidad de Destino. | The parties establish a Student Exchange Programme that will allow students enrolled at one University (Home University) to attend courses at the other (Receiving University) to be accredited as part of the requirements necessary to obtain an academic degree at the Home University. Students proposed by each university will be accepted at the other in order to study a set of pre-agreed courses. Acceptance is subject to the academic assessment of the Receiving University. To be eligible for this Exchange Programme, students must meet all the requirements and regulations established by both the Home University and the Host University. | |
2.1 Los estudiantes aceptados en este programa de intercambio deberán: a)Permanecer inscritos como alumnos de tiempo completo en su Universidad de Origen y haber cubierto el pago de inscripción y colegiaturas en dicha Universidad, quedando exento de abonarlo en la Universidad de Destino. b) Comprometerse a estudiar un mínimo de un semestre académico y un máximo de un año de tiempo completo en la Universidad Receptora, con el programa de estudios previamente aprobado por las autoridades académicas correspondiente de la Universidad de Origen. c) Asumir: a. Gastos varios requeridos por la Universidad de Destino, tales como: seguro internacional, con cobertura médica, de accidentes, repatriación y responsabilidad civil; seguro escolar, de ser aplicable; gastos por actividades especiales, cuotas de laboratorio o deportivas, etc. b. Billetes de avión, alojamiento, alimentación y otros gastos que se originen con motivo de las actividades académicas en la Universidad de Destino. 2.2. Los estudiantes aceptados en este Programa de Intercambio podrán solicitar apoyo financiero mediante las convocatorias a las que tienen acceso como alumnos de su universidad de origen. 2.3. Los estudiantes de intercambio deberán certificar la tenencia de un seguro médico “o equivalente” que cubra enfermedad, accidentes, hospitalización, repatriación y en caso de ser necesario por la naturaleza de las actividades a realizar, de responsabilidad civil, que cubra todo el período de estadía. 2.4. Cada estudiante de intercambio será responsable de obtener su visa y los documentos legales que pudiese requerir para el viaje. Ambas instituciones dentro de sus posibilidades asistirán, en lo necesario para satisfacer los requerimientos de visa locales y otras formalidades, a los estudiantes visitantes, por el período completo de su intercambio. 2.5. El intercambio de estudiantes será administrado, gestionado y coordinado a través de los organismos técnicos correspondientes en ambas instituciones. En la ULL, la unidad encargada será el Vicerrectorado de Proyección, Internacionalización y Cooperación, en colaboración con las comisiones de movilidad de los centros. En la UNIRSM la unidad encargada será La Oficina de Internacionalización, en colaboración con la Oficina de Administración Estudiantil. | 2. OBLIGATIONS AND RIGHTS OF PARTICIPANTS 2.1 Students accepted on this Exchange Programme must: a) Remain enrolled as full-time students at their Home University and have covered the registration and tuition fees at that University, being exempt from paying them at the Host University. b) Commit to study a minimum of one academic semester and a maximum of one year full-time at the Receiving University, with the study programme previously approved by the corresponding academic authorities of the Home University. c) Bear the costs of: a. Miscellaneous expenses required by the Host University, such as: international insurance, with medical, accident, repatriation and civil liability coverage; school insurance, if applicable; expenses for special activities, laboratory or sports fees, etc. b. Airline tickets, accommodation, food and other expenses arising from academic activities at the Host University. 2.2. Students accepted on this Exchange Programme may apply for financial support through the calls for applications to which they have access as students of their Home University. 2.3. Exchange students must certify that they have medical insurance "or equivalent" covering illness, accidents, hospitalisation, repatriation and, if necessary, due to the nature of the activities to be carried out, civil liability insurance, covering the entire period of their stay. 2.4. Each exchange student will be responsible for obtaining his/her visa and any legal documents that may be required for the trip. Both institutions will, to the best of their ability, assist visiting students in meeting local visa requirements and other formalities for the full period of their exchange. 2.5. The student exchange will be administered, managed and coordinated through the corresponding technical bodies at both institutions. At the ULL, the unit in charge will be the Vice-Rectorate for Projection, Internationalisation and Cooperation, in collaboration with the mobility commissions of the centres. At the University of San Marino, the unit in charge will be the Internationalisation Office, in collaboration with the Student Administration Office. | |

Cada Universidad enviará la información pertinente de sus candidatos a la Universidad de Destino. Estas candidaturas deberán ir acompañadas por una historia académica oficial y pasaporte, así como por cualquier otra documentación que sea requerida por la Universidad de Destino. Las partes acuerdan las siguientes fechas límite para la postulación de solicitudes de estudiantes: Postulaciones a la ULL: 30 de junio para los estudiantes de primer cuatrimestre (septiembre-enero) y 30 de noviembre para los estudiantes de segundo cuatrimestre (febrero-junio). Postulaciones a la UNIRSM: 15 de mayo (semestre de otoño) y 15 de noviembre (semestre de primavera). La Universidad de Destino tendrá la decisión final sobre todas las admisiones de estudiantes recibidos como estudiantes de intercambio, conforme a los mecanismos establecidos por su normativa interna. 3.3. Cada Universidad estará a cargo de difundir el Programa de Intercambio entre sus estudiantes; para ello, las universidades acuerdan intercambiar todos los documentos o enlaces web que ofrezcan información a los candidatos sobre los planes y programas de estudios disponibles en cada institución. 3.4. El número de estudiantes que serán admitidos en el Programa de Intercambio para cada año será de dos por curso académico, tanto si cursan un semestre como si cursan el año completo. Las partes harán todo lo posible para que exista paridad en la cantidad de alumnos intercambiados, pero se reconoce que periódicamente pueden presentarse desequilibrios en ese número. El número de estudiantes intercambiados deberá estar equilibrado al final del periodo de vigencia del presente convenio. De ser necesario, regulará este asunto la Comisión Técnica mencionada en el artículo 3.1 de este Convenio. | 3. Each University shall send the relevant information on its candidates to the Host University. These applications must be accompanied by an official academic record and passport, as well as any other documentation required by the Host University. The parties agree on the following deadlines for the submission of student applications: ULL applications: 30 June for first semester students (September-January) and 30 November for second semester students (February-June). UNIRSM applications: 15 May (Fall semester) and 15 November (Spring semester) The Host University will have the final decision on all admissions of incoming exchange students, in accordance with the mechanisms established by its internal regulations. 3.3. Each University will be in charge of disseminating the Exchange Programme among its students; to this end, the universities agree to exchange all documents or web links that provide information to candidates about the curricula and study programmes available at each institution. 3.4. The number of students to be admitted to the Exchange Programme for each year shall be two per academic year, whether for one semester or for the full year. The parties will make every effort to ensure parity in the number of students exchanged, but it is recognised that imbalances in the number of students exchanged may occur from time to time. The number of exchanged students shall be balanced at the end of the term of this agreement. If necessary, this matter shall be regulated by the Technical Commission referred to in Article 3.1 of this Agreement. | |
El presente convenio entrará en vigor a partir de la fecha de su firma y su vigencia será de 4 años. Podrá ser prorrogado por igual periodo, previa evaluación de los resultados, mediante acuerdo expreso por escrito de las partes. Este convenio puede darse por terminado anticipadamente por cualquiera de las partes mediante notificación por escrito a la otra con noventa (90) días de antelación a la fecha de terminación anticipada. Aparte del fin de periodo de vigencia y la terminación anticipada antedichos, serán causa de extinción del presente convenio la decisión judicial declaratoria de nulidad del mismo, el común acuerdo entre las partes y el incumplimiento de sus términos por alguna de las partes. En caso de terminación anticipada, las partes tomarán las medidas necesarias para evitar perjuicios, tanto a ellas como a terceros, en el entendido de que deberán continuar hasta su conclusión las actividades ya iniciadas. |
This agreement shall enter into force on the date of signature and shall remain in force for a period of 4 years. It may be extended for an equal period, after evaluation of the results, by express written agreement of the parties. This agreement may be terminated early by either party by giving ninety (90) days written notice to the other party prior to the date of early termination. Apart from the aforementioned end of term and early termination, the termination of this agreement shall be caused by a court decision declaring the agreement null and void, by mutual agreement between the parties and by the breach of its terms by any of the parties. In the event of early termination, the parties shall take the necessary measures to avoid damages, both to themselves and to third parties, on the understanding that the activities already initiated shall continue until their conclusion. | |
Queda expresamente pactado que las partes no tendrán responsabilidad civil por los daños y perjuicios que pudieran causarse como consecuencia de caso fortuito o fuerza mayor, particularmente por el paro de labores académicas o administrativas, en la inteligencia de que, una vez superados estos eventos, se reanudarán las actividades en la forma y términos que determinen las partes. |
It is expressly agreed that the parties shall have no civil liability for damages that may be caused as a result of unforeseen circumstances or force majeure, particularly for the stoppage of academic or administrative work, on the understanding that, once these events have been overcome, activities will be resumed in the manner and under the terms determined by the parties. | |
6. MODIFICACIONES Este Convenio podrá ser modificado o adicionado por acuerdo mutuo de las partes, mediante la firma de Adendas; dichas modificaciones obligarán a los signatarios a partir de la fecha de su firma. | 6. MODIFICATIONS This Agreement may be modified or added to by mutual agreement of the parties, through the signing of Addenda; such modifications shall be binding on the signatories as of the date of signature. | |
Este convenio es producto de la buena fe, en razón de lo cual los conflictos que llegaran a presentarse en cuanto a su interpretación, formalización y cumplimiento, serán resueltos, en principio, de común acuerdo entre las partes. De no ser posible alcanzar un acuerdo, las partes se someterán al dictamen de un arbitraje externo. |
This agreement is a product of good faith, which is why any conflicts that may arise regarding its interpretation, formalisation and fulfilment will be resolved, in principle, by mutual agreement between the parties. If it is not possible to reach an agreement, the parties shall submit to external arbitration. | |
