1 WELCOME
[1.1] Welcome to Florentein’s: In these terms and conditions or “Booking Terms”
[1.1.2] “You” and “your” refer to the holidaymaker who is requesting a Booking.
[1.1.3] The words “we”, “our” and “us” refer to Florentein’s, an all around design solutions service. We were hired by the “Owner” (which means the Owner of the property) of the “Property” (which means a holiday rental property) Tigh Na Sith and the management of its (‘Website’ or ‘Site’): www.tigh-na-sith.co.uk and all its Bookings. We also manage a direct booking website through Lodgify: www.tigh-na-sith.lodgify.com
[1.2] To any “Booking” (which means the Booking of a property) you make through us for use of a property that we manage, these Booking Terms apply. These Bookings can be made through the site or sites we manage, by telephone, or email.
[1.3] The Bookings you make with us legally binds you to two individual contracts, which are as follows:
[1.3.1] Contract to the Owner of the property. When you make a Booking with us, you enter a contract with the Owner of the property for the use of their property as a holiday accommodation (we call this the “Rental Contract”). This contract is strictly between you and the Owner which we are not a part of. The terms of this Rental Contract includes:
[1.3.1.1] these Booking Terms;
[1.3.1.2] the dates or period of time you are allowed to use the property (which we will refer to as the Holiday Period)
[1.3.1.3] The charges we would collect on behalf of the Owner of the property for your use of the property within the Holiday Period agreed upon and any other charges due by you to the Owner.
[1.3.1.4] Details specific to your booking including restrictions to your use of the property (which we refer to as Booking Details)
[1.3.1.5] If there are any recent updates or additional changes to the conditions, we will make sure to raise your attention in the booking process.
[1.3.1.6] We will send you an email when we accept your booking request. (we will call this Booking Confirmation)
[1.3.2] The second contract you will be entering is a contract directly with us for the use of the site or sites we manage and any other services we provide. We call this contract the “Booking Contract”. Our services are as follows (we refer to any booking related services we provide as “Booking Services”):
[1.3.2.1] We provide the service to allow you to make a Booking to a property.
[1.3.2.1.1] We may charge you for a Booking Fee for our Booking Services and this will be reflected in the Total Amount of payable charges before you confirm your booking.
[1.3.2.2] We provide customer service for any queries you may have before and after your booking confirmation.
[1.3.2.3] We facilitate payment charges on behalf of the Owner such as prepayments, refunds and other additional fees related to your Booking.
[1.4] “Deposit” refers to the amount we will charge you initially when you confirm your booking. This will be 20% of the Total Amount.
[1.5] “Total Amount” refers to the overall amount you owe under the Rental Contract between you and the Owner. We will charge you for the Booking you made through us for the duration of your Holiday Period.
[1.6] “Remaining Balance” refers to the remaining balance payable after the initial Deposit. This transaction must be completed 14 days before your arrival at the property.
[1.7] “Guest” or “Guests” refers to holidaymakers apart from you that are included in the Booking for the duration of the Holiday Period.
[1.8] “Rental Fees” refers to any and all payment in connection with the Booking, this includes the Booking Fees, Deposit and Total Amount and any other relevant charges that are payable within your booking.
2 YOUR BOOKING
[2.1] To be eligible to make a booking you must be 18 years of age and are capable of entering legally binding contracts
[2.2] You must provide us your full name, date of birth, address and phone number and any other information we will need in order to process your booking request
[2.3] You must have a working payment method that is acceptable by our Site. These can include credit card, Paypal, or bank transfer.
[2.3.1] If booking by telephone or email, you must provide information we require as seen on Paragraphs 2.2 and 2.3.
[2.4] When you request a booking with us, you confirm that:
[2.4.1] You and the other Guests agree to these Booking Terms.
[2.4.2] All of the information you provided in Paragraphs 2.2 and 2.3 are correct.
[2.5] By making a booking with us, you agree to:
[2.5.1] Enter a Rental Contract for the property you selected and its respective Owner.
[2.5.2] Enter a Booking Contract with us; and
[2.5.3] Pay any and all fees due in respect of the Deposit and Total Amount.
[2.6] Before we give you a Booking Confirmation, the following steps must take place:
[2.6.1] You provide us with your Booking Details on our booking Site. You will be given the chance to review your booking before submitting your request. Information regarding our cancellation policies and a copy of these Booking Terms would also be available which you would have to confirm that you have read and understood. Please note that all bookings are subject to our confirmation, once we have confirmed your booking, we will send you an email where you could proceed with the payment.
[2.6.1.1] Once the payment is processed, we will send you an email with your Booking Confirmation and a receipt for your payment.
[2.7] If you’re booking by telephone, we will read to you your Booking Details and confirm that you are happy to go through with the booking. Once you’ve confirmed to go through with the booking, we will send you a quote together with a payment request by email where you could proceed with the payment.
[2.8] When your booking process is successful, we have processed your Deposit and the Holiday Period you intend to book is available, we will send you an email confirmation with all your booking details and a copy of these Booking Terms. Please keep us up to date regarding your contact information at all times. 24 hours after we’ve sent you your Booking Confirmation, if you have not amended or contacted us regarding any changes with your Booking Details, we would consider that you are happy to go through with the booking.
[2.9] After you have received your Booking Confirmation, that is when the Rental Contract with the property Owner and the Booking Contract with us takes effect.
[2.9.1] It is your responsibility to check all the details of your booking. We will amend any mistakes in the booking details provided you contacted us within 24 hours after you’ve received your Booking Confirmation at no extra cost.
[2.9.1.1] If you contacted us more than 24 hours after you received your Booking Confirmation regarding a mistake with your booking, we will amend the mistakes in exchange for a fee.
[2.10] Please note that we have the right to cancel the booking, even after we have sent you your Booking Confirmation if we have reasonable cause to do so. We may cancel your booking if:
[2.10.1] The information you have provided to us is false and incomplete.
[2.10.2] You have been abusive, unlawful or inappropriate to any of our staff or the property Owner.
[2.10.3] You have a history of breaking the Booking Terms based on previous bookings and are likely to break them in your current booking.
If we do cancel your booking, please note that we and the Owner are no longer responsible for you and the Booking Contract and Rental Contract are void effective immediately. We will refund you the equivalent of your remaining Holiday Period (we will consult our pricing service on how much each individual night cost and we will deduct this from the Total Amount you paid for) from the date we cancel the booking and we will keep the rest of the Total Amount you paid to us. Please provide us with your banking details for the refund at your earliest convenience.
[2.11] The maximum Holiday Period you could book with us is 28 consecutive days.
[2.11.1] The minimum Holiday Period you could book is 7 consecutive days. Please let us know if you intend to leave the property earlier than 7 days so we can arrange for cleaning duties accordingly.
3 OUR ROLE AND LIABILITY
[3.1] Our role in this Booking Terms is to provide you with Booking Services to the best of our abilities.
[3.2] On behalf of the Owner, we act as an agent to collect Rental Fees from holidaymakers (which is you). The Owner has provided us the responsibility to refuse bookings in accordance with these Booking Terms.
[3.3] It is the Owner who will provide you with Rental Services (this are services provided to you by the Owner including your permission to stay in the Property and its usage as a holiday accommodation);
[3.4] We will provide you with Booking Services and answer your queries about any information regarding the booking of the property wherever applicable (we refer to this as “Customer Service”)
[3.5] We ensure that our Website is always up to date in terms of the latest photos, videos and descriptions to the best of our ability.
[3.6] Our Booking Services are available for personal use only. We do not give you or any of the guests booked into the property any permission to any commercial use of our services.
[3.7] We are not responsible for the speed of the Internet Service Provider we provide you for your Holiday Period. We are also not responsible for the reception of mobile data or other network services you require during your Holiday Period in the Property.
[3.7.1] In the event that the Wi-Fi we provide in the Property will be unavailable during your Holiday Period, we will provide you with this information at the earliest possible time
4 CHARGES AND PAYMENT
[4.1] You will be presented with a breakdown of the charges payable before you confirm your booking. The breakdown includes:
[4.2] The Booking Fee which becomes non-refundable after we have sent you your Booking Confirmation.
[4.3] Any other extra services you selected during the booking process. We may also include any additional services or add-ons you requested before confirming your booking.
[4.4] When you are presented with the Deposit, which is payable after we have accepted your booking, you are also given the date on which you must pay the Remaining Balance. This is usually 14 days before your arrival on the Property.
[4.5] We currently accept the following payment methods: Credit Cards, Debit Cards and Paypal.
[4.5.1] Manual payment by bank transfer may also be arranged ahead of time. Please contact us if this is the case, we will only consider this payment method if you are paying all the Total Amount payable in one payment.
[4.6] Our prices may vary depending on the season.
[4.7] If you had authorised us to charge your credit card for the Deposit and the Remaining Balance, we will automatically take payment from your credit card immediately for the Deposit and on the scheduled date for the Remaining Balance using the original payment method.
[4.7.1] If you had not authorised us to charge your credit card for the scheduled date of the Remaining Balance or your credit card expired or became unusable, you will have to settle this amount with another payment method. Please contact us immediately so we may find a way for you to pay these charges. Failure to do so will result in cancellation of the booking. Please see our Cancellation Policy.
5 YOUR RESPONSIBILITIES
[5.1] It is your responsibility to make sure that all the information you have provided us is correct.
[5.2] It is your responsibility to ensure that all financial transactions made in your name are your responsibility. All payments due and their due date will be presented to you and you shall be responsible in paying them within the time frame that we specified.
[5.3] It is your responsibility to arrive at the Property on the check in time and date specified in your Booking Confirmation and not earlier. You will also vacate the property on the check out time and date specified in your Booking Confirmation and not later. Please inform us if you intend to leave earlier so we may arrange for cleaning services accordingly.
[5.3.1] It is your responsibility to ensure that the number of guests does not exceed the amount you have confirmed with us and what is stated on your booking confirmation.
[5.3.1.1] This includes extra pets and any other guests that may come and stay in the property.
[5.3.2] It is your responsibility to treat us, ours and the Owner’s representatives and the neighbours of the property with respect and consideration. We will not tolerate abuse of any kind including inappropriate, anti-social and irresponsible use of the property.
[5.3.3] In the event that the Owner and the Owner’s representatives need access to the property for reasonable purposes and given that they have informed you well in advance, except for emergency situations (i.e. Facilities need replacing or fixing, you and any of your guests are reasonably suspected of breaching these Booking Terms). It is your responsibility to comply and let them do the work they need to do.
[5.3.4] It is your responsibility to ensure that you leave the property as it was on arrival. This includes furniture, utensils, appliances, equipment, fixtures and fittings. Please treat the property with care and respect.
[5.3.5] If there is significant damage to any of the furniture, utensils, appliances, equipment, fixtures and fittings that occurred within your Holiday Period, the Owner and the Owner’s representatives (which may include us) may charge you additional fees in order to fix the property back to its state of repair.
[5.3.6] It is your responsibility to notify us or the Owner about any significant damage or breakages to the furniture, utensils, appliances, equipment, fixtures and fittings in the Property as soon as possible. You agree to reimburse the Owner in full for the repair of the damages and breakages incurred.
[5.3.7] It is your responsibility to ensure that all guests are informed regarding their responsibilities and obligations to the property as stated in Paragraph 5.3
[5.3.8] You are responsible for your guests and all their activities within your Holiday Period even if you are not staying there yourself.
[5.3.9 It is your responsibility to ensure that you and your guests have the appropriate health and travel documents if you are traveling from outside the UK. This includes health and travel documents for your pets. We will not be responsible for any penalty fees or other expenses that are incurred in the event of a complication regarding travel or health documentation on your part.
[5.3.10] It is you and your guests responsibility to use the property solely for the purposes of a holiday or private accommodation.
[5.3.10.1] This includes using the property as a private accommodation for work purposes.
[5.4] Failure to comply with any of the requirements as stated on Paragraph 5.3 will result in your Rental Contract being void. The Owner or the Owner’s representatives may refuse you to enter and stay at the property. All charges then including the Deposit, additional fees and Total Amount paid to us and the Owner are effectively non-refundable. We will also not be responsible for finding you and your guests further accommodation nor will we be responsible for any other expenses you require afterwards.
6 AN OWNER’S RESPONSIBILITY
[6.1] The Owner will provide you with Rental Services to the best of the Owner’s ability;
[6.1.2] It is the Owner’s responsibility to provide the latest descriptions of the property. The Owner will notify us regarding any changes that may affect our description of the property within your Holiday Period and in turn we will notify you as soon as possible.
[6.1.3] It is the Owner’s responsibility to maintain and clean the property before you and your guests arrive.
[6.1.4] Is it the Owner’s responsibility to ensure that you and your guests have exclusive access to the property and Rental Services within the Holiday Period specified in your Booking Confirmation. In the event of a breach in Booking Terms as stated in Paragraph 5.4, you and your guests forfeit this exclusive access.
[6.1.5] It is the Owner’s responsibility to comply with any applicable laws and regulation including Health and Safety, and regulations relating to fire.
[6.1.6] It is the Owner’s responsibility to ensure the Owner has the right to let the property, provide Rental Services and enter a Rental Contract with you.
[6.1.7] It is the Owner’s responsibility to ensure that insurance policies are in place to meet any liabilities under the Rental Contract with you.
[6.1.8] It is the Owner’s responsibility to cooperate with you regarding any matters about Rental Services and refunds which we may process on behalf of the Owner.
[6.1.9] It is the Owner’s responsibility to share with you the access details to the property.
[6.1.10] It is the Owner’s responsibility to treat you and your guests with respect and consideration.
[6.1.11] It is the Owner’s responsibility to comply with the Rental Contract.
[6.1.12] It is the Owner’s responsibility to facilitate and resolve any problems that may arise during you and your guests’ Holiday Period. This may also be facilitated by us on behalf of the Owner if it is within our power to do so, we will endeavor to answer all your questions and resolve issues to the best of our abilities except for times when a professional intervention is needed. (i.e. plumbing, electrical issues, internet service provider issues etc.)
7 PETS
[7.1] Pets are allowed in the property unless stated otherwise on our Site for any reason.
[7.1.2] Please refrain from letting pets on the beds and furniture where possible. Please bring your own pet beds. Your pets must not be left alone in the house or outside within the garden area.
[7.1.3] Please note that any damages or traces made by your pets are your responsibility. Please ensure that you remove any traces left behind by your pets inside and outside before you vacate the property. The Owner may charge you for additional cleaning fees if damages or traces are left behind which we may facilitate on the Owner’s behalf.
[7.2] If you or any of your guests are allergic to animals, please note that the property allows pets. This will be advertised on our Site. It is your responsibility to inquire if you or one of your guests have an animal allergy. We will not accept any responsibility regarding health related issues that may occur during your Holiday Period because of animal allergy.
8 AMENDING, TRANSFERRING AND CANCELLATION POLICY
[8.1] If you wish to amend a booking after you received your Booking Confirmation, please contact us directly by the contact details we provided in Paragraph 16
[8.1.2] Please note that there may be additional charges as a result of us amending the booking. We will notify you of these charges beforehand and you will be responsible for paying them.
[8.2] If you wish to cancel your booking after you received your Booking Confirmation, Our cancellation policy is as follows:
[8.2.1] If you wish to cancel your booking 60 days before your arrival date in your Booking Confirmation, we will refund you the Deposit you paid in full (100%).
[8.2.2] If you wish to cancel your booking 30 days before your arrival date in your Booking Confirmation, we will refund you the Deposit you paid in half (50%).
[8.2.3] If you wish to cancel your booking in less than 30 days before your arrival date in your Booking Confirmation, we will not refund you the Deposit you paid.
[8.2.4] Any Booking Fee paid to us is non-refundable as we have already provided the Booking Services for you on that particular booking.
[8.3] You may not transfer the Rental Contract or the Booking Contract to any other person. You are still legally responsible for all the obligations under the Rental Contract, these Booking Terms and your guests compliance to them as stated in Paragraph 5.3 regardless of your stay or absence in the property within your Holiday Period.
9 YOUR RIGHTS TO END A RENTAL CONTRACT
[9.1] You have the right to end a rental contract if us or the Owner made a serious breach of these Booking Terms.
[9.2] For our cancellation policy, please refer to Paragraph 8.2
[9.3] Please consult your local Citizens' Advice Bureau or Trading Standards office for details about your consumer rights.
10 UNEXPECTED EVENTS
[10.1] In the event that an unforeseeable accident, including fire; natural disasters, pandemic or epidemic, law or guidance abided by the local or national government occurs during or before your Holiday Period, we on behalf of the Owner and the Owner have the right to end the Rental contract. We call these events “Unexpected Events” that may hinder or likely hinder:
[10.1.1] The Owner to provide you with the Rental Services the Owner has promised; or you and your guests’ ability to stay at the property due to dangerous or unsafe health hazards.
[10.2] If such Unexpected Event occurs during or before your Holiday Period, we will offer you these alternatives:
[10.2.1] We will notify you, if at all possible, in advance about the Unexpected Event to the best of our abilities and alternative options that you may take in anticipation of said Unexpected Events.
[10.2.2] We may arrange for you and your guests alternative bookings within reasonable standards from what services we and the Owner offer. Please note that we will not be responsible for any cost and any other expenses beyond finding you a suitable and reasonable accommodation.
[10.2.3] The Owner will refund you (we may also facilitate this) the Rental Fees except for the reasonable damages incurred at the day of terminating the Rental Contract.
[10.3] Completing any of these options ends our responsibility to you in regards to your original booking.
11 OTHER CONSEQUENCES OF A RENTAL CONTRACT ENDING
[11.1] In the event that your Rental Contract with the Owner is ended before the end of your Holiday Period you must:
[11.1.1] You and your guests vacate the property as soon as possible;
[11.1.2] Notify us, the Owner or the Owner’s representatives that you have left the property and adhered to the check out instructions (return key or keys according to check out instructions). You may tell us, if relevant, the reason for your leaving. Please note that there will be no refund as a result of your leaving early.
12 INSURANCE
[12.1] We strongly advise you to take reputable travel insurance for your own benefit. It is your responsibility to make sure that you are covered for the duration of your travels.
13 OUR LIABILITIES AND RESPONSIBILITIES
[13.1] We are not responsible for any part of your Rental Contract; it is solely between you and the Owner. We have no responsibility to you or your guests regarding the Rental Contract.
[13.2] We do not exclude ourselves from our responsibility to you where it would be unlawful to do so.
[13.3] We are responsible to you for anything we say in these Booking Terms under the Booking Contract.
[13.4] We are not responsible for any of you and your guests’ belongings and vehicles including their contents. We are not liable for any injuries, loss or damages to you or your Guests and your and their properties during your Holiday Period in the property unless it is as a result of our own negligence.
14 THE OWNER’S LIABILITIES AND RESPONSIBILITIES
[14.1] The Owner is not responsible for any of you and your guests’ belongings and vehicles including their contents. The Owner is not liable for any injuries, loss or damages to you or your Guests and your and their properties during your Holiday Period in the property unless it is as a result of the Owner’s negligence.
[14.2] The Owner does not exclude themselves from their responsibility to you where it would be unlawful to do so.
15 COMPLAINTS
[15.1] If you or any of your guests have any complaints about the Booking Services we provided or your stay in the property within your Holiday Period, please do not hesitate to contact us directly by the contact information we provided in Paragraph 16.
[15.2] Complaints may be made by email, telephone or through our Site. Please be mindful that we do not tolerate abusive and inappropriate behaviour.

These are some of the basic house rules we would like you to follow while you are staying at Tigh Na Sith
More detailed instructions are available in the house via a green folder located next to the broadband router.
Please treat Tigh Na Sith as your home away from home, with care and respect.
