Planning Commission Meeting

August 24, 2016

Those in attendance: Chairman Joe Stubbs, Vice-Chair Nancy Baird, Commissioner Brian Ewell, Commissioner Ron Hawkins, Commissioner John Rosenberger, Commissioner Sandra Greenwood, Ashlee Collard, Bryan Draper, Justin Faulkner, Mr. and Mrs. Mike Washburn, Lawrence Lavery, Mr. and Mrs. Ben Carson.

Approval of Minutes from July 27, 2016 Planning Commission Meeting. No changes needed.

John Rosenberger made a motion to approve Planning Commission Minutes from July 27, 2016.

Nancy Baird seconded.

All in favor.

Second agenda item removed from agenda per Chairman Joe Stubbs.

Discussion and possible action on a building permit application for a single family dwelling on property owned by Russ and Ashlee Collard located at approximately 904 E 715 S in the Genola Heights Subdivision. Commission discussed all setbacks and frontage. Since lot is part of an approved subdivision frontage should have already been resolved and approved. Decision was made that the frontage measurement was needed and the utility box to be labeled on the site plan.

Brian Ewell made a motion to approve the Collard’s building permit contingent on showing the utilities, the frontage, and the back measurement.

Joe Stubbs seconded.

All in favor.

Discussion and possible action on an amended plan for a subdivision owned by Mike Washburn located approximately 962 N Main St. It was discussed on what the original subdivision lines are and what the proposed property lines are. Legal counsel advised that as long as all lots that are under the same ownership or all parties are willing to sign off then the decision to approve the lot line adjustment can be made at the public meeting. It was determined that all properties are owned by either Mr and Mrs Washburn or the family trust, which Mrs. Washburn is the executor of the trust. A Final Mylar will need to be submitted to the county with the lot line adjustment.

Joe Stubbs made a motion to approve preliminary lot line adjustment on the Washburn property.

Discussion and possible action on a building permit application for a single family dwelling on property “under contract” by Ben Carson (represented by Justin Faulkner) located at approximately 923 N 350 E Parcel # 40.401.0008. Site Plan presented to commission. All setbacks, frontage, and easements discussed and verified per site plan checklist.

Joe Stubbs made a motion to approve a building permit application for Ben Carson.

Brian Ewell seconded.

All in favor.

Discussion on a possible building permit application for a shed on property owned by Stubbs Brothers, LLC. located at approximately 754 E 1200 N. Shed will only be used for agriculture storage. Site plan did not properly show side and rear setbacks. Discussion regarding what setbacks are required for an agriculture only shed.

John Rosenberger made a motion to approve with contingencies of the side and rear setback showing on the site plan and proper ownership be listed.

Sandra Greenwood seconded.

All in favor. Chairman Joe Stubbs recused himself from vote.

Discussion and possible action on a Final Mylar for a subdivision owned by Alan Davis (represented by Farrah Davis) located at approximately 645 E 1200 N. No changes needed.

Sandra Greenwood made a motion to approve the Briar Patch Final Mylar owned by Alan Davis.

John Rosenberger seconded.

All in favor.

Discussion with Lawrence Lavery regarding a potential subdivision. Mr. Lavery is simply wanting to change title of 2 of the lots under his ownership. All lots will continue to be agriculture ground.

Lawrence Lavery will be making an application in order to be place on the September Planning Commission Agenda. Legal Counsel will research what can legally be done regarding dividing agriculture land.
