1. WHAT INFORMATION DO WE COLLECT?

In Short:  We collect information that you provide to us.

We collect personal information that you voluntarily provide to us when you register on the Website, express an interest in obtaining information about us or our Services, when you participate in activities on the Website or otherwise when you contact us.

The personal information that we collect depends on the context of your interactions with us and the Website, the choices you make and the products and features you use. The personal information we collect may include the following:

·         Personal Information Provided by You. What we collect depends on which product and license type you use:

Hypatia Create — Site License (Google)

Under a site license for the Google version of Hypatia Create, users are not required to create a named account. Each user is issued a pseudo-account. We store a one-way cryptographic hash of the user's email address; we do not store the email address itself in readable form, and we do not store the user's name. We do not collect IP address or location for site-license users. We collect pseudonymous usage information under a randomly generated identifier that is not linked to any individual's identity — for example, how many days per month the add-on is used and counts of in-product actions.

Hypatia Create — Individual and Group Licenses, and the Microsoft and Canva versions

Under an individual or group license, and for the Microsoft and Canva versions of Hypatia Create, users create an account. For these accounts we store the email address, the name the user provides, and either a hashed password or, for social/third-party sign-in, a provider identifier. We also store the most recent IP address and an approximate location derived from that IP address (city or region level, provided by our network provider, Cloudflare). We collect usage information associated with the account.

We use approximate location for statistical analysis and for fraud detection and prevention. Where an institution prefers that we not collect approximate location for its users, we can exclude the institution's email domain(s) from location collection on written request to privacy@hypatiasys.com.

Hypatia Teach

Where a school, school district, or other educational institution uses Hypatia Teach, we may receive limited student information from the institution or through its Google Workspace for Education environment, including student name, school-issued email address, class or course roster membership, and student work product submitted through the Service (for example, mathematical expressions and assignment responses). Hypatia Teach is provided through our website and through Google Workspace for Education. We also collect the approximate location (city or region level, derived from IP address) of users accessing Hypatia Teach.

We do not collect student home address, telephone number, date of birth, government identification number, biometric data, precise geolocation, disciplinary records, or health records.

Student information is collected and processed only at the direction of, and on behalf of, the educational institution. The institution — not Hypatia — determines what student information is provided to us and controls its use. Where an institution requires a student data privacy agreement, we enter into one. Section 17 (Student Privacy Compliance) sets out the framework that applies.

·         Payment Data. We may collect data necessary to process your payment if you make purchases, such as your payment instrument number (such as a credit card number), and the security code associated with your payment instrument. All payment data is securely stored by Stripe, Inc. You may find their privacy policy link here: https://stripe.com/en-ca/privacy

·         Social Media Login Data. We may provide you with the option to register with us using your existing social media account details, like your Facebook, Twitter or other social media account. If you choose to register in this way, we will collect the information described in the section called “HOW DO WE HANDLE YOUR SOCIAL LOGINS” below.

All personal information that you provide to us must be true, complete and accurate, and you must notify us of any changes to such personal information.

2. INFORMATION AUTOMATICALLY COLLECTED

In Short:  Some information — such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our Website.

We automatically collect certain information when you visit, use or navigate the Website. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, approximate location (derived from IP address, at city or region level; we do not collect precise or device-based geolocation), information about how and when you use our Website and other technical information. This information is primarily needed to maintain the security and operation of our Website, and for our internal analytics and reporting purposes.

The information we collect automatically includes:

·         Log and Usage Data. Log and usage data is service-related usage and performance information our servers automatically collect when you access or use our Website and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type and settings and information about your activity on the Website (such as the date/time stamps associated with your usage, pages and files viewed, searches and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called ‘crash dumps’) and hardware settings).

3. HOW DO WE USE YOUR INFORMATION?

In Short:  We process your information for purposes based on legitimate business interests, the fulfillment of our contract with you, compliance with our legal obligations, and/or your consent.

We use personal information collected via our Website for a variety of business purposes described below. We process your personal information for these purposes in reliance on our legitimate business interests, in order to enter into or perform a contract with you, with your consent, and/or in compliance with our legal obligations. We indicate the specific processing grounds we rely on next to each purpose listed below.

We use the information we collect or receive:

·         To facilitate the account creation and login process. If you choose to link your account with us to a third-party account (such as your Google or Facebook account), we use the information you allowed us to collect from those third parties to facilitate the account creation and login process for the performance of our contract with you. See the section below headed “HOW DO WE HANDLE YOUR SOCIAL LOGINS” for further information.

·         To post testimonials. We post testimonials on our Website that may contain personal information. Prior to posting a testimonial, we will obtain your consent to use your name and testimonial. If you wish to update or delete your testimonial, please contact us at privacy@hypatiasys.com and be sure to include your name, location, and contact information.

·         To request feedback. We may use your information to request feedback and to contact you about your use of our Website.

·         To enable user-to-user communications. We may use your information in order to enable user-to-user communications with each user’s consent.

·         To manage user accounts. We may use your information for the purposes of managing your account and keeping it in working order.

·         To send administrative information to you. We may use your personal information to send you product, service and new feature information and/or information about changes to our terms, conditions, and policies.

·         To protect our Services. We may use your information as part of our efforts to keep our Website safe and secure (for example, for fraud monitoring and prevention).

·         To enforce our terms, conditions and policies for business purposes, to comply with legal and regulatory requirements or in connection with our contract.

·         To respond to legal requests and prevent harm. If we receive a subpoena or other legal request, we may need to inspect the data we hold to determine how to respond.

·         To fulfill and manage your orders. We may use your information to fulfill and manage your orders, payments, returns, and exchanges made through the Website. To administer prize draws and competitions. We may use your information to administer prize draws and competitions when you elect to participate in our competitions.

·         To deliver and facilitate delivery of services to the user. We may use your information to provide you with the requested service.

·         To respond to user inquiries/offer support to users. We may use your information to respond to your inquiries and solve any potential issues you might have with the use of our Services.

·         To improve our Services. We may use your information to inform ongoing improvements to our Services we may implement

What we do not do with your information. We do not sell personal information. We do not share personal information for cross-context behavioural advertising. We do not use student information for targeted advertising, to build a commercial profile of a student, or to train artificial intelligence or machine learning models other than those directly required to deliver user-facing features of the Service to the relevant institution. We do not permit our service providers to do any of these things.

4. WILL YOUR INFORMATION BE SHARED WITH ANYONE?

In Short:  We only share information with your consent, to comply with laws, to provide you with services, to protect your rights, or to fulfill business obligations.

We may process or share your data that we hold based on the following legal bases:

Consent: We may process your data if you have given us specific consent to use your personal information in a specific purpose.

Legitimate Interests: We may process your data when it is reasonably necessary to achieve our legitimate business interests. Legitimate interests are not a basis on which we process student information. Student information is processed only on the documented instructions of the educational institution, in our capacity as a school official under FERPA and as a service provider or processor under applicable privacy law.

Performance of a Contract: Where we have entered into a contract with you, we may process your personal information to fulfill the terms of our contract.

Legal Obligations: We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).

Vital Interests: We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or as evidence in litigation in which we are involved.

More specifically, we may need to process your data or share your personal information in the case of a Business Transfer. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company. Where such a transfer involves student information, we will require the successor entity to be bound by commitments no less protective than those in this policy and in any executed student data privacy agreement, and we will provide notice to affected educational institutions, which may terminate and require deletion of student information prior to the transfer.

5. HOW DO WE HANDLE YOUR SOCIAL LOGINS?

In Short:  If you choose to register or log in to our services using a social media account, we may have access to certain information about you.

Our Website offers you the ability to register and login using your third-party social media account details (like your Facebook or Twitter logins). Where you choose to do this, we will receive certain profile information about you from your social media provider. The profile information we receive may vary depending on the social media provider concerned, but will often include your name, email address, friends list, profile picture as well as other information you choose to make public on such social media platforms.

We will use the information we receive only for the purposes that are described in this privacy policy or that are otherwise made clear to you on the relevant Website. Please note that we do not control, and are not responsible for, other uses of your personal information by your third-party social media provider. We recommend that you review their privacy policy to understand how they collect, use and share your personal information, and how you can set your privacy preferences on their sites and apps.

6. USE OF GOOGLE API DATA

In Short:  We follow Google's Limited Use requirements for any data we receive from Google APIs — used only to provide Hypatia Teach features, never for advertising, AI training, or human review without your consent.

Hypatia Teach for Google Classroom's use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy (https://developers.google.com/terms/api-services-user-data-policy), including the Limited Use requirements.

Specifically:

·         We do not transfer Google user data to third parties, except as necessary to provide and improve user-facing features of Hypatia Teach, to comply with applicable law, or as part of a merger, acquisition, or sale of assets with notice to users.

·         We do not use Google user data to serve advertisements.

·         We do not use Google user data to train AI/ML models that are not directly required for the user-facing functionality of Hypatia Teach.

·         We do not allow humans to read Google user data, except with the user's affirmative consent for specific support cases, when necessary for security purposes (such as investigating abuse), or when required to comply with applicable law.

The commitments in this Section apply to all student information we process, not only data received from Google APIs.

7. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short:  We keep your information for as long as necessary to fulfill the purposes outlined in this privacy policy unless otherwise required by law.

We keep account information for as long as the account exists. On deletion of an account, we delete the associated account record, including the email address and name, subject to the log-retention and legal-retention provisions below.

Operational and error logs are retained for security, debugging, and fraud-prevention purposes for a maximum of thirty-six (36) months, after which they are removed on a rolling basis. Where an account is deleted, we additionally run an automated process to remove that user's email address from existing logs.

For site-license users of the Google version of Hypatia Create, we do not store the email address in readable form and do not record it in our logs, so no email-scrubbing step is required.

Student information. We retain student information only for as long as necessary to provide the Service to the educational institution. On the institution's written request, or within ninety (90) days following expiry or termination of the institution's agreement, we will delete or return student information in our possession and will provide written certification of deletion on request, excluding data we are required to retain by law and de-identified data that cannot reasonably be re-identified.

We may retain information for longer where required or permitted by law (for example, tax or accounting obligations).

8. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short:  We aim to protect your personal information through a system of organizational and technical security measures.

These measures include: encryption of personal information in transit using TLS 1.2 or higher; storage of the email address for site-license users only as a one-way bcrypt hash; hashing of account passwords; access controls limiting access to personal information to personnel with a business need; use of a reputable cloud infrastructure provider (Amazon Web Services, US region) and network provider (Cloudflare); and logging and monitoring of access to production systems.

However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Website is at your own risk.

9. REVIEWING, CHANGING, AND DELETING ACCOUNT INFORMATION

In Short: At any time, you are free to review or change information in your account or terminate your account through our Website. You can also opt-out of email marketing. There are certain cases where we may retain information on you after opting out or terminating your account.

If you would at any time like to review or change the information in your account or terminate your account, you can:

·         Log in to your account settings and update your user account.

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use and/or comply with applicable legal requirements. Any such retention is subject to the limits described in Section 7 (How long do we keep your information?), including the thirty-six (36) month maximum retention period for operational and error logs.

You can also opt out of email marketing at any time by clicking on the unsubscribe link in the emails that we send or by contacting us using the details provided at the end of this policy. You will then be removed from the marketing email list – however, we may still communicate with you, for example to send you Service-related emails that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes. To otherwise opt-out, you may access your account settings and update your preferences.

10. HOW CAN YOU REVIEW, UPDATE, OR DELETE THE DATA WE COLLECT FROM YOU?

In Short: You can request to review, update, or delete the data we collect from you by contacting us.

Based on the applicable laws of your country, you may have the right to request access to the personal information we collect from you, change that information, or delete it in some circumstances. To request to review, update, or delete your personal information, please contact us using the contact information at the end of this policy. We will respond to your request within 30 days.

11. CONTROLS FOR DO-NOT-TRACK FEATURES

In Short: We do not currently respond to signals from your browser or any other mechanism that automatically communicates your choice not to be tracked online, though we may in the future.

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy policy.

Separately from DNT, where required by applicable law we honour Global Privacy Control (GPC) and similar opt-out preference signals as a request to opt out of the sale or sharing of personal information. As described elsewhere in this policy, we do not sell or share personal information, so no such opt-out is required for our Services.

12. WHAT ARE YOUR PRIVACY RIGHTS?

In Short:  In some regions, such as the European Economic Area, you have rights that allow you greater access to and control over your personal information. You may review, change, or terminate your account at any time.

In some regions (like the European Economic Area), you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; and (iv) if applicable, to data portability. In certain circumstances, you may also have the right to object to the processing of your personal information. To make such a request, please use the contact details provided below. We will consider and act upon any request in accordance with applicable data protection laws.

If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time. Please note however that this will not affect the lawfulness of the processing before its withdrawal, nor will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

If you are resident in the European Economic Area and you believe we are unlawfully processing your personal information, you also have the right to complain to your local data protection supervisory authority. You can find their contact details here: https://www.edpb.europa.eu/about-edpb/about-edpb/members_en.

If you are resident in Switzerland, the contact details for the data protection authorities are available here: https://www.edoeb.admin.ch/edoeb/en/home.html.

If you have questions or comments about your privacy rights, you may email us at privacy@hypatiasys.com.

13. DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short:  If you are a resident of California, you are granted specific rights regarding access to your personal information.

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided at the end of this policy.

If you are under 18 years of age, reside in California, and have a registered account with the Website, you have the right to request removal of unwanted data that you publicly post on the Website. To request removal of such data, please contact us using the contact information provided below, and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Website, but please be aware that the data may not be completely or comprehensively removed from all our systems (e.g. backups, etc.).

Where we process student education records on behalf of an institution, we act as a school official with a legitimate educational interest under 34 C.F.R. § 99.31(a)(1). We rely on the educational institution to provide any parental consent required under COPPA on behalf of parents, consistent with FTC guidance.

We do not use student information to build a commercial profile of a student, for targeted advertising, or to train AI or machine-learning models other than those directly required to deliver user-facing features of the Service to that institution. We do not sell student information.

Parents may request access to, correction of, or deletion of their child's information by contacting their school or district, which will direct the request to us. We will respond to institution-directed requests within thirty (30) days.
