Frazy’s Terms Of Service & Purchase Usage Policy

These Terms Of Service (or “Terms”, “TOS”, “Terms Of Service”, “Terms Of Service & Usage”) govern your access and use to any product (digital art, traditional art, physical product(s), writings, etc.) created or purchased by me. They will describe your and I, the artist’s, rights of use of the art, exceptions, offenses, and reasons for blacklist. If you need assistance reading this, or have any questions, please do not hesitate to contact me!

1. General Terms
Ill behavior and disrespect towards me will not be tolerated and your commission can be canceled. If payment occurs before cancellation, you may have the right to receive a partial refund depending on the reason for cancellation. It will never be less than the amount I, the artist, feel is fair to me.
All digital artwork(s) will be provided via a .PNG format. You are NOT allowed to have the .KRA file of any of my artworks to edit the finished product in any way without my permission.
Please provide references when asking for a commission of your character. If you want a custom character made by me, check my Terms for Custom Characters & Adopts.
When you give the “OK” to start the commission (any agreement between the commissioner and the artist, whether written down through messages/texts, emails, etc.), that is your virtual signature to these terms. If created in a phone call, I may ask that you message me with proper written consent if I feel it is necessary.
If you fail to follow the rules provided I have every right to cancel your commission.

2. Copyright & Usage Policy
When purchasing ANY product of mine (digital art, traditional art, physical product(s), writings, etc.), I, the artist, hold every right to the product/artwork, NOT the commissioner. Therefore, you must follow these terms:
You may:
- Post or share the artwork with proper credits to my name (usernames can be found in my Credits section)
- Use the copyrighted work(s) for personal use
- Claim the rights/ownership of the character(s) in the drawing if they are rightfully yours
- Use the artwork(s) to promote themselves with proper credits to the artist
- Sell the character in the artwork(s) and use the art as an example of the character as long as credit to the artist is shown
You may NOT:
- Post the artwork(s) without proper credit
- Edit the artwork(s) in any way (including but not limited to: filters, changes in colors/lineart of any kind, removing the watermark(s), adding colors/lineart of any kind, etc.) without my written permission
- Reproducing/using the copyrighted work in any way commercially
- Taking credit of the artwork created/not crediting the artist
Being the artist, I have multiple things I am allowed to do with the product(s), such as:
- Promote myself with the artwork wherever I please.
- Publish books with.
- Display where I please.
- Post wherever I want.
- Create videos of/with said commission wherever I want.
If you decide to cancel your commission for any reason, the sketch provided to you will be recycled unless paid for separately, meaning you do not have the rights to said sketch and I am able to use it for another customer, personal work, etc.

3. Pricing & Payment Info
I, the artist, have every right to create/alter the pricing any time during the commission if it is agreed to by the commissioner for compensation for anything such as changes asked for by the commissioner, complexity, multiple variations of the artwork(s), etc.
Quotes from me are a general estimate on what the price of your commission will be. Prices are subject to change depending on a variety of factors. I will always inform the commissioner of a change in price once the sketch is completed and provided. I am willing to explain my pricing to the commissioner at any given time when the price is altered.
I normally accept payment after providing the commissioner with a rough sketch. Alternate pieces, edits, and additions to the original piece must be specified BEFORE the commission is completed. Creating alternate pieces takes significantly more effort depending on the commission, and will cost more. I have the right to deny providing the commissioner with alternate pieces.
If you, the commissioner, are confused about the price, please do not hesitate to ask me any questions. I am usually open to changing the price to fit a commissioner’s budget. Do not be rude about my pricing though. If you do not agree with my pricing, find another artist to take your commission.
If the commission amount is less than 5.00 USD, there will be an additional fee of at least 5% and up to 20%. This is because certain money-transferring applications have set or percentage fees, and if a commission is worth little enough, I won’t receive any money at all, so it will all be a waste!
Payments as of now are only accepted through PayPal in USD (United States Dollar). However, during specials/sales, I may also be open to accepting payments through:
- Gift cards (including but not limited to Steam gift cards, Amazon gift cards, etc)
- Discord Nitro gifts
- Other virtual currencies
Payments must be paid IN FULL before receiving the finished product, but only after the sketch or an agreed Work In Progress. I do accept payment plans for commissions over 100$.
If you want a quote, simply ask instead of agreeing to a commission and canceling after agreement.
If you do not pay when I ask for rightful payment, or when the agreed upon date of payment is not met, I have the right to:
1. Request interest fees depending on commission size, or
2. cancel your commission.
Tips are appreciated, and I do take donations now! I accept them through my PayPal Donation link on my page! ALL donations received go towards my savings for my Service Dog’s training, as well as, vet appointments, food, etc. for my Service Dog and my ferrets! If you would like to donate to a specific animal, you will receive a picture of them as a thank you. ❣️
* When offering the trade of ‘sloppy-toppy’ over USD currency, you must allow I, the artist, to cash this ‘IOU’ whenever I choose.

4. Process
When agreeing to commission me, you agree that you will be available at ALL times of the commission process unless I am informed otherwise beforehand. If I have a question about your commission, you must be available to answer. If I do not hear from you within 24 hours of my question, the commission will be canceled or I will continue with the information given to me.
I am always willing to provide a sketch to the commissioner before finishing the rest of the commission. I normally provide sketches to the commissioner BEFORE requesting payment.
If I make a mistake on your commission that was NOT specified by you, the commissioner or your reference sheet(s) before the completion of the commission, I am under no obligation to fix it. If a mistake is made on my behalf that WAS specified by the commissioner or your reference sheet(s), there will be no extra charge for the fix(es).
NEW IMPORTANT INFO: Reference sheets that are provided must be clear, unshaded, and not covering important details. Please only have one piece you would like me to reference from when it comes to your character design(s). Adding clothing, trinkets, or other extras that are not on your reference sheet may cost more.
Completion time of your commission may vary depending on a number of factors, including (but not limited to) personal life, queue, and unexpected delays such as payment or file/material/holiday/mail issues. I will try my best to inform the commissioner of any delays, but I am not obligated to. I can take as much time as I need to complete your commission. If you have a deadline however, please feel free to let me know about it and I can see what I can do. During holidays/busy queue weeks I may request a rush fee!

5. Customs & Adoptables Policy
When ordering a product whose characters are created by me, all rights to the character belong to ME, the artist, not the commissioner until the commission is completed and paid for. Some customs & adoptable designs have their own special rights that must be abided by as strictly as these Terms.
Your rights to custom designs and adoptable designs are as follows:
- Use the copyrighted work(s) for personal use
- Claim the rights/ownership of the character design
- Use the artwork(s) to promote themselves with proper credits to the artist
- Sell the character in the artwork(s)
Things you may NOT do with the design(s):
- Post the artwork(s) without proper credit
- Taking credit of the artwork created/not crediting the artist
If a customer does not pay the agreed-upon price for the custom/adopt, all rights and designs still belong to me, the artist.

6. NSFW Rules
Being 18 years of age or older is REQUIRED if you purchase a NSFW commission of any kind. If I am suspicious that you are not 18 years of age or older, I may ask for your ID with everything blurred except your age and face, with your username and face next to it. If you are uncomfortable showing your face, we can discuss another way of proof (ex. Peace sign, holding a pencil, etc.)
I have every right to turn down a commission. I am very lenient on NSFW art, however if you request anything on this list of severe “No-No’s”, you can be blacklisted and blocked instantly. (Note: Trigger warning for S/A)
1. Violent rape
2. Child/”cub” exploitation/pornography (no, I do not care if they are a fictional character. It isn’t happening.)
3. Necrophilia
4. Scat pornography
5. Extreme gore pornography (Gore not related to porn doesn’t count.)
Just don’t ask me at all. Do not mention it, do not question my reasoning. I am extremely uncomfortable with it and I will not be tolerating anybody who continuously asks me for it! Mistakes do happen, but if I am continuously asked there will be a huge problem.
However, most kinks/fetishes are perfectly fine with me. I do not kink-shame anybody, so please feel free to ask me if I can draw anything EXCEPT what I listed above. HOWEVER, if you would like to ask if one of your requests falls under these categories, you can ask me.

If a commissioner breaks these Terms Of Service at any point in time, they are at risk for being blacklisted, as well as any stated rights they may have had being revoked completely.
