Limited Hardware Warranty Terms

The following are terms applicable to your hardware  Hardware warranty only.

Duration of Hardware Warranty:

  1. 12 Months unless stipulated otherwise stipulated. Contingent that the original user continues to own or use the product. In the event of discontinuance of product manufacture, meldCX limited hardware warranty support will be discontinued on the Last Date of Support (LDoS) published in the product end of life announcement (End of Life Announcement).
  2. Replacement, Repair or Refund Procedure for Hardware:  meldCX or its service center will use commercially reasonable efforts to ship a replacement part within fourteen (14) working days after receipt of the Return Material Authorization (RMA)  request. Actual delivery times may vary depending on Customer location and parts availability. Unless otherwise specified in the quoted terms all warranty is returned to base (RTB) to meldCX nominated repair center. meldCX or its nominated distributors (Distributors)  are not responsible for the de-installing devices,  packaging of and or transport costs associated with returning the product. meldCX or its nominated Distributors from time to time may offer onsite service contracts, which may include onsite services which can be quoted upon request and subject to availability.

Limited Hardware Warranty

  1. Hardware. meldCX and/or its subsidiary selling the product warrants that commencing from the date of shipment to customer (Customer) (and in case of resale by a meldCX reseller, commencing not more than thirty (30) days after original shipment by meldCX), and continuing for a period of the longer of (a) twelve months (12) months the hardware (Hardware) will be free from defects in material and workmanship under normal use. The date of shipment of a Product by meldCX is set forth on the packaging material in which the Product is shipped. This limited warranty extends only to the original user of the Product. Customer's sole and exclusive remedy and the entire liability of meldCX and its suppliers under this limited warranty will be, at meldCX's or its service center's option, shipment of a replacement part within the warranty period and according to the replacement process described in the warranty card (if any), or if no warranty card, as described on the meldCX Product policies webpage [www.meldcx.com/policies]  or a refund of the purchase price if the Hardware is returned to the party supplying it to Customer, freight and insurance prepaid. meldCX replacement parts used in Hardware replacement may be new or equivalent to new. meldCX's obligations hereunder are conditioned upon the return of affected Hardware in accordance with meldCX's or its service center's then-current RMA procedures.
  2. DOA (Defective on Arrival) - For Distributors or Direct Resellers
  1. Unless otherwise specified on the applicable sales contract, DOA returns must be requested within 14 days of meldCX invoice date.
  2. meldCX  shall be entitled, at its sole discretion, to decide whether DOA product claims are to be replaced with a new product or to be returned for credit based on the original invoice price.
  3. DOA products must be returned with all original packaging and accessories, otherwise, the value of the missing parts or accessory will be deducted from the credit amount.
  1. Restrictions. This limited warranty does not apply if the Hardware (a) has been altered, except by meldCX or its authorized repair representative, original equipment manufacturer, original design manufacturer (b) has not been installed, operated, repaired, or maintained in accordance with instructions supplied by meldCX, including but not limited to operating temperatures, avoiding humidity, moisture and should be maintained at 16C/60F to 27C/80F unless specifically stated in the product specification (c) has been subjected to abnormal physical or electrical stress, abnormal environmental conditions, misuse, negligence, or accident; or (d) is licensed for beta, evaluation, testing or demonstration purposes.
  2. DISCLAIMER OF WARRANTY.

EXCEPT AS SPECIFIED IN THIS LIMITED WARRANTY, ALL EXPRESS OR IMPLIED CONDITIONS, REPRESENTATIONS, AND WARRANTIES INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OR CONDITION OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, SATISFACTORY QUALITY, NON-INTERFERENCE, ACCURACY OF INFORMATIONAL CONTENT, OR ARISING FROM A COURSE OF DEALING, LAW, USAGE, OR TRADE PRACTICE, ARE HEREBY EXCLUDED TO THE EXTENT ALLOWED BY APPLICABLE LAW AND ARE EXPRESSLY DISCLAIMED BY MELDCX, ITS SUPPLIERS AND LICENSORS. TO THE EXTENT AN IMPLIED WARRANTY CANNOT BE EXCLUDED, SUCH WARRANTY IS LIMITED IN DURATION TO THE EXPRESS WARRANTY PERIOD. BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, THE ABOVE LIMITATION MAY NOT APPLY. THESE WARRANTIES GIVE CUSTOMER SPECIFIC LEGAL RIGHTS, AND CUSTOMER MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM JURISDICTION TO JURISDICTION. This disclaimer and exclusion shall apply even if the express warranty set forth above fails of its essential purpose.

  1. Limitations and Exclusions of Liability. In no event will meldCX or its licensors be liable for the following, regardless of the theory of liability or whether arising out of the use or inability to use the Hardware or otherwise, even if a party been advised of the possibility of such damages: (a) indirect, incidental, exemplary, special or consequential damages; (b) loss or corruption of data or interrupted or loss of business; or (c) loss of revenue, profits, goodwill or anticipated sales or savings. All liability of meldCX, its affiliates, officers, directors, employees, agents, suppliers and licensors collectively, to Customer, whether based in warranty, contract, tort (including negligence), or otherwise, shall not exceed the license fees paid by Customer to any approved source for the Hardware that gave rise to the claim. This limitation of liability for Hardware is cumulative and not per incident. Nothing in this limited warranty limits or excludes any liability that cannot be limited or excluded under applicable law.

Return Material Authorizations

  1. To Receive a Return Materials Authorization (RMA) Number:

  2. If you are instructed to return your product under the terms of your warranty and issued an RMA Number, follow these steps:
  1. Important Note - All material returned to meldCX must be accompanied by a Return Material Authorization (RMA) number. This number is necessary so that the factory can ensure proper tracking and handling of returned material.

If you do not have an RMA number, meldCX reserves the right to refuse receipt of returned units.

Support from Operating System(s) meldCX  is not the manufacturer of the software or operating system and does not guarantee that operating systems will be free from errors, either in isolation or in combination with the hardware.

Packaging Requirements

  1. A valid meldCX RMA number must be clearly marked on outside of all returned package.
  2. An approved RMA Request Form must be attached to every shipment as a packing list and the returned goods must match the attached packing list.
  3. Returned products must be packaged properly to avoid any shipping damage. Any damage or loss of returned goods during transportation shall be the sole responsibility of the shipper.
  4. Returned motherboard or main board must include original BIOS, CACHE RAM (module) or VRM. Motherboard or main board with missing parts will be returned to customers as NTF (i.e. no trouble found) with freight collect.
  5. Regular RMA items must not be returned with any shipped accessories. meldCX will not return nor bear responsibility for any accessories shipped along with returned product.
  6. meldCX RMA number is valid for 30 days from the date on which the RMA number is issued.
