Venue hire terms and conditions

  1. This agreement does not create a tenancy.
  2. The Hirer may not sell, transfer, or assign all or any part of its rights under this agreement.
  3. The Hirer may only use the specified Facilities for the specified Purpose.

Representatives

  1. The Hirer must appoint a Representative who will be the only channel of communication between the Hirer and the Club. The Representative must promptly convey any communications between the Club and the Hirer.  If the Club considers that the Hirer’s representative is not facilitating communication in a timely manner it may require the Hirer to appoint another representative in his or her place.
  2. The Hirer may appoint a replacement Representative at any time and must immediately notify the Club of that change. Likewise, the Club may appoint a replacement Club Representative at any time and must immediately notify the Hirer of that change.
  3. The Hirer agrees that a representative of the Club can at any time, after introducing themselves, attend the hirer's event, free, to observe how the Club's Facilities are being used, help solve problems, and receive feedback on the hirer's experience in using the facilities.

Health and Safety

  1. The Hirer uses the Facilities at its own risk and agrees to at all times maintain a health and safety plan in respect of its use of the Premises. The Hirer will adhere to the fire evacuation plan displayed in the Premises and ensure that every person permitted by the Hirer to enter or remain on the Premises is made aware of the evacuation plan.
  2. If the Hire Period exceeds six months the Hirer must carry out a fire drill at least once every six months.

Care of the Premises

  1. The Hirer must take all reasonable steps to ensure that any person permitted by the Hirer to enter or remain on the Premises takes care of the Premises and the Club’s fixtures, fittings, and moveable property.
  2. The Hirer must take all reasonable steps to ensure that any person permitted by the Hirer to enter or remain on the Premises does not interfere with any part of the Premises or Facilities that are not hired to the Hirer under this agreement, including any equipment or other items stored in the Premises by other users of Facilities.
  3. The Hirer shall take all reasonable steps to ensure that any person permitted by the Hirer to enter or remain on the Premises does not bring flammable liquids or fire hazards onto the premises or do anything that might cause the Club’s insurance to be rendered void or cause the Club's insurance premiums to increase.
  4. The Hirer’s representative must immediately advise the Club’s representative of any fire in the Premises, damage to the Premises Facilities, or any property of other users, or damage to or failure of any equipment in the Premises.

Use of the Facilities

  1. The whole of the Premises is a non-smoking or vaping area and the Hirer must ensure that any person permitted by the Hirer to enter or remain on the Premises does not smoke or vape in the Premises or in the immediate vicinity of the Premises.
  2. The Hirer may only serve alcoholic drinks on the Premises if it has fully complied with the provisions of the Sale and Supply of Liquor Act 2012 and obtained all necessary licences and permits.
  3. The Hirer must take all reasonable steps to ensure that any person permitted by the Hirer to enter or remain on the Premises does not make noise, conduct themselves, or behave in the Premises or in the vicinity of the Premises in a manner that unreasonably interferes with the right of the occupants in neighbouring buildings to the quiet enjoyment of their premises.
  4. The Club will provide the Hirer with a front door key, and if the library is hired a key to the library, for which Hirer will pay a $40 deposit.  The deposit will be refundable when the key is returned at the end of the Hire Period.
  5. The Hirer may during the Hire Period allow any person permitted by the Hirer to enter or remain on the Premises to use the two parking spaces outside the Premises while they are at the Premises after 6pm on weekdays or during the weekend.  Any vehicle parked in these spaces between 8am and 6pm on weekdays may be towed away at the vehicle owner’s expense.
  6. Whenever the Hirer vacates the Premises at the end of the Hire Period, or at the end of a session within the Hire Period, the Hirer shall ensure that:

Liability

  1. The Hirer shall pay the Club the cost of repairing any damage to the Premises, or repairing or replacing any damaged property of the Club, where the damage is caused by, or arising from, any wilful or negligent act or omission of the Hirer or any person permitted by the Hirer to enter or remain on the Club’s premises.
  2. The Hirer indemnifies the Club in respect of any claim arising from any damage to the property of any other user of Facilities caused by or arising from any wilful or negligent act or omission of the Hirer or any person permitted by the Hirer to enter or remain on the Club’s premises.
  3. The Hirer indemnifies the Club in respect of any liability for any injury to any person or damage to or loss of any property that occurs in the Premises during the Hire Period.  The Hirer should arrange its own insurance in respect of any property brought into or stored in the Premises.

Termination

  1. If in the reasonable opinion of the Club the Hirer has committed a serious breach of this agreement the Club may terminate this agreement forthwith by serving on the Hirer’s Representative notice by email to that effect.
  2. Subject to clause 21 either party may terminate this agreement by giving one week’s notice by email to the other party’s Representative.
