The Frederick City Market 2025 Rules and Regulations

  1. Eligibility Requirements

  1. The Frederick City Market is a local-friendly market. Meaning that any fruits, vegetables, plants, herbs, flowers, baked goods, prepared beverages, jellies, jams, honey, prepared foods, handicrafts and/or other products sold at The Frederick City Market must be grown, produced, or made in the state of Maryland. Any product not produced by the vendor must be pre-approved by the Market Managers and clearly marked with its origin. Exceptions may be made for vendors selling products that cannot be made in Maryland (such as olive oil).

  1. All Vendors must carry insurance for general liability and property damage, as well as product liability coverage, in an amount not less than $1,000,000 per occurrence with a $2,000,000 aggregate limit (required by our insurance company). The policy shall name The Frederick City Market and other entities, if determined to be necessary, as added insured’s, and shall maintain all other coverage as required by law. A copy of the Certificate of Insurance must be provided with the Application to The Frederick City Market. If insurance expires mid market season, the farmer or producer must provide The Frederick City Market with a copy of the renewed insurance policy at the time of the policy expiration.
  1. If you are a Meat Processor, all the farmers/growers for whom you process foods that will be sold at The Frederick City Market must carry insurance for general liability and product liability of not less than $1,000,000. If you as the Meat Processor are providing insurance coverage for these farmers/growers, a copy of the policy naming those farmers/growers must be provided with your application as proof of insurance coverage.

  1. General Rules

  1. Definition of a Vendor: A person who has completed an application, agreed to the market guidelines, been accepted for participation in The Frederick City Market, and pays vendor fees, submits proof of insurance via email (info@frederick city market.com) text a photo to 240-291-8254 or sends a hard copy to Rachel Gagne-10707 Easterday Rd, Myersville, Md 21773. You MUST email the market (info@frederickcitymarket.com) that you have read the rules and regulations for . Use the subject line “Read Rules and Regs”. It is important that you send the email from the account you wish to have included on our weekly vendor email list. We will send you a response via that email to confirm that you are receiving emails from us. Please add this email address to your contacts list.

  1. Permitted Items for Sale: Vendors may only sell items listed in their vendor application. Additional items may be added during the season with prior permission from the Market Managers. A no-cost permit via Maryland Department of Agriculture is required to sell eggs.

  2. Items brought to market not previously approved by managers will result in a written warning for first infraction. A second infraction after the warning will result in the vendor being removed from the market for the remainder season with no refund of vendor fees.

  1. The Market Managers reserve the right to be provided a tour of the vendor farm/facility given 48 hours advanced notice to the vendor.

  1. Adhering to Market hours: Market hours are 9:00am-1:00pm. Vendors must be fully set up by 8:55 am. You must arrive by 8:45 am with your items on site at that time. Vendors may not leave prior to 1:00 pm without permission from the Market Managers.

  1. Clear signage. Vendors shall post clear, legible, and visible signs with the following information:
  1. Farm or business name & location
  2. Product names & prices
  3. Origin of agricultural products not produced by vendor
  1. Maintaining Market Eligibility:

  1. Comply with sanitary rules and regulations – All vendors must comply with rules and regulations of the Frederick County Health Department. Vendors shall apply directly to the Frederick County Health Department for any necessary permits. Vendors shall be responsible for submitting a copy of the appropriate permits with their market application. Vendors required to have licenses must post them on market days. It is up to you to make sure that you are in compliance with the Frederick County Health Dept and /or any other licensing and permitting entities. There will be NO REFUNDS of deposit monies or vendor fees , if you are found in non-compliance and shut down by the county or the state.

  1. Regular Participation in Market – The Frederick City Market will be in operation May 4th – November 23rd, every Sunday. The Market hours of operation will be from 9:00am-1:00pm. Please contact the Market Managers if you are not able to attend the market on any given day. We will be advertising for the coming Market weekend. We want our customers to know about any new products or specials you are offering. Notice of whether or not you will be participating is required by Thursday for the coming Sunday’s Market. If there are extenuating circumstances that do not allow you to attend, please let the Market Managers know you will not be able to make it as soon as possible.

  1. Any notifications made after Thursday of non-participation for that upcoming Sunday will incur a $15.00 fee that will be taken out of the $50.00 deposit. This fee will be assessed whether you are a full time vendor and have paid for the season, or a part time vendor paying by the week.

Vendors are also encouraged to let the Market Managers know about any new products or information regarding their products they would like advertised.

Repeated absences without notice may result in suspension or expulsion from the Farmers Market.

  1. Vendors must come with appropriate equipment – Vendors are responsible for providing canopies, tables, and weights with which to secure their canopies. Vendors with canopies MUST have weights available at market. Suggested weight per leg of canopy is 25 lb, but vendors must have at minimum 15lb of weight per leg of canopy.
  2. Vendor Space – Vendors need to provide their own tables/tents/shade structures. Vendors are not guaranteed the same exact space for every market; however, we will try to be as consistent as possible. Vendors are expected to arrive at market at a consistent time to maintain their usual space.

  1. Pay Vendor fees and deposit – The 2025 season runs from May 4th to November 23rd. To secure a space at the 2025 market, vendors must pay vendor fees. In addition to vendor fees, the vendor must submit a $50 refundable deposit.  It will be returned to you at the end of the season unless you are a no-show at market (no calls/no texts to let managers know you won’t make it). Each no-show (and no notice given) will incur a $25 fee. After two no-shows you will not be allowed to attend the market for the remainder of the season (no refunds of paid market fees). There are two options for payments:

  1. Option 1: Pay a discounted rate of $200 for one 10x10 for the entire 2025 season within one week of approval as a vendor for the 2025 season. Payment should be received by April 1. Each additional 10x10 space will be $25 for the entire season if paid in advance (Please include your $50 deposit).

  1. Option 2: Pay $250 for one 10x10 for the entire 2025 season by Opening Day (or within one week of approval as a vendor for the 2025 season). Each additional 10x10 space will be $25 for the entire season if paid at the same time (Please include your $50 deposit).

  1. Option 3: Pay $15 per week for each 10x10 space on the day of market that you are attending. Please submit your $50 deposit with your insurance paperwork.

  1. Vendors will not be reimbursed for missed market days.

  1. Clean up – Vendors shall be responsible for post-market clean-up of their space. The space should be left as it was found with neither litter nor organic trash left behind.

  1. Display Appropriate Conduct –Treat other market Vendors, customers and Market staff with respect.

  1. No Smoking Within 50 feet of the Market.

  1. No pets allowed at market with vendors.

  1. The Market Managers decision on these rules and all other matters concerning the Market is final.

  1. Violations

  1. Any complaints against a Vendor are the responsibility of the Market Managers.

  1. The Market Managers reserve the right to cancel the approval of any vendor’s application at any time, for any reason.

  1. Hold Harmless Clause and Insurance

  1. All authorized vendors participating in the Farmers Market shall be individually and severally responsible to The Frederick City Market for any loss, personal injury, deaths, and/or any other damage that may occur as a result of the vendors’ negligence or that of cost, damages and other expenses, including attorney’s fees, suffered or incurred by The Frederick City Market by reason of the vendor’s negligence or that of its servants, agents and employees; provided that the vendors shall not be responsible nor required to indemnify The Frederick City Market for negligence of The Frederick City Market, its servants, agents or employees. All producers shall be required to carry liability insurance in an amount of no less than $1,000,000 per occurrence/ $2,000,000 aggregate -  attach a certificate of insurance along with the market application.

  1. Modifications

  1. The Market Managers reserve the right to revise the guidelines at any time as deemed appropriate. Vendors will be notified, in writing, of any changes to the guidelines.

  1. Additional Requests from your Market Managers

  1. If cars on lot when you arrive (after 7 am) - First vendor on the lot Sundays will need to contact the Frederick City Police Non-Emergency Line (301)-600-2102 with the color, make/model, and license plate number of the car(s) to begin the lot clearing process. If you are uncomfortable doing this, please contact Rachel or Kelsi with this information so they can make the call
  2. When submitting your application, please include at least four (4) photos of you and your product(s)/location for use with social media as well as a short 2-4 sentence blurb about your business/photos. Please make sharing your business on our large and growing social media pages easier! Without these, we will not be able to share information about you to our followers.   1. Once the market season has started, please tag us on some of your social media posts to expand your reach. IG and facebook - @thefrederickcitymarket
                           
  2. Each week we send an informational email to EVERY approved VENDOR, regardless if you are attending the upcoming Sunday or not. This gives part time vendors that may wish to attend a heads up about any open spaces we may have for the upcoming Sunday. Also included is a map layout for the upcoming market SO THAT YOU KNOW WHERE YOU SHOULD BE SETTING UP. Please take a minute to glance through the email each week and consider saving the map on your phone for reference if you are attending that week (anticipated major changes to map will be sent via email).THANK YOU for being prepared!
