The following procedures are to be followed by the school:

  1. All new non-teacher employees and new contractors to the school will be vetted by Police through the Police Licensing & Vetting Service. The Authorisation to Disclosure form (Appendix 1) must be signed by the staff member and kept on their personal file.
  2. The Principal will check the Police Vet, and keep its content confidential. If there is a concern the principal will discuss with the BOT chair.
  3. The Board will only take adverse action in relation to a person who is the subject of a Police vet once:
  1. The person has validated the information contained in the vet.
  2. The person had been given a reasonable opportunity to validate the information, but has failed to do so within a reasonable period.

        

        Before any action is taken the matter will be discussed with a NSTA personnel/industrial relations adviser.  While the result of a vet is being considered by the Board it will be kept locked in office file.

        The person will be given a chance to challenge the accuracy of information provided to the school by the Police.  Disputes will be resolved between the person concerned and the Police.

        Until the Board receives a correction from the Police it will assume that the information received is correct.

  1. If the vet does not reveal any criminal offences or concerns by the Police or if after considering the nature of an individual’s criminal record the Board decides that it has no concerns the vet will be handed to the employee/contractor or destroyed with their agreement.  A note will be made on the individual’s personnel file that a Police vet was undertaken and was satisfactory.
  2. Employees dealing with incoming mail will be instructed and regularly reminded that a letter marked as “Confidential” should only be opened by the person it is addressed to.

6.        School application forms, letters offering employment and all contracts let by the school will contain the statement that the appointment will be subject to satisfactory Police vet and have appropriate questions on matters relating to previous convictions.

Screening Criteria

For positions that require substantial direct contact with children, personal safety concerns are paramount.  Therefore, the focal points of criminal history record checks for these positions are crimes against persons.

Offences become relevant based upon the nature of the position held at the school.

Individuals will be disqualified for holding positions that require substantial contact with children if their criminal records include any of the following:

Individuals will be disqualified from holding positions that require substantial handling of money if their criminal records include convictions relating to fraud.

Individuals will be disqualified from holding positions if their criminal convictions include convictions for serious drug offences, including dealing.

If an individual has been arrested for any of the above offences and is awaiting trial, that individual will be disqualified for appointment until the full disposition of the charge.
