PLATFORM RULES

These Platform Rules ("Rules") govern all participation in competitions, predictions, and contests hosted on the MariNation platform at marination.app (the "Platform"), operated by MariNation Global Inc, a Delaware c-corp company. These Rules are incorporated into and form part of the MariNation Terms of Use. Capitalized terms not defined herein have the meanings given in the Terms of Use.

By participating in any competition on the Platform, you agree to be bound by these Rules. MariNation reserves the right to amend these Rules at any time. It is your responsibility to review these Rules regularly.

1. The MariNation Skill-Based Model

MariNation is a skill-based music prediction competition platform. Success on MariNation depends predominantly on a user's knowledge, research, expertise, and informed judgment about the music industry. The Platform is designed to reward users who demonstrate superior music industry knowledge, analytical ability, and strategic thinking.

Competitions on MariNation require participants to predict outcomes related to the music industry, including but not limited to:

• Chart performance of songs, albums, and artists across major platforms including Billboard, Spotify, Apple Music, and others
• Streaming milestone achievements by artists or recordings
• Award show nominations and outcomes including Grammy Awards, BET Awards, MTV VMAs, and others
• Album and single release dates and commercial performance
• Artist collaboration announcements and outcomes
• Music video performance metrics
• Social media milestone achievements by artists
• Tour and concert announcements and attendance figures

All prediction categories are based on publicly verifiable data from official and recognized industry sources. MariNation does not create or control the underlying music industry events that determine competition outcomes.

2. Eligibility to Participate

To participate in paid competitions on the Platform, you must meet all eligibility requirements set forth in the Terms of Use, including:

• Be at least eighteen (18) years of age
• Be physically located in a jurisdiction where skill-based competition for prizes is permitted
• Not be physically located in a restricted state as listed in the Terms of Use
• Have a verified MariNation account in good standing
• Have sufficient account balance to cover any applicable entry fees

Free-to-play competitions may have different eligibility requirements as specified within each individual contest. MariNation reserves the right to verify eligibility at any time and to disqualify any participant who does not meet eligibility requirements.

3. How Competitions Work

3.1 Entry

Competitions are entered through the Platform. Each competition will clearly display the following information prior to entry:

• Entry fee (if any)
• Prize pool and prize structure
• Number of participants allowed
• Prediction categories and questions
• Contest duration and prediction deadline
• Scoring methodology
• Tiebreaker rules

Once a competition has begun and the prediction deadline has passed, entries are final and cannot be modified. Entry fees are non-refundable except as expressly stated in these Rules or required by applicable law.

3.2 Making Predictions

Participants submit predictions through the Platform interface before the stated deadline for each competition. Predictions submitted after the deadline will not be accepted. It is your responsibility to ensure your predictions are submitted correctly and on time. MariNation is not responsible for predictions that fail to submit due to user error, connectivity issues, or device failure.

3.3 Scoring

Each competition uses a defined scoring system that is displayed within the competition details prior to entry. Scoring is based entirely on the accuracy of predictions measured against official, verifiable music industry data from recognized sources. The scoring methodology may vary by competition type and will always be disclosed in advance. Higher scores reflect greater prediction accuracy and thus greater demonstrated skill.

3.4 Results and Verification

Competition results are determined based on official data from recognized industry sources including but not limited to Billboard, Spotify for Artists, Apple Music, Recording Industry Association of America (RIAA), and official award show announcements. MariNation reserves the right to use alternative verified sources where primary sources are unavailable or disputed. Results are final once officially verified and posted on the Platform.

3.5 Tiebreakers

In the event of a tied score between two or more participants, tiebreakers will be applied in the order specified within each competition's rules. Common tiebreaker methods include:

• Closest numerical prediction to the actual outcome
• Earliest submission timestamp
• Secondary prediction accuracy on a designated tiebreaker question

If a tie cannot be resolved through the stated tiebreaker methodology, the prize will be divided equally among tied participants.

4. Prizes

4.1 Prize Structure

Prize structures vary by competition and are clearly displayed before entry. MariNation offers the following competition formats:

• Head-to-Head: Two participants compete directly, winner takes the prize pool minus platform fees
• Multi-Entry Tournaments: Multiple participants compete, prizes distributed to top finishers per the stated prize table
• Leaderboard Competitions: Participants accumulate points over a defined period, prizes awarded to top performers on the leaderboard
• Free-to-Play: No entry fee required, prizes may include platform credits, merchandise, or cash prizes as specified

4.2 Platform Fees

MariNation charges a platform fee on paid competitions. The applicable platform fee percentage is clearly disclosed within each competition prior to entry. Platform fees are deducted from the prize pool or entry fees as specified. MariNation reserves the right to modify platform fee structures with reasonable notice to users.

4.3 Prize Distribution

Prizes are credited to your MariNation account balance following official verification of competition results. Prize distribution timelines vary by competition type and are posted within each competition. Prizes are subject to identity verification and compliance review before withdrawal. MariNation reserves the right to withhold prize distribution pending investigation of any suspected Rules violation.

4.4 Unclaimed Prizes

Prizes not claimed or withdrawn within one hundred eighty (180) days of being credited to your account may be forfeited at MariNation's sole discretion. MariNation will make reasonable efforts to notify users of unclaimed prizes before forfeiture.

5. Competition Cancellation and Refunds

MariNation reserves the right to cancel, postpone, or modify any competition at any time. In the event of a cancellation before the prediction deadline, all entry fees will be refunded to participants' account balances. In the event of a cancellation after the prediction deadline, MariNation will determine the appropriate remedy, which may include a full or partial refund or awarding prizes based on results available at the time of cancellation, at MariNation's sole discretion.

Competitions may be cancelled or voided where:

• Fewer than the minimum required number of participants enter
• A technical error materially affects the integrity of the competition
• The underlying event or data source becomes unavailable or unreliable
• Regulatory or legal requirements necessitate cancellation

6. Fair Play and Prohibited Conduct

6.1 Prohibited Conduct

The integrity of MariNation competitions depends on all participants competing fairly. The following conduct is strictly prohibited and may result in immediate disqualification, account suspension, forfeiture of prizes and balances, and permanent ban from the Platform:

• Using bots, scripts, automated tools, or artificial intelligence systems to generate, submit, or optimize predictions
• Colluding with other users to manipulate competition outcomes, including coordinating predictions to split prizes
• Using material non-public information obtained through employment, contractual relationships, or insider access in the music industry to gain an unfair competitive advantage
• Creating or using multiple accounts to enter the same competition more than once
• Sharing account credentials with another person for the purpose of gaining a competitive advantage
• Exploiting bugs, glitches, or technical errors in the Platform
• Manipulating the Platform's systems in any way not expressly authorized by MariNation
• Engaging in any form of fraud, misrepresentation, or deception in connection with competition entry or prize claims

6.2 Insider Information Policy

MariNation is committed to a level playing field. Users who have access to material non-public information about music industry events through professional relationships, employment, or other means are prohibited from using such information in competitions. This includes but is not limited to unreleased chart data, advance knowledge of award nominations, unannounced release dates, and confidential label or artist information. MariNation reserves the right to investigate and disqualify any participant reasonably suspected of using insider information.

6.3 Investigations and Enforcement

MariNation monitors competition activity for patterns indicative of prohibited conduct. Where MariNation has reasonable grounds to suspect a violation of these Rules:

1. MariNation may place a hold on the relevant account and any associated prizes pending investigation
2. MariNation may request information from the user to assist in the investigation
3. MariNation will make a determination based on available evidence
4. If a violation is confirmed, MariNation will take appropriate enforcement action including disqualification, prize forfeiture, and account termination
5. MariNation's decisions regarding Rules violations are final and binding

7. Data Sources and Dispute Resolution

7.1 Official Data Sources

MariNation uses official and widely recognized data sources to determine competition outcomes. These sources are identified within each competition. Where a primary data source is unavailable, delayed, or produces anomalous results, MariNation reserves the right to use an alternative recognized source or to delay result determination until reliable data is available.

7.2 Result Disputes

If you believe a competition result has been determined incorrectly, you may submit a dispute within forty-eight (48) hours of the result being posted on the Platform by contacting info@marinationmusic.com with the subject line "Result Dispute" and including the competition ID, the specific result you are disputing, and supporting evidence. MariNation will review all disputes and issue a final determination within ten (10) business days. MariNation's determination on result disputes is final and binding.

8. Account Conduct

All users are expected to conduct themselves with respect and integrity on the Platform. The following conduct is prohibited in any public-facing feature of the Platform including chat, forums, or community features:

• Harassment, abuse, or threatening behavior toward other users or MariNation staff
• Use of offensive, discriminatory, or hateful language
• Spamming or posting irrelevant or repetitive content
• Sharing personal information of other users without their consent
• Impersonating other users, MariNation staff, or public figures

MariNation reserves the right to remove any content and take action against any account that violates these conduct standards, up to and including permanent termination.

9. Responsible Play

MariNation encourages all participants to engage with the Platform responsibly. We recommend that you:

• Set personal limits on the amount you deposit and spend on the Platform
• Only participate with funds you can afford to lose
• Take regular breaks from competition activity
• Monitor your participation patterns and seek help if you feel your participation is becoming problematic

MariNation provides responsible play tools including deposit limits, competition entry limits, and self-exclusion options. To access these tools or to request self-exclusion, visit your account settings or contact us at info@marinationmusic.com. Self-exclusion requests will be processed within twenty-four (24) hours of receipt.

10. Amendments to These Rules

MariNation reserves the right to amend these Rules at any time. Material changes will be communicated to users via email or prominent notice on the Platform. Your continued participation in competitions following notice of any amendment constitutes your acceptance of the revised Rules. It is your responsibility to review these Rules regularly.
