DIGITAL TIPPING PROGRAM POLICY

The Shiny Solutions Services provide functionality (the “Tipping Platform”) that allows guests (“Guests”) of participating properties (each, a “Property”) to direct the payment of tips to eligible property staff (each, a “Team Member”).
The Tipping Platform provides an application functionality that enables Guests to direct a tip payment amount using a debit card, credit card, or ACH information.
For a Team Member to be eligible, in addition to meeting the required eligibility criteria established by the Property, the Property must register each participating Team Member for the Tipping Platform using a valid mobile phone number. The Property determines whether a Team Member will receive tips via their regular payroll or via ACH payment.
For tip allocations that are not included in a Team Member regular payroll, in order to receive tip allocations from Guests or the Property following such registration, each Team Member must provide bank or paycard ACH information and ID verification. ACH is the only payment method available for tip disbursement.
To direct their tip, a Guest must specify the service they received at the Property, and optionally, depending on the specific Tipping Platform configuration selected by the Property, one or more of the following items: the Team Member’s name, the room the Guest stayed in, and/or the day and time of the service.
Amounts not timely claimed within 30 days by the Team Member(s) to whom a tip has been directed by a Guest, and any amounts directed by a Guest to a Team Member who has not provided valid electronic means for the receipt of payment, may at the Property’s election and direction be pooled and shared among Team Members or otherwise handled in accordance with the policy of the participating Property and applicable law. Compliance with all federal or state wage and hour, tax, employment or other laws applicable to tips or other payments made using the Tipping Platform, including without limitation any obligations under the federal Fair Labor Standards Act, is the exclusive responsibility of the Property in its capacity as employer or contractor of the relevant personnel, as provided under the applicable agreement between Shiny Solutions and the Property.
Payment processing services are provided by Shiny Solutions’ third-party payment processing partner, Stripe.
