CONSIGNMENT AGREEMENT

This Consignment Agreement (“Agreement”) is between Star Coin & Currency, LLC (the “Auctioneer”) and the undersigned consignor (“Consignor”).

1. Commission & Fees. Consignor authorizes Auctioneer to offer the consigned items for sale by online auction. Auctioneer’s consignment fee is 10% of the hammer price per lot sold, subject to a $3 minimum fee per lot deducted from sale proceeds. Occasionally we may have special discount offers. Any discount is off the hammer price only.
   
2. No Reserve; Terms & Conditions. All lots will be sold without reserve to the highest bidder, regardless of price, and no selling price is guaranteed. Consignor acknowledges and agrees that the Terms & Conditions posted on Auctioneer’s website are incorporated into this Agreement by reference.
   
3. Non-Payment, Returns, and Chargebacks. If the auctioneer does not receive good funds from the buyer, the sale is void and the item(s) may be reoffered in a subsequent auction. If a buyer return or chargeback occurs after Consignor has been paid, Consignor agrees to promptly refund Auctioneer the net proceeds previously remitted for the affected lot(s).
   
4. Payment to Consignor. Payment to Consignor will be made within 30 days after Auctioneer receives and clears buyer payment. In practice, auctioneer typically pays within one (1) week after the auction ends, subject to cleared funds.
   
5. Risk of Loss; Insurance. The auctioneer is not responsible for fire, theft, loss, or damage to consigned items. Consignors are strongly encouraged to maintain insurance coverage on the items until delivery is accepted by the buyer.
   
6. Lotting & Grouping. Auctioneer may lot, re-lot, separate items, repackage or group items in lots at Auctioneer’s sole discretion. Any grades, estimates or descriptions expressed by us is solely an opinion and not a guarantee of grade, value or selling price.
   
7. Title; Authority; Indemnity. Consignor represents and warrants that they own and have good, marketable title to all consigned items and the authority to sell them free of all liens, claims, or encumbrances. Consignor agrees to defend, indemnify, and hold harmless Auctioneer and its employees/agents from any claim, loss, or liability arising out of title defects, misdescription provided by Consignor, or Consignor’s breach of this Agreement.
   
8. Technical Issues; Limitation of Liability. Consignor understands that online auctions may be affected by technical, server, or internet interruptions that could impact bidding or selling price. The auctioneer will not be liable for consequential or incidental damages arising from such issues.
   
9. Photography and Marketing. Consignor grants Auctioneer a non-exclusive license to photograph and describe the items and to use such images, video, and descriptions for cataloging, marketing, and promotional purposes, including social media and archives.
   
10. Shipping Instructions.
      • Pack securely so no rattling is heard when handled.
     • Use heavy tape on all seams, edges, and corners; double-boxing is recommended.
     • Include a printed copy of this completed form inside the box.
     • Ship to: Jim Haver, P.O. Box 1234, Union Lake, MI 48387
       (For security, do not write “Star Coin & Currency” on the shipping label.)
      • Always use signature confirmation and appropriate insurance.
    
11. Entire Agreement; Amendments. This Agreement, together with the incorporated website Terms & Conditions, constitutes the entire agreement between the parties regarding the consignment. Any amendment must be in writing and signed by both parties.
    
12. Governing Law & Venue. This Agreement is governed by the laws of the State of Michigan, without regard to conflicts of law. Venue for any court action permitted under this Agreement shall lie in the state or federal courts located in Michigan.
    
13. Dispute Resolution (Mediation/Arbitration).
    Any dispute arising under this Agreement shall first be submitted to mediation. If unresolved, the dispute shall be settled by binding arbitration administered by the American Arbitration Association in Oakland County, Michigan. Each party shall bear its own legal fees, and arbitration costs shall be shared unless otherwise awarded by the arbitrator.
