Analysis - Stephan  A Rossi’s Conduct

 I am setting this up for a complete rewrite (24 Jun 18)


This is what Stephen A Rossi [1] knew.

Rossi works for the Milstein Group. In early 1990, the Milstein group took over for Douglas-Elliman; ~ two months after November 1989 the steam pipe explosion which rocked the Koenig family’s apartment - # 17C.

Rosi’s arrival and Milstein’s replacing Douglas-Elliman was precipitated by the arrest and indictment (and subsequent criminal conviction) of the two senior Douglas-Elliman executives who were charged with the 55 Liberty Owners Corp account.

In the very beginning, Stephen A Rossi deceptively signed as if he was a new management executive, appointed in due course, at Douglas Elliman: thus disguising the true facts underlying the turmoil.  We know this from Rossi’s May 29 1990 letterhead and signature-block.

When criminal Rossi first wrote me on May 29 1990 [Exhibit “ _”] Rossi knew that:

Criminal Rossi was completely silent as to the orderly segue that should have accompanied Kessler’s, Oelberger’s,and Gottsegen’s departure.


nb:  Milstein, having just acquired the Douglas-Elliman management operation under extreme duress:

Stephen A Rossi’s immediate predecessors, Daniel Kessler [RIP] and Jack Oelberger,  
were arrested and subsequently found guilty and jailed for
pay-to-play fraud.

Douglas Elliman supplied Rossi with the paperwork up to the point of Douglas-Elliman’s forced sale to the Milstein Group (due to its own criminal pay-to-play fraud).

As is public knowledge, Stephen A Rossi’s immediate predecessors, Daniel P Kessler [5]  and Richard "Jack" A Oelberger  [6],  were arrested and subsequently found guilty and jailed for pay-to-play fraud.

Criminal Rossi knew that 55 Liberty Street superintendent Robert J Phillips was the gatekeeper for Kessler’s and Oelberger’s  pay-to-play scheme which charged building contractors to do business at 55 Liberty Street.  Robert J Phillips had reported directly to Paul Gottsegen, Kessler and Oelberger; and then directly to Rossi.

Now: why don’t  we get down to short strokes on Rossi’s criminality.

Stephan A Rossi knew, as did all of 55 Liberty Street’s Lawyers:

that a cooperative apartment shareholder at 55 Liberty Street in NYC had the duty to repair and bear the costs of repair for any and all damage to the leasehold regardless of the source or origin of water damage or responsibility.


Criminal Rossi knew, fully understood, and failed to communicate in an actionable manner that it was duty of all tenants in all cooperative apartments to restore all damage to their leaseholds: without particular regard to cause or responsible party.

Criminal Rossi knew, fully understood, and failed to communicate in an actionable manner that records (of which he was the only substantive and knowledgeable custodian) conclusively depicted in an actionable manner that the entire bespoke interior of 55 Liberty Street # 17c was owned by its tenant (the Koenig family) - the fixtures having been 100% installed by the predecessor tenants Burt Sanoff and Lombardi, and not by sponsor Globus.

Ownership of fixtures in cooperative apartments being more a matter of common law than statute or contract:

as criminal Rossi was uniquely in possession of the very records that determined ownership - Rossi had a fiduciary duty to unwind the facts of the matter so as to enable an orderly 2nd/3rd party insurance settlement.

Criminal Rossi knew that 55 Liberty Owners Corp was running naked and without insurance coverage for the absolutely certain claim that subrogors Koenig family subrogee United Services Automobile Association would submit to Greater New York Mutual Insurance Company (NAIC 22187) Policy # 1131M75921-S.

I believe that criminal Rossi conspired with attorneys Phyllis Weisberg and Saurborn to commit fraud upon the court as to the elements of the matter: and that one of those:

purposefully served papers on the Koenig family attorney [Barry Yellen] at an address that he knew was no longer viable.

Henry L Saurborn Jr Esq knew the constructively correct address for Barry J Yellen [41]  and purposefully avoided using it or supplying a copy to that new address.  Sauer born wished to frustrate a proper solution.

Criminal Rossi and now disbarred Michael Seth Feuer Esq and Henry L Saurborn Jr Esq knew that the canonical solution was for the Koenig family to repair all damage to the leasehold and to obtain costs from their insurer.

Criminal Rossi knew that the attorney he selected [Michael Seth Feuer Esq  [42]] was riddled with criminal tendencies [redacted .  .  .  ].

Criminal Rossi knew, fully understood, and failed to communicate that 55 Liberty Owners Corporation had evaded the industry standard duty to send 55 Liberty Owners Corporation’s own adjuster to prepare or participate in the preparation of a 2nd/3rd party adjustment.  Had 55 Liberty Owners Corp and its insurer [Greater New York Mutual Insurance Company NAIC 22187 Policy # 1131M75921-S] prepared the industry standard 2nd/3rd party adjustment report - it would have presented along the lines of this armature - below:

Criminal Rossi had complete scienter (as I had told him and supplied him with full documentation) that in addition to a complete and full understanding of our unbridled obligation to restore under the terms of the proprietary lease that “we were full insured”:

Criminal Rossi knew that on June 23rd 1989, our insurance syndicate USAA’s adjuster had visited 55 Liberty Street # 17 C and had photographed the almost violent concave cupping of the red oak flooring, the upheaval of the finished floor and subfloor, and the floor in quiescent North East corner of the living room.  Rossi knew that on June 23 1989, there was absolutely no surface damage to the section of floor [blue arrow] that perjurer Robert J Phillips would later describe as having been intentionally damaged and removed.

Criminal Rossi knew from the repair records of the cooperative corporation that even prior to our assuming occupancy in December 1986, that there had been regular repeated explosions and shearing of the high-pressure Con-Ed steam pipe in the Southwest Corner of the living room.

Criminal Rossi knew from the organic and institutional repair records of the cooperative corporation that the coop’s contract plumber had repaired an  exploded steam pipe in December 1986 - two days before my family assumed occupancy.  Criminal Rossi knew that it had never been explained to us why in December 1986 the wall was open and the steam pipes exposed on the very day we moved in.  Rossi knew all along that it was all very hush hush.

Criminal Stephan A Rossi knew that the building contract professional engineer, Abraham Joselow, had carefully and assiduously reported on January 15 1988 [complete letter in Exhibit “_”] as to the design flaws and engineering defect that was leading to the continuous and systematic steam pipe explosions behind the walls of 55 Liberty Street  17C:

Criminal Rossi, from from the coop corporate records and most notably the minutes of the 55 Liberty Street Board of Directors, knew that the building’s contract professional engineer had suggested that building superintendent Robert J Phillips must install this particular fixture:

Series 100 Stainless Steel Flexonic Hose

Criminal Rossi knew that building superintendent Robert J Phillips had been directed to install the a Series 100 Stainless Steel Flexonic Hose behind the wall of 55 Liberty  Street # 17C in December 1986 and then in November 1989.

Criminal Rossi knew that 55 Liberty building superintendent Robert J Phillips thought most instructions were precatary guidance: and that building superintendent Robert J Phillips lived in a self-referential world of delusion and grandeur - not entirely unlike President Donald Trump.

Criminal Rossi knew that building superintendent Robert J Phillips had conspicuously and contumaciously refused to install the a Series 100 Stainless Steel Flexonic Hose believing in his demented alcohol-ridden mind that it was unnecessary.

Criminal Rossi knew that the responsibility to be there whenever a steam pipe fractured and was being repaired fell to the building superintendent Robert J Phillips.

Criminal Rossi knew that building superintendent Robert J Phillips had installed absolutely no Series 100 Stainless Steel Flexonic Hoses at the sites of any steampipe fractures at 55 Liberty.

When the Douglas-Elliman 55 Liberty Street contract plumber arrived at # 17C on November 19 1989 to repair the steam pipe which had exploded -  Mr Phillips purposefully made himself unavailable and refused to be in attendance.  We know from my insurance syndicate USAA November 30 1989 photos after the repair:

that  building superintendent had not followed contract engineers Joselow’s prescription to install a Series 100 Stainless Steel Flexonic Hoses.  And that is why the steam pipes and steam risers behind the wall of # 17 C continued to explode and fracture releasing vast amounts of asbestos every time.  Unless a series 100 Stainless Steel Flexonic Hose has ben installed on the Southwest living room riser - we can be assured that the steam pipe explosions are continuing today.

Criminal Rossi knew (as I told him) that the 55 Liberty Street contract plumber told me during his November 19 1989 visit to repair the exploded steampipe that “ he recognized the exploded fitting as his work from three years earlier (December 1986) and that the work he was contemporaneously repairing on November 19 1989 would explode again unless a Series 100 Stainless Steel Flexonic Hose was installed”.

Criminal Rossi knew that that old steam pipe, removed and replaced when the new steam-run out was installed, supplied incontrovertible evidence that the steam run -outs were fracturing:

And criminal Rossi knew that the red oak floor and ¾” subfloor removed by 55 Liberty’s contract carpenter Mark Brannon in August 1989 contained the signature chemicals of Con-Ed anti-corrosion chemicals.

Robert J Phillips had taken portions of the floor which his carpenter had cut out and sent it out for lab analysis.

Criminal Rossi knew that with careful coordination I had arranged with his predecessor:

for the Douglas Elliman/55 Liberty Street contract carpenter, Mark Brannon, to begin the floor removal on July 28 1989.

Criminal Stephan Rossi knew it was agreed and fully understood that my insurance syndicate’s adjuster Richard J Froese and building superintendent Robert J Phillips would be there on July 28 1989 when 55 Liberty Owners Corp carpenter arrived to remove the floor.

It was agreed that work would stop if water was discovered.

This arrangement was carefully documented.

Of course nobody shoe - except Mark Brannon the carpenter and 3 workers.

On July 28 1989, ¼” - ½” of ponded water was discovered as soon as 55 Liberty Street carpenter Mark Brannon, the building carpenter, and his crew of 3 other men, cut open the floor.  And work was immediately stopped.


After water was discovered on July 298 1989, I wrote the USAA adjuster:

 

And I also wrote 55 Liberty Owners Corp:

Criminal Rossi knew that the building’s assistant superintendent Joseph Pelican had attended the opening of the floor and witnessed the water welling up.

Criminal Rossi knew that my insurance syndicate USAA adjusted Richard J Froese had arrived on August 3rd 1989 to take photographs and to take with him a portion of the damp ConEd steam condensate soaked floor for forensic examination.

Then, right on schedule, on November 18th, the first day of the heating season, the steam pipe behind the Southwest living room wall exploded.

It is noteworthy to point out that it was a downstairs apartment which was immediately damaged by the resulting flood.

Criminal Rossi knew that on November 30 1989 our insurance syndicate USAA adjuster had visited and photographed the exploded steam pipe which had been repaired on November 19th 1989:

Criminal Rossi also knew that on November 30 1989 our insurance syndicate USAA adjuster had visited and photographed the water damage to the ceiling of #16C directly below.


Now - here is why Rossi (who just phoned - +1.917.453.5045 - 01 dec 17 2836 GMT) is a criminal.

On May 29 1990, criminal Rossi, as a fiduciary, lied in letter about the floor.

Criminal Rossi knew exactly how the floor had come to be damaged.

But here is what he wrote.

Here was my May 31 1990 response:

But the real reason why Rossi was (and still is) a criminal is that he knew at all times that it was our duty to restore all damage at/to 55 Liberty Street # 17C, regardless of cause or responsible party.

Criminal Rossi’s almost masterbatory indulgence in even discussing blame qua blame was itself a deception:  as blame wasn’t even an artifact of the process by which the leasehold would become repaired.

Rossi knew that the Koenig family was wholly responsible to restore the apartment - even if 911 terrorists had caused the building itself to collapse.

The first step to obtaining the repair was the 2nd/3rd party adjustment which Rossi controlled as the fiduciary and building manager.

From the 2nd/3rd party adjustment would flow, hopefully, with Douglas Elliman management involvement in selecting a contractor, the restoration.

If my insurer and subrogee, unincorporated insurance syndicate USAA, felt that 55 Liberty Owners had a financial responsibility with respect to the Koenig family property that USAA had paid to restore: that was a matter for subrogee USAA take up with 55 Liberty Owners Corp.

By the same token, if 55 Liberty Owners Corp felt hard-done-by in paying for repairs to damage to cooperative corporation property - believing that I had surreptitiously cut a hole in the floor and poured water into it  [47]:  a theory that criminal Rossi seems to have bought into  .  .  .  

then Greater New York Mutual Insurance Company (NAIC 22187) Policy # 1131M75921-S as subrogee to subrogor 55 Liberty Owners Corp’s interests could have and should have commenced an action against me.

In addition to the required P&C coverage, I also had an wrap-around  umbrella policy from unincorporated insurance syndicate USAA.

Any legal action from Greater New York Mutual Insurance Company (NAIC 22187) Policy # 1131M75921-S as subrogee to 55 Liberty Owners Corp’s subrogor interests would have happily triggered a defense.


The root of Rossi’s criminality is that he alone possessed the documents that could have produced the 2nd/3rd party adjustment.  And that by obscuring the canonical history of fixture ownership, which flowed from proprietary and institutional knowledge in the sole possession of the cooperative corporation - Rossi criminally frustrated a resolution.

And there is motivation as well.

And it seems that Rossi frustrated delivering a 2nd/3rd party adjustment and a demand that we restore on the orders of the board of the cooperative corporation -  as the board had failed to obtain insurance coverage.

Mr Rossi’s problem, today, is with the Board of Directors of 55 Liberty Street.

But for me - all that matters is that Stephen A Rossi and his hand-picked attorney instituted a fraud upon the court.

Rossi’s lawyer, Michael Seth Feuer, tainted the very proceedings of the court.

And those proceedings and all the county court records which have been stolen from the clerk’s office, are a nullity.

might not have been so quick to dismiss 55 Liberty Owners Corp if he had not been induced by Daniel White Esq to overlook the gravamen of the case - which was a canonical parsing of the canonical duties to restore a canonical NYC coop apartment from canonical steam-pipe explosion damage.  Had 55 Liberty Owners Corp fought the good fight which would have absolutely resulted in 55 Liberty’s complete exoneration (except for Stephen A Rossi’s dirty hands) - USAA would have paid the entire bill.

It is indeed possible that Justice Martin Schoenfeld was himself suborned.

We do know that 55 Liberty Owners Corp lawyer, Daniel White Esq, supplied 55 Liberty’s Robert J Phillips as a last minute witness.  55 Liberty’s Robert J Phillips perjured himself.

And that suggests that 55 Liberty Owners Corp and USAA were in cahoots.

If Justice Martin Schoenfeld was suborned - it was likely Robert J Spadaro who bribed him.  Spadaro knew that if 55 Liberty was allowed to stay in the action that the ultimate inevitable 55 Liberty exoneration would leave USAA holding the bag.

Without 55 Liberty Street as the counterpoint - USAA lawyer Spadaro’s bribery of Judge Diane Lebedeff was made all that much easier.
