HEALTH AND SAFETY GUIDELINES

By registering to visit, purchasing tickets for admission, or participating in our programs at The Nest (by The North Carolina Children’s Museum), you agree to abide by the following Health and Safety Liability Release and our Visitor Agreements. A copy of these can be provided to you upon arrival if requested.

Assumption Of Risk/Liability Release And Indemnification

By registering to visit, purchasing tickets for admission, or participating in our programs at The Nest (by The North Carolina Children’s Museum), you agree to release and hold harmless The Nest (by The North Carolina Children’s Museum) and/or any of its agents or representatives from any liability whatsoever arising out of injury to the person or property of the child or adult which may occur while participating in activities at The Nest. You further agree to indemnify The Nest in the event any claims are asserted against it arising from the child’s or adult’s participation. You understand and agree that in participating in any kind of activity, there are risks for injury or bodily harm and to agree to assume all such risks.

Illness

We require all children to stay home if they are feeling ill, including, but not limited to: fever,

cough, chills, new loss of taste or smell, or shortness of breath. If your child is too sick to go to school, they are also too sick to visit us!

Masks are available for both children and grown-ups upon request.

What to Expect

The Nest is an early learning environment and play space designed for ages 0-5. Many of our toys and materials are labeled by the manufacturer or supplier as safe for use by children under age 3 and free of choking hazards. However, some toys or materials intended for use by children older than age 3 may be accessible and/or pose a choking hazard to younger children. It is the responsibility of the adult caregiver accompanying the child to monitor their use of toys and materials to ensure their safety.  

The Nest space includes precautionary child-proofing such as outlet covers, corner covers, and child-proof locks on cabinets and drawers. However, it is the responsibility of the adult caregiver accompanying the child to monitor their safety while in the space.

All children must be accompanied by an adult caregiver while visiting The Nest during open play sessions. Children must always be supervised by their caregiver. The Nest is not a drop-off facility and staff members are not certified to provide child care.

COVID-19 LIABILITY RELEASE

ASSUMPTION OF RISK/LIABILITY RELEASE AND INDEMNIFICATION 

COVID-19 is an extremely contagious disease that can for some lead to severe illness or death. The Centers for Disease Control and Prevention provides additional information on COVID-19.

You and your family or members of your party shall be required to follow all posted or noticed rules while visiting The Nest (by The North Carolina Children’s Museum). The Nest may implement enhanced health and safety measures for your protection and that of other guests and staff. These include encouragement of wearing a face covering/mask to help control the spread of COVID-19. In addition, The Nest reserves the right to impose any additional restrictions at or before the time of your visit as new or additional information or requirements are made known by local, state, or national health experts.

By entering The Nest, you and your family or members of your party agree to adhere to all Nest rules and instructions and voluntarily assume all risks related to exposure to COVID-19. You and your family and members of your party also agree to waive all claims arising from, connected, or related to your visit, including screenings that occur prior to your visit, and rules required at the time of your visit.

By purchasing tickets to The Nest, you and your family or members of your party agree that your assumption of risk and waiver will apply to heirs, executors, administrators, and next of kin. By accepting a timed entry reservation, you and your family or members of your party agree and covenant not to sue, and forever discharge The Nest, its employees, its agents, its contractors, and its partners from all liabilities, claims, actions, damages, costs or expenses of any nature ("Claims") arising out of or in any way connected with or related to your visit, and further agree to indemnify and hold harmless The Nest from and against any and all such Claims arising out of or in any way connected with or related to your visit, including, but not limited to, all attorneys' fees and disbursements through and including any appeal.

By entering The Nest, you and your family or members of your party expressly acknowledge that all understand that this assumption and release includes any Claims based on the negligence, action, or inaction of The Nest, its employees, agents, contractors, or its partners, and covers bodily injury (including death), whether suffered at the initiation, during, or after your visit, as such actions relate to COVID-19, or arise out of actions taken to protect the public from COVID-19. This includes actions as a result of indirect efforts by The Nest, including constitutional claims and claims related to privacy.
