                                                                       OPEN LETTER

Ladies & Gentlemen,  

We address you today on a most urgent matter that is being perpetrated by the unlawful actions of Daniel Ortega and his Sandinista Government. We are well aware of the promises made to the Russian Government by Ortega. Perhaps you did not investigate the matter deep enough because it is our belief that if you did you would know that Mr.Ortega has no rights to the Miskitu lands! The Miskitu Kingdom that existed prior to the five republics, became free and is no longer annexed to Nicaragua or any of the five republics since 1957 when the treaties expired

  The true owners and decision makers are the Miskitu Peoples, Council of Elders, Royal Families (of all twelve tribes), and the traditional Miskitu officials and elected leaders. Not whomever Mr. Ortega deems fit to rule over us. We reserve the right to elect our own representatives. We refuse the ones hand-picked by the very illegal genocidal government of Daniel Ortega, Rosario Murillo, and the Sandinista Party, who send out Colonos from the Pacific who commit atrocities against us.

We believe that wealth lies in communities and in the people’s ability to produce and consume their own products. So that the money transfer is for everybody and does not end up in the hands of a relative few. If you can’t buy what you produce then there is no incentive. it’s the spread of the wealth that creates ultimate wealth. The destruction of natural resources only contributes to the depletion of wealth. If we have the ability to replace the natural resources we use we would ultimately have a surplus and we go back later to reuse it. This sort of ecological and environmental preservation has always been the Miskitu (and many other “Indigenous” Nations) belief and what they’ve practiced for hundreds of years.

The lands and islands that Russia and China, all other foreign companies have ceased; the minerals and ecological resources that they mine, deforest and fish in on the Miskitu Coast do not belong to Nicaragua. Mr. Ortega had no right to negotiate anything on the Atlantic Coast with anyone without the consent of all its inhabitants, traditional authorities, and heirs of the Miskitu Kingdom. Those lands belong to the people whose ancestors cultivated it and whose offspring have to continue to cultivate it even now.

These are not Roman times! We claim to have evolved and to be civilized so why is this neanderthal like leadership in existence. We have one world and we are all born in it and have the right to life, health, love, peace, justice, safety and a peaceful lucrative existence from our hard work.

There is no reason to kill us for money made from our natural resources. Anyone associated with the stupidity and reprehensible behavior of the Sandinista Regime is not a good business partner. We find it hard to believe that the Russians, Chinese, Inter-American Bank, UN Global Compact, B2Gold, HEMCO or any Multi-National Business would want to be associated with Daniel Ortega and his unlawful cowardly behavior. There is a simple logical way of doing good business. You could have more than what you already have an infinite wealth. Money is a medium of exchange. As a medium of exchange, such as the dollar has the velocity, that is to say, it moves from one point to another at any given time. To measure that from Las Vegas -Soviet Union -China- Africa and so on. The point is that if you stop that flow and accumulate it all in one place then nobody benefits from that. So the problem is not to produce but to spread. Spreading the wealth between the people and conserving/protecting that from which wealth is created and those who cultivate it is to have an abundance surplus and that is what a civilized intelligent free economy does.

We are letting the Russian Federation, China, HEMCO, B2Gold, UN Global Compact and the Inter American World Bank know what you are partaking in. We are informing you that by continuing to do business on the Atlantic Coast of Miskitu Kingdom, without consent from its peoples you are complicit in genocide.

  No one race or gender is superior just for the simple act of being born. Supremacy comes from skill, talent, education, product, character and actions. The Miskitu government in exile is presently challenging the government of Nicaragua now led by Daniel Ortega and others under these very authorities in the United States District Courts.

We are letting you, the Russian Federation, China, B2Gold, HEMCO, Multi National companies and the Inter American world bank know what you are involved in. We are informing you that by continuing to do business in the Atlantic Coast of Miskitu Kingdom you are complicit in genocide

•  150 nations (including the United States), defines genocide as follows:

•      [A]ny of the following acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such: (a) Killing members of the group; (b) Causing serious bodily or mental harm to members of the group; [or] (c) Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part . . .

•      This definition of genocide is “generally accepted for purposes of customary [international] law.” Restatement (Third) of the Foreign Relations Law of the United States § 702 cmt. d. It appears not only in the Genocide Convention itself, but also in numerous other international treaties. See, e.g., Rome Statute of the International Criminal Court art. 6, July 17, 1998, 2187 U.N.T.S. 90; Statute of the International Tribunal for Rwanda art. 2 (1994); Statute of the International Criminal Tribunal for the Former Yugoslavia art. 4 (1993). The offense of genocide under U.S. domestic law uses the same definition. See 18 U.S.C. § 1091(a).

•      Such a burden of “complicity” where rules require those in authority to act on behalf of a party where claims of genocide and torture are against one of the parties would compromise the court’s neutrality under Title 18 USC § Code 4 where it is common knowledge as well as publicly known, being aware that the defendant's’ conduct is both continuous and felonious (genocide and torture) and failing to act to protect the plaintiffs by being compelled into a conspiracy against the plaintiffs’ rights under Title 18 §241 Conspiracy against rights for failing to do so.

• Additional Protocol I ("AP I") of 1977 to the Geneva Conventions of 1949, Articles 86(2) and 87, inclusively Additional Protocol I and the Statutes of the ICTY, the ICTR, and the ICC makes prevention or prosecution of crimes mandatory that also affords us this right.

•      Under the Foreign Sovereign Immunities Act, since the Ortega regime has been and is continuing to commit genocide against our people and involved in an unlawful taking and expropriation of property without compensation his government is in violation of international law and 28 U.S.C. § 1605(a)(3). It is undisputed that genocide itself is a violation of international law. See, e.g., Tel-Oren v. Libyan Arab Republic, 726 F.2d 774, 791 n.20 (D.C. Cir. 1984) (Edwards, J., concurring); accord, Abelesz v. OTP Bank, 692 F.3d 638 at 675-76 (7th Cir. 2012)...

•      Congress has also authorized aliens to bring federal common law tort actions in federal courts for violations of the law of nations to avoid the diplomatic problems that may otherwise result from adjudication of these civil claims in state courts. William R. Casto, The Federal Courts' Protective Jurisdiction Over Torts Committed in Violation of the Law of Nations, 18 Conn. L. Rev. 467, 468-69 (1985-1986); and 2 Emmerich de Vattel, Law of Nations, ch. 6 §§ 71-72 (Joseph Chitty, trans. and ed., T. J. W. Johnson & Co. 1867) (1758) (the law of nations provides a private remedy for foreigners injured by violations of international or domestic law and is an essential means of reducing friction between nations.).

•     See Abelesz, 692 F.3d at 675-76. Rather, the expropriations were themselves genocide. Since the wrongfully taking of Miskitu properties was inextricably linked to the mass killings and genocide of these peoples, plaintiffs’ property-based claims fall squarely within the FSIA’s expropriation exception.

• See Phoenix Consulting Inc. v. Republic of Angola, 216 F.3d 36, 40 (D.C. Cir. 2000). Such expropriations, therefore, constitute “tak[ings] in violation of international law.” 28 U.S.C. § 1605(a)(3).

       We would like to close by  bringing to your attention, the United Nations Resolution 650 along with the ILO, Tribal peoples, Convention 1989 (No.169) to make the position  of the Miskitu Nation quite clear:

 In Guatemala, Convention No. 169 was an instrumental agent in the signing of peace agreements that put an end to 30 years of civil war between indigenous groups and the government.

  Article 2

• 1. Governments shall have the responsibility for developing, with the participation of the peoples concerned, co-ordinated and systematic action to protect the rights of these peoples and to guarantee respect for their integrity

                                                                                 Article 3

• 2. No form of force or coercion shall be used in violation of the human rights and fundamental freedoms of the peoples concerned, including the rights contained in this Convention.

                                                                            Article 12

  The peoples concerned shall be safeguarded against the abuse of their rights and shall be able to take legal proceedings, either individually or through their representative bodies, for the effective protection of these rights. Measures shall be taken to ensure that members of these peoples can understand and be understood in legal proceedings, where necessary through the provision of interpretation or by other effective means.

   All things have a natural order. Our ancestors united and created civilization, tribes, traditions and cultures in one Miskitu Nation and we all honor and maintain what they started while still allowing room for advancement and  change. We are human beings. We can't dictate the feelings of others but we must control impulses and actions. Rules and laws exist to do just that. They also exist to maintain fairness and peace.

  True leaders, lead and don’t follow fads or cliques, They know the importance of their post. They do not destroy people's properties or physically injure them. They do not kill someone because they have an opposing opinion or because they want what does not belong to them.   A Superior person leads, through logic, neutrality, and through the upholding of created laws that allows for all people's rights to be enforced. A true leader does not allow his people to suffer, be uneducated, starve, or leave the sick and diseased untreated then looks down on his her people. How you lead is a reflection of who you are. If a current leader is not  allowing for all people's rights and advancing their people? That is poor! Those who look the other way when they have in their hands the power to change things to good or grand are those who deal, conspire with and protect who serves their and evil purposes only. We call on you to put an end to the suffering of the Miskitu people. We call for a change in the way we lead.

   We will continue to repeat this; “ Any human being on the earth through Degradation, Marginalization, and Oppression can become ignorant and be raised ignorant on that same note we all come to the planet ignorant and can be learned to brilliance.

  We Miskitu Nation believe we can have harmony, between technology, humanity, industry, business, privacy, ecology, education, development, sciences, global wealth through understanding and intelligent enforcement and obedience of inalienable rights for all!
