This Privacy Policy sets out the privacy policies and practices for Big Head Club Ltd., a British Columbia, Canada, corporation (collectively “Big Head”, “we” or “us”) with respect to the collection, use, and disclosure of your personal and non-personal information through any tool, websites, applications, products or services we provide (collectively, the “Services”). For purposes of clarity, when we refer to a “device” in this Privacy Policy, we mean any device, including smartphones, tablets, laptops, desktops or any other device that is used to access or interact with the Services. COLLECTION OF PERSONAL INFORMATION: Big Head generally collects your personal information through:

any interactions that you have with Big Head (for example, by contacting or submitting information to Big Head for any purpose).

The personal information that Big Head collects will vary depending on the Services that you are using, and how you access and use our Services, but may include your name, contact information (such as email address), and social media information.

Web Beacon/Pixel Tags

SOCIAL ACTIVITIES: By using the Services, you may elect to disclose Personal Information on or within the Website and other services to which you are able to post information and content (including, without limitation, our social media pages). Please note that any information you post or disclose through these services will become public and may be available to other users and the general public. When you connect your Services account with your social media account, you will share information with your friends associated with your social media account, with other users, and with your social media account provider. With third-party identity verification services in order to prevent fraud. This allows Big Head to confirm your identity by comparing the information you provide us to public records and other third-party databases. These service providers may create derivative data based on your personal information that can be used in connection with the provision of identity verification and fraud prevention services.
With service providers under contract who help with parts of our business operations. Our contracts require these service providers to only use your information in connection with the services they perform for us and prohibit them from selling your information to anyone else. Examples of the types of service providers we may share personal information with (other than those mentioned above) include Network infrastructure, Cloud storage, Payment processing, Transaction monitoring, Security, Document repository services, Customer, Marketing, and Data Analytics. For example, we are using Strikingly (https://www.strikingly.com/) for the purpose of having a website.
With our professional advisors who provide banking, legal, compliance, insurance, accounting, or other consulting services in order to complete third-party financial, technical, compliance, and legal audits of our operations or otherwise comply with our legal obligations.
With companies or other entities that we plan to merge with or be acquired by. You will receive prior notice of any change in applicable policies
With law enforcement, officials, or other third parties when we are compelled to do so by a subpoena, court order, or similar legal procedure, or when we believe in good faith that the disclosure of personal information is necessary to prevent physical harm or financial loss, to report suspected illegal activity.

RETENTION OF PERSONAL INFORMATION: Big Head will retain personal information only as long as necessary for the purposes outlined in this Privacy Policy or as required or permitted by law.

PRIVACY OF CHILDREN: Big Head does not knowingly collect personal information from children under 16 without appropriate parental notice and consent. If you are under 16, please do not attempt to use the Website or send any information about yourself to Big Head, including your name, address, telephone number, or email address. No one under the age of 16 may provide any personal information to Big Head. In the event that Big Head learns that it has collected personal information from a child under age 16 without verification of parental consent, Big Head will delete that information as quickly as possible. If you believe that Big Head might have any information from or about a child under 16, please contact Big Head’s privacy officer.
SECURITY: Big Head takes steps to protect the loss, misuse, and alteration of the personal information that it holds. Big Head seeks to limit access to personal information to individuals who Big Head reasonably believes need to access the information to utilize the information as set out in this Privacy Policy. However, it is possible that any information transmitted via the Internet may be intercepted by unknown third parties. Please note that no system can be guaranteed to be 100% secure. Therefore, while we strive to employ reasonable protections for your information that are appropriate to its sensitivity, we cannot guarantee or warrant the security of the information you share with us and we cannot be responsible for the theft, destruction, loss, or inadvertent disclosure of your information.
COMPLAINTS: You may direct a written complaint regarding compliance with this Privacy Policy to the Privacy Officer. If the Privacy Officer allows the complaint, Big Head will take appropriate measures necessary to rectify the source of the complaint. Separately, you may also be able to lodge a complaint with a supervisory authority or privacy commissioner of your applicable jurisdiction.
INTERNATIONAL DATA TRANSFER: Under the General Data Protection Regulation (GDPR) and other data protection laws, information about you may only be transferred to the European Economic Area (EEA) to outside the EEA if adequate data protections are in place. Our Services are managed by Big Head’s headquarters in British Columbia, Canada. As the European Commission considers Canada to be a country that provides adequate data protection, information about you may be transferred from the EEA to Canada.
Big Head also uses third-party service providers, such as managed hosting providers, credit card processors, and technology partners to provide the software, networking, infrastructure, and other services required to operate the Services. These third-party providers may process or store personal data on servers outside of the EEA and Switzerland, including in Canada or the US. We rely on adequacy (if sent to Canada), the service provider’s registration in the EU-US Privacy Shield and Swiss-US Privacy Shield (if sent to the US), and/or standard contractual clauses (if sent to the US or onward to other countries) to ensure that information about you is lawfully transferred under EU law.

CALIFORNIA PRIVACY RIGHTS: California Civil Code Section 1798.83 allows users who are California residents and have provided their personal information to us to request information about our disclosures of certain categories of personal information to third parties for their direct marketing purposes. Within thirty (30) days of receiving such a request, we will provide a list of the categories of personal information disclosed to third parties for third-party direct marketing purposes during the immediately preceding year, along with the names and addresses of those third parties. This request may be made no more than once per calendar year.
California Consumer Privacy Act (“CCPA”) provides California residents certain rights with respect to their personal information, including the right to request the identity of any third parties to whom the resident’s personal information was shared if such sharing was to enable the third party’s direct marketing efforts. Other rights provided by the CCPA include:

An ability to appoint a third-party representative to assist you with exercising your rights provided that Big Head may ask to verify your identity and such representatives authority; and

Please note that Big Head does not discriminate in its provision of Services to you based on exercising your rights. Your requests to delete data is limited to data that Big Head is not allowed to retain under the CCPA. Big Head may retain data for certain purposes, including completing transactions for you or reasonably related to completing transactions for you, detecting security incidents, illegal activity, and fraud, maintaining our systems, complying with applicable law and legal obligations, engaging in public or peer-reviewed research provided we comply with applicable ethics and privacy laws related to such research, or enabling solely internal purposes such as financial recordkeeping.
