Below are the terms and conditions set forth by Orange County Sandbagger:

1. OC Sandbagger provides temporary erosion control and temporary rentals
2. OC Sandbagger does not warranty materials or installation that is subsequently damaged
3. Minimum 48 hour lead time for all job requests except emergencies
4. Installation based on trencher & truck accessible prepared areas free of weeds, trash and other debris
5. Installation price may increase with an hourly charge for labor and/or equipment due to difficult or rocky soil conditions or poor access
6. Neither payment nor performance bonds included
7.  Materials & services not provided by or shown on OC Sandbagger price list charged @ cost plus 15% (including dump or recycling fees, etc)
8. Payment terms:  No retention; 1st time customers COD, credit card or approved credit application, net 30 terms; 1.5% per mo finance charge on unpaid balance
9. Customer agrees to pay for additional administrative services and costs such as insurance certificates, waivers of subrogation, additional insureds, city business licenses, certified payroll, etc. if required for payment
10.  Sales tax applies to materials and delivery charges
11. No traffic control included
12. Standard crew consists of one foreman and two laborers
13. All work performed shall be at the request and direction of the customer's job superintendent or project manager
14. Labor rates are for landscape maintenance laborers, other classifications are billed accordingly.  All labor is port-to-port, 4 hr minimum.
15. Regular work hours M - F from 7:00 am to 3:30 pm, portal to portal, beginning when crew loads or is dispatched
16. Overtime hours M - F at 1.5 x regular hourly rate from 3:30 pm to 6:30 pm & Sat 7:00 am to 3:30 pm
17. Double-time hours M - F from 6:30 pm to 7:00 am, Sat 3:30 pm to Mon 7:00 am including Sundays & holidays
18. Standby charges apply if crews are idle more than 30 minutes
19. Trucking and T & M labor rates based on 4 hour minimum during regular working hours
20. Equipment charged daily rate, including operator, 1/2 day minimum including travel
21. Rental equipment requested by contractor to be onsite that is not operated will be charged the daily rate until rental terminated
22. Prices include one move-on; additional move-ons subject to time & materials charges.  
23. Water to be provided by customer through 2 1/2" meter hydrant or equivalent connection if needed to complete job
24. Customer is responsible for full replacement cost on damaged materials and/or equipment
25. This proposal is valid for 30 days
26. 4% credit card convenience fee (min. $2.00) added to all invoices paid by credit card
