Niswonger Online & AP Access for ALL

Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Niswonger Online and AP Access for ALL (APAA) Programs provided by Niswonger Foundation. By accessing or using these programs, you agree to these Terms.
1. Access to the Programs:
- School System/ High School Use: To access the Niswonger Online/ APAA programs, the local LEA must sign a standard Memorandum of Understanding (MOU). Once the MOU is approved and signed, use and access will begin immediately.
- Student Use: Students should be at least 13 years old (grade levels 8-12) to participate in the Niswonger Online program and at least 14 years old (grade levels 9-12) to participate in the AP Access for ALL Program. By accessing the program, the LEA enrolling confirms that the enrolled students meet this age requirement. If an LEA has an exceptional student who is under the age of 13 but requires our online courses, the enrollment can proceed. However, the school must follow all COPPA policies regarding this student before student information is shared.
- Guardian Access: LEAs may choose to link a parent or guardian to a student's enrolled account to monitor the student's progress. Schools are responsible for managing this decision and must promptly update this information in case of changes in custody or other circumstances.
2. Program Usage:
- The enrolling LEA agrees to use the program solely for its intended purpose of accessing educational resources, materials, and support services provided by Niswonger Online and APAA.
- LEAs will not use the program for any unlawful or prohibited purpose, including but not limited to violating any applicable laws or regulations.
3. Account Registration:
- To access certain features of the program, the LEA may be required to create an account and create accounts for students and guardians. The LEA agrees to provide accurate, current, and complete information during the registration process and to update it to keep it current and complete.
- The LEA and high school Liaison are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under the account(s). Stakeholders agree to notify us immediately of any unauthorized use of the account or any other breach of security.
4. Intellectual Property:
- The program and its contents, including but not limited to text, graphics, logos, images, and software, are the property of the Niswonger Foundation.
- You may not modify, reproduce, distribute, or create derivative works based on the program or any part thereof without the prior written consent of the Niswonger Foundation President/ CEO or the Niswonger Online Executive Director.
5. Privacy:
- LEA use of the program is subject to our Privacy Policy, which governs the collection, use, and disclosure of student and guardian personal information. By using the program, you consent to the terms of our Privacy Policy.

6. Modifications to the Terms:
- Niswonger Online and AP Access for ALL administration reserves the right to modify or update these Terms at any time without prior notice. Any changes to the Terms will be effective immediately upon posting. Your continued use of the program after the posting of any changes constitutes acceptance of those changes.
7. Termination:
- The Niswonger Online/ APAA Executive Director reserves the right to suspend or terminate LEA, student, or guardian access to the program at any time for any reason without prior notice or liability.
8. Contact Us:
By accessing or using Niswonger Online and/or the AP Access for ALL Program, partnering LEAs agree to abide by these Terms of Use. If the governing local educational agency (LEA) does not agree to these Terms, please do not access or use these programs.
