AB 2943: Speech Censorship and Viewpoint ban on Book Addressing Same-sex Attractions

AB 2943 makes advertising or selling goods and services to someone in California that helps him or her overcome unwanted gender confusion or same-sex attractions illegal. The bill does this by prohibiting both speech content about homosexuality, having a viewpoint that such lifestyle is unhealthy, harmful, or immoral, and speech content with the view that it’s ok to choose to work towards overcoming unwanted same-sex desires to develop heterosexual desires. The bill labels this type of speech as fraud under the Consumer Protection Act so that anyone who speaks or writes with opposing views on same-sex attractions in the context of earning their living, may be sued.  The only time anyone can advertise, distribute books and resources, or provide a service such as counseling on same-sex attractions with an opposing viewpoint, is when they do it for free.  

Unfair Speech Viewpoint Censorship

I.        Authors Prohibited from Selling         Books with Banned Viewpoints on         Homosexuality

A counselor or scientist who writes a book on how to overcome same-sex desires and the harmful effects of homosexual practices on health cannot sell the book, but will have to give it away for free even though it costs money, and requires intellectual work to write a book and have it published.  

II.        Bible Sales Banned for Prohibited         Viewpoints on Homosexuality

Bibles and other religion-based books would be banned from being sold by booksellers such as Amazon and Barnes & Noble.

III.        Married Man Denied Counseling to help         him Remain Faithful to his Wife

A married man who struggles with same-sex attractions who wants to remain faithful to his wife and children, will not be able to pay even a nominal amount of money for counseling sessions with a licensed therapist or religious counselor who will support his desire to remain faithful to his wife. However, had this same man been struggling with unwanted sexual attractions to a woman who was not his wife, he would be able to pay counselors to help him to eliminate those unwanted desires.

IV.        Conference Speakers Sued for Speech         with Prohibited Views on         Homosexuality

Pastors and therapists would be sued for speaking at a conference on marriage and sexuality, if the attendees pay a fee to attend when the conference topic includes perspectives based on scientific findings or religious beliefs that teach how to overcome unwanted same-sex attractions. Organizations sponsoring such conferences would also be subject to liability.

V.        Pastor Sued for Recommending a         Book Available at the Church         Bookstore

A pastor could be sued for illegal advertising, if during a sermon he recommends a book for sale in the church bookstore that addresses homosexuality as sin.

VI.        Professionals must Undergo Censorship or         Give up Earning Their Living

  Counselors, pastors, book sellers, schools and colleges, conferences sponsored by church and secular organizations, publishers, and medical and mental health care professionals will have to choose between their income or their ability to speak freely to clients to address how to overcome unwanted same-sex attractions. They will have to live under censorship just to  get paid for their work.

AB 2943 has been passed in the Assembly and referred to the Senate Judiciary Committee. A hearing will be scheduled soon.

Make phone calls to the Senate Judiciary Committee. When you call, be polite but firm. Introduce yourself, say you are calling to ask Senator (insert name) to vote no on AB 2943 by Assembly Member Low.  If asked, give the receptionist your zip code. Say thank you and goodbye. And you’re done! The call should take about two or three minutes.

On Tuesday May 15, 2018 the California Family Council is organizing a Day of Action to oppose AB 2943 on the North Steps at the State Capital in Sacramento from 1:00 pm to 4:00 pm.
