 Fulcrum Design, LLC Privacy Policy

VQ.Axper.com is managed and supported by Axper, Inc. (“Axper”) and powered by Fulcrum Design, LLC (“Fulcrum Design”). The terms "we", "our", or "us" When used in  this Agreement, refers to Axper and/or Fulcrum Design, and the terms “you,” “your”, and “user” will refer to you.

Fulcrum Design's Privacy Policy is designed to help you (“end user”) understand the collection, use, and disclosure of personal information that may be collected by Fulcrum Design anytime you interact with Fulcrum Design websites, applications, and services (referred to collectively as the "Services" in this document). End user personal information and privacy is a priority at Fulcrum Design and we go to great lengths to ensure it is protected internally and externally. However, no information system is 100% secure, so we cannot guarantee the absolute security of your information at all times.

By using or accessing Fulcrum Design either directly or through one of our partner or affiliates, you are accepting the practices described in this Privacy Policy. Please take a few moments to read this policy and learn more about the type of information gathered and how we use it.

Message Recipients Opt Out

We are in compliance with industry standards and federal regulations, any customer/recipient who opts-out using STOP keyword or replies L to leave a line, will be added to an opt-out list (blacklist) and will not be sent any further messages until or unless they opt back in, by joining a queue or opting in.

Information Collected and Why

We collect data associated with account users, such a session ID cookies to confirm that users are logged in and keep you logged in until you log out. By default, we use a persistent cookie that stores your login ID and password to make it easier for you to login when you return to use the Fulcrum Design service. You can remove or block this cookie using the settings in your browser if you want to disable this convenience feature.


When using one of Fulcrum Design’s SaaS such as QueueMobile, Student Q and Court Q or any varation on our automated queue management services.  Personal data collected is limited to the use of the applications, such as name, cell phone number, Case ID, notes, and messaging.  User data is necessary to provide:


Retention of Data

To serve our clients with both short-term and long-term uses of data, we retain personal data indefinitely and do not purge it periodically. This allows us to compare information, such as average wait times, satisfaction rates, times of high, low and medium customer volume, average drop-out rates, average lengths of time between notifying a customer that the customer is next in line to the customer’s arrival at the client’s location, etc. over years where desired.
However, we can accommodate clients who prefer a data delation policy.

Use of Data

Fulcrum Design does not currently, nor has plans to sell personal data that we collect, process and/or store. If we wish to sell personal data in the future, we will ask for the User’s consent.

Fulcrum Design does not currently transfer data that we collect to third parties other than in response to a request from a data subject that we provide data in a machine-readable format and send it to another data controller. This is called “data portability”.

Security

The Fulcrum Design website and SaaS platforms have reasonable administrative, technical, and physical safeguards in place designed to protect your personal information from loss, misuse, and unauthorized access, disclosure, alternation, or destruction. Fulcrum Design utilizes managed services through a secure data center using industry adopted server and database security measures. Fulcrum Design also limits its employee’s access to personal information. Despite these protections, no information system is 100% secure, so we cannot guarantee the absolute security of your information at all times.

Compliance

We may be required to disclose user information pursuant to lawful requests, such as subpoenas or court orders, or in compliance with applicable laws. We do not reveal information until we have a good faith belief that an information request by law enforcement or private litigants meets applicable legal standards. This may include sharing information with other companies, lawyers, agents or government agencies.

In addition to our compliance with applicable state and federal laws, including Regulation of Investigatory Powers Act 2000, the Telecommunications (Lawful Business Practice) (Interception of Communications) Regulations 2000 (SI 2000/2699), the Electronic Communications Data Protection Directive (2002/58/EC), the Privacy and Electronic Communications (EC Directive Regulations 2003 (SI 2426/2003); the Gramm-Leach- Bliley Act; and with the EU General Data Privacy Regulation, we also ask our clients to confirm that they will comply with applicable laws as part of our contracts with them.

Compliance with the Children Online Privacy Act - Children should request permission from their parent or guardian prior to sending personal information online. Fulcrum Design does not knowingly collect personal data from individuals under the age of 13. If you are under the age of 13, please do not submit any personal data into our SaaS platforms. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce our Privacy Policy by instructing their children never to provide personal data without their permission. If you have reason to believe that a child under the age of 13 has provided personal data, please contact us at support@fulcrumdesignllc.com and we will use reasonable efforts to assist in the deletion of the child’s personal information.

Terms of Use, Notices, and Revisions

Fulcrum Design may update its privacy policy from time to time. When we change the policy in a material way a notice will be emailed to our clients and a link to the updated privacy policy. We encourage you to refer to this policy on an ongoing basis so that you understand our current privacy policy. Unless stated otherwise, our current privacy policy applies to all information that we have about you and your account.
